He asked his family and friends witnessing the execution to take care of someone, which was inaudible.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"WUSTVTK7L5ATJBVCJ4H5TODBLI\">\u201cI didn\u2019t do anything to be on death row,\u201d he said again.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"YGDVJYJLDBHW3L3MTATJEP26CY\">Following his final words, the gas appeared to start flowing into the gas mask fitted on his face at 6:16 p.m. His fingers moved slightly on the gurney as his spiritual advisor approached him and touched his leg.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"VYDSJBGBUFARTH4RP45LLIB7W4\">He struggled against the restraints on the gurney, shaking and trembling for about two minutes. On Wednesday, Miller was visited by his two sisters, brother, and brother-in-law, along with his spiritual advisor, and two attorneys.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"DIVMCNE22VCBFOXXY3AUNGBEIY\">He refused Wednesday\u2019s formal meals, but ate a Philly cheesesteak sandwich, pizza, a chicken sub sandwich, a chicken burrito, several sodas and a bottle of water.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"Z6PCQ3OBINFJLIS7D5DGYIZZBE\">On Thursday, Miller was visited by three attorneys, a friend, his brother-in-law, two sisters, brother and spiritual advisor. He didn\u2019t make any phone calls.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"DWDGZNU3LNAHZBHQXGE3IPUBV4\">He refused his breakfast on Thursday but did accept a final meal of hamburger steak, a baked potato, and French fries.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"EVIGC2FNFBHFDJJEX7CIFKLVVQ\">He\u2019s slated to have six witnesses: a friend, two sisters, brother and two attorneys.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"OOG6T6WSZBFOPCWHEJZOZCGVDQ\"><i>This story will be updated throughout the evening, with live updates appearing at the top of the page. The original story will continue below.<\/i><\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"OPSZV5COJFGBROZZ6DEKEX7FT4\">An Alabama Death Row inmate, convicted of killing three men in a workplace shooting, is set to die Thursday evening, the second inmate in the country to be executed using nitrogen gas.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"J36PYAEAT5CXDNCKGGUVH6UXJY\">Alan Eugene Miller, 59, is scheduled to be executed at 6 p.m. at William C. Holman Correctional Facility in Atmore. The prison, located just north of the Florida border, is the only facility in the state equipped with an execution chamber and where most of the state\u2019s death row inmates are housed.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"CQTV5VIKEFBNNM5HBKWNOJL424\">His nitrogen hypoxia execution is set to go forward after Miller reached a <a href=\"https:\/\/www.al.com\/news\/2024\/08\/alabama-settles-case-with-death-row-inmate-set-to-die-in-september.html\" target=\"_blank\" rel=\"noopener\">confidential settlement<\/a> with the state in August and his federal lawsuit was dismissed.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"AFLYE4YWSVAEJDL3HXYANLXI4Y\">It will be the second time Miller enters Alabama\u2019s execution chamber.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"7OMJD2WN4FELNK6OEOJB57DR7A\"><a href=\"https:\/\/www.al.com\/news\/birmingham\/2022\/09\/alan-miller-awaits-decision-on-whether-alabama-will-execute-him-tonight.html\" target=\"_blank\" rel=\"noopener\">Miller was first set to die <\/a>by Alabama\u2019s three-drug lethal injection cocktail in September 2022, but prison officials called off that execution about 30 minutes before the state\u2019s death warrant expired. Miller\u2019s veins couldn\u2019t be accessed within execution protocol time limits.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ONF6ZBSKWVEXDFSROFNK5GMMEM\">Miller was convicted in the Aug. 5, 1999 Shelby County shootings in which he killed Terry Jarvis, 39, Lee Holdbrooks, 32, and Scott Yancy, 28. The shootings happened at two businesses where Miller worked and had previously worked.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"P24UVYHQLZGZHFERUOA4LRQMFY\">Holdbrooks and Yancy were employees of Ferguson Enterprises, while Jarvis worked for Post Airgas in Pelham.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"DIQV2PLHRJGWFIEQ6V7USCUNRI\"><b>First attempted execution<\/b><\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"R3Z5DOHDURHL5L3K2T3AECVGS4\">The state first tried to execute Miller two years ago, on Sept. 22, 2022, using lethal injection.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4EI4F7NX5FA6TMB5KJYRMW7VMA\">The execution was called off at approximately 11:30 p.m. because of issues accessing Miller\u2019s veins, Alabama Department of Corrections Commissioner John Hamm told reporters gathered at the prison system media center. At the time, the state\u2019s death warrant expired at midnight \u2014 meaning the execution couldn\u2019t happen after 12 a.m. \u2014 and there wouldn\u2019t have been enough time left to finish setting up the IVs and preform the lethal injection.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"VJIVXVJEIFFFXF4KSYA7ZRYSMY\">Miller\u2019s legal battles prior to that execution attempt centered around his claims that in June 2018, he completed a form distributed to death row inmates at Holman electing to die by the state\u2019s newly approved method of execution, nitrogen hypoxia, instead of the default method of lethal injection.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ZCGLMPT4OBC7RCBM6UZBUPWDNU\"><a href=\"https:\/\/www.al.com\/news\/birmingham\/2022\/09\/alabama-attorney-generals-office-appeals-judges-ruling-calling-off-thursday-execution.html\" target=\"_blank\" rel=\"noopener\">The AG\u2019s Office argued <\/a>there was no record of that form being submitted, and that he should be executed using lethal injection instead.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BFVOUSZ5I5F3DKWYPKAEYYSWRI\">The U.S. Supreme Court had issued a ruling that sided with the state just after 9 p.m. the night of the first execution attempt, giving the prison nearly three hours to conduct the execution before the death warrant expired.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ZQE3RC7OVBCVRLNV37JMGFYCDQ\">At the time, Hamm said the execution team tried to access Miller\u2019s veins to insert the IV lines for the three-drug lethal injection cocktail. When pressed what was being done during that nearly three-hour period, Hamm would not elaborate. \u201cLike I said, there are several things that we have to do before we even start accessing the veins. And that was taking a little bit longer than we anticipated.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"VCETP4UBURDGRGPLVSCMDF5QFU\">Miller <a href=\"https:\/\/www.al.com\/news\/2022\/10\/alan-miller-claims-alabama-prison-workers-poked-him-for-90-minutes-looking-for-vein-in-failed-execution.html\" target=\"_blank\" rel=\"noopener\">claimed later in a lawsuit <\/a>that prison workers poked him for 90 minutes trying to start an IV. And later, <a href=\"https:\/\/www.al.com\/news\/2022\/11\/alabama-agrees-not-to-execute-death-row-inmate-alan-miller-by-lethal-injection-settles-federal-lawsuit.html\" target=\"_blank\" rel=\"noopener\">the state agreed with Miller\u2019s lawyers<\/a> in a federal lawsuit that it would not seek to execute Miller by lethal injection again, and that any attempt to execute him in the future would be done with nitrogen gas.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"VXFJM3ZGFNBJXP3VUHAL6QDOXI\">In 2022, when the lethal injection attempt happened, the state hadn\u2019t yet begun using nitrogen.<\/p>\n<section class=\"Stories-By-Section-Tag-module_wrapper__69Ed7 Stories-By-Section-Tag-module_al__jY2oy\"\/>\n<p class=\"article__paragraph article__paragraph--left\" id=\"PBNBYHQLTFFW5HMKAFZPZYMC2Q\"><b>Nitrogen hypoxia<\/b><\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"WOWWWA75PRBM3A2W3LPCVNK3CE\">If Miller\u2019s execution happens Thursday night, it will be the second carried out in America using the method of nitrogen hypoxia \u2014 having an inmate breathe in pure nitrogen, lose consciousness and die of asphyxiation.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"POGQDTXAJFDK7ENPIXGEGJQQTY\">The first nitrogen execution also happened in Alabama, when <a href=\"https:\/\/www.al.com\/news\/birmingham\/2024\/01\/alabama-to-execute-kenneth-smith-with-untested-nitrogen-gas-tonight.html\" target=\"_blank\" rel=\"noopener\">Kenneth Smith was executed<\/a> in January. That execution drew international attention, as groups around the world expressed outrage over the method and after Smith thrashed against the gurney for several minutes before losing consciousness.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"7CGVOQOVJREGXHLD7NHPG3LU4I\">The U.S. Supreme Court had allowed Smith\u2019s execution to proceed, but Justice Sonia Sotomayor filed a dissent, with which two other justices joined.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"FKE4WAP6DRE3TBLKRPSSMUDZG4\">In that document, Sotomayor noted Alabama failed in its first attempt to execute Smith by lethal injection\u2014an execution attempt that happened just after the attempted execution of Miller in 2022. She also wrote Smith predicted \u201cAlabama\u2019s protocol will cause him to suffocate and choke to death on his own vomit. I sincerely hope that he is not proven correct a second time. With deep sadness, but commitment to the Eighth Amendment\u2019s protection against cruel and unusual punishment, I respectfully dissent.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"OUEMYDT3YZFADLCWUTVCMP2BOI\">The Alabama Attorney General\u2019s Office, led by Attorney General Steve Marshall, said in a filing to the high court in that case that nitrogen hypoxia was \u201cperhaps the most humane method of execution ever devised.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BONRTE64NBEPZCYHOP5KGWC23E\">The method works by strapping a gas mask onto the condemned inmate and pumping pure nitrogen into the mask. Some Alabama Death Row inmates\u2019 lawsuits have centered around calls for not using a mask for the procedure.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"NL4UYNBRWZDOLKLJM6SUBYP6R4\">After Miller\u2019s case settled last month, Marshall issued a statement saying that the nitrogen protocol was \u201creliable and humane.\u201d He said the lawsuit \u201cwas based on media speculation that Kenneth Smith suffered cruel and unusual punishment in the January 2024 execution, but what the State demonstrated to Miller\u2019s legal team undermined that false narrative.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"XM6PBTIXNRAT5ESRFSO2PIPMWE\">State officials have argued that Smith held his breath at the beginning of his execution, delaying the nitrogen entering his body and causing his seizure-like movements.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"CPM3QPOD6BHNLG2H7RW6IM675I\">But Miller\u2019s <a href=\"https:\/\/www.al.com\/news\/2024\/07\/alabama-death-row-inmate-alan-eugene-miller-prison-too-incompetent-to-fit-his-execution-gas-mask.html\" target=\"_blank\" rel=\"noopener\">lawyers argued that the <\/a>state doesn\u2019t offer any proof for their claims that Smith held his breath, and the state \u201chang(s) their hat exclusively on the self-serving testimony of a witness who claims to have remembered Mr. Smith\u2019s oxygen levels nearly seven months after the execution.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"F5U6J37KTVCXRJK3YQQOVCD3J4\">The witness\u2014 an execution team captain \u2014 didn\u2019t write down those oxygen levels, according to Miller\u2019s lawyers, nor tell anyone about them on the night of the execution.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"LRZOIS4GQRGIPLI3WNX5DDW2FI\">\u201cIn fact, evidence in the record suggest that the witness could not even see the levels from his position in the execution chamber, and the execution log from Mr. Smith\u2019s execution\u2026 undercuts (the state\u2019s) entire argument,\u201d said a court filing.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"WSWWAJEKFZBVTKJOKNWXVC73RQ\">In a deposition earlier this summer, Miller said he has no intention of holding his breath or resisting his execution, but he\u2019s worried the state will fail at securing his gas mask because they\u2019re \u201cincompetent.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"EZGHWD3IYNF55GE2VVWESROOYA\">\u201cI don\u2019t think y\u2019all know what you\u2019re doing,\u201d Miller told a state attorney during the <a href=\"https:\/\/www.al.com\/news\/2024\/07\/alabama-death-row-inmate-alan-eugene-miller-prison-too-incompetent-to-fit-his-execution-gas-mask.html\" target=\"_blank\" rel=\"noopener\">deposition<\/a>. \u201cAnd these guys can\u2019t even open a cell door sometimes. They\u2019re keystone cops is basically what they are.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"FWQIZMCIVZBL5EDX2WTOQYS6ZE\">Death penalty opponents on Wednesday delivered petitions asking Gov. Kay Ivey to halt the execution, according to the Associated Press. Miller is <a href=\"https:\/\/apnews.com\/article\/executions-oklahoma-alabama-missouri-texas-south-carolina-d77a31bea7a4839424afc8889c7d8755\">one of five death row inmates<\/a> scheduled to be put to death in the span of one week, an unusually high number of executions that defies a yearslong trend of decline in the use of the death penalty in the U.S.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"E6PPCRW4J5AYVIAOBHC3GK7ZT4\"><b>The crime<\/b><\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"JRENXC5YSJBHFPQC7WR3WLJZLI\">The three men killed by Miller were gunned down at their workplaces on that August day in 1999, in the Shelby County city of Pelham. Shortly after the slayings, a friend of one victim summed up the situation: \u201cThere will probably never be any sense made of this &#8230; There never is.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"QC5FOHXC2BDBRH73GQVX3YV6C4\">The men died after Miller opened fire in two Highway 31 businesses while alleging his current and former co-workers were \u201cspreading rumors\u201d about him, according to court records.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"PUDDH5PRWZB6VPRDUHLY5QMPFM\">Yancy and Holdbrooks were killed at Ferguson Enterprises; Jarvis was slain at Post Airgas, located just down the street.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"MSM5JRKGQJGULCCFRGEC3TBKV4\">Shelby County District Attorney Robby Owens, in his opening statement in Miller\u2019s trial nearly a year after the shootings, described the killings as methodical and cold. \u201cThese men are not just murdered. They are executed,\u201d he said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6UDZY6E3YNFNFJ7ASRGZYZXQFY\">Efforts by AL.com to reach relatives of the three men killed by Miller were unsuccessful prior to his first execution attempt.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"HMQM33GISJD3VDTCK7FFSK7UXI\">But immediately after the slayings, some friends did talk to <a href=\"https:\/\/www.al.com\/news\/birmingham\/2022\/09\/i-just-dont-understand-condemned-alabama-inmate-alan-eugene-millers-victims-described-as-loving-hardworking.html\" target=\"_blank\" rel=\"noopener\">The Birmingham News<\/a> about the men and how they would be missed.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"G3PK3GGIHJBFRG5SKITDGJZSTE\">Yancy was 28 when he was gunned down, leaving behind a wife and two children. An article published in the days after the shooting by The Birmingham News quoted Yancy\u2019s pastor, calling Yancy a dedicated family man and friend who didn\u2019t seek attention for his many good deeds.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"5KPNHKGCG5DGHLCTDMSHZX3BWE\">Yancy and Holdbrooks were close friends, and both graduated from Thompson High School; Holdbrooks in 1985 and Yancy in 1989, according to the former principal. Friends and family told the newspaper in 1999 that Yancy liked to talk about his job at Ferguson and loved spending time at his church, where he chaired the church maintenance committee. Reports say he was gentle, despite his large frame of 6 feet and 6 inches.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"SD3ICNN62VD4PLL3PIRMDSU2GQ\">Ferguson\u2019s Atlanta branch sent two Japanese maple trees that were planted in front of the Pelham office in memory of Yancy, a 10-year employee, and Holdbrooks. Officials from the company declined to comment in 1999 after the shootings, saying they were focusing on letting their employees grieve.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"SY22CFNTBREDBPVLEBCSLV2EIA\">Holdbrooks was 32 when he was killed. He suffered six gunshot wounds, with the sixth being the fatal shot fired at close range.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"OYGHVWIDRJEXJCGLIJO6E3O46I\">According to reports at the time of the slayings, he had recently celebrated his fourth anniversary with his wife. The couple had no children, but The Birmingham News reported Holdbrooks doted on his dog, Oreo. He had just taught the pet to catch a Frisbee from a long distance.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"FGHXXXFP3NCJHCOPDUA5GCWPR4\">Jarvis was 39, working at Post Airgas when he was shot five times, also at close range. Witnesses said that before he was shot, Miller confronted Jarvis about spreading rumors. Jarvis denied the accusation but was shot just seconds later.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"DSFSEKJUFRHYPO35OREU53HKOE\">Jarvis wasn\u2019t married and had no children.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"RNADGIVMOFGA3OMYK4Y6IPQ2IE\">He was described as \u201cjolly\u201d and his sister said later in August 1999 that, if Jarvis was alive, he would likely be deep-sea fishing in Florida.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"SITLSOQVKRBWZONAKF6RZ5VPCI\">At a joint memorial service for the three men held that summer, Jarvis\u2019 pastor said the community must hold out hope.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"Q2KW3V3C5VGILCAVWAXYYF5XW4\">Rev. Donald Vanderslice of Macedonia Baptist Church said, \u201cIn the midst of this tragic time, we must have courage; courage for today, courage for tomorrow.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BGSFFOT3QBGKBKK5FNA53YPROU\"><b>Alan Miller\u2019s past<\/b><\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"HCPKSMM3SJGCTGOKNMUVT7QGGA\">Court records <a href=\"https:\/\/www.al.com\/news\/birmingham\/2022\/09\/alan-miller-awaits-decision-on-whether-alabama-will-execute-him-tonight.html\" target=\"_blank\" rel=\"noopener\">filed by an appeal team <\/a>for Miller in 2006 talked about his \u201cunstable\u201d upbringing and the \u201cextreme physical and psychological abuse\u201d he suffered from his father. He also physically beat Miller, resulting in multiple concussions and other injuries, and stabbed him with a knife. Miller\u2019s father also, according to the records, would often wave a pistol and threaten to kill his family.
