The shaking and trembling was followed by about six minutes of periodic gulping breaths before he became still, the AP reported.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1jzeak9001d356kliby16l8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI didn\u2019t do anything to be in here,\u201d Miller said in his final words, which at times were muffled by a mask that covered his face from forehead to chin, according to the AP.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1jyvr7o000s356kqvs9gg11@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Miller was fitted with the mask during the procedure, during which nitrogen gas flowed for about 15 minutes, Hamm said. In response to a reporter\u2019s question, Hamm confirmed the two minutes of shaking, which he said was to be expected.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1jz9a17000z356kbmg6bdh8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThere\u2019s going to be involuntary body movements as the body is depleted of oxygen. That is nothing we did not expect,\u201d Hamm said at the news conference.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1jz7beq000x356k9h9kjcw7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cEverything went according to plan and according to our protocol, so it went just as we had planned,\u201d Hamm said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1jzagu70014356k643dj9su@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At one point, a corrections officer had to adjust Miller\u2019s mask, Hamm confirmed in response to a reporter\u2019s question. \u201cThat\u2019s just making sure the mask is fitted,\u201d Hamm said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1jzgzwf001g356khvrabywl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cTonight, justice was finally served for these three victims through the execution method elected by the inmate,\u201d Alabama Gov. Kay Ivey said in a release. \u201cHis acts were not that of insanity, but pure evil. Three families were forever changed by his heinous crimes, and I pray that they can find comfort all these years later.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1jy268g000d356k0ys8f267@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Miller\u2019s execution came after a yearslong chain of events surrounding how he would be put to death: He first <a href=\"https:\/\/www.cnn.com\/2022\/09\/20\/us\/alan-eugene-miller-stay-of-execution\/index.html\">requested<\/a> death by nitrogen hypoxia, but the state said it wasn\u2019t prepared to use the method, and it then attempted to execute him by lethal injection in September 2022. That attempt, however, was <a href=\"https:\/\/www.cnn.com\/2022\/09\/23\/us\/alan-eugene-miller-execution-alabama-friday\/index.html\">called off<\/a>, with state officials saying they couldn\u2019t access Miller\u2019s veins before the execution warrant expired.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt0mwv000b356kpfmhd1tt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The state subsequently agreed not to execute Miller using any method other than nitrogen hypoxia. But then Alabama executed <a href=\"https:\/\/www.cnn.com\/2024\/01\/25\/us\/kenneth-smith-nitrogen-gas-execution-alabama\/index.html\">Kenneth Smith<\/a> early this year by nitrogen hypoxia in what is believed to be the first execution by that method. Witnesses said Smith was shaking and writhing on the gurney for minutes before dying.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1jzw1oi001p356kzfp0fcot@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Miller then <a href=\"https:\/\/www.cnn.com\/2024\/08\/06\/us\/alabama-death-row-alan-miller-lawsuit\/index.html\">challenged<\/a> the state\u2019s <a href=\"https:\/\/www.cnn.com\/2024\/06\/08\/us\/nitrogen-hypoxia-execution-adoption-legislation\/index.html\">nitrogen hypoxia<\/a> protocol in a federal lawsuit, claiming it could cause him undue suffering, thus violating his Eighth Amendment protections against cruel and unusual punishment. The suit, however, was <a href=\"https:\/\/www.cnn.com\/2024\/08\/06\/us\/alabama-death-row-alan-miller-lawsuit\/index.html\">settled<\/a>\u00a0last month.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1jzz2ig001r356kxhsfgto5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The terms of the settlement were confidential, though state Attorney General Steve Marshall touted it as proof Alabama\u2019s nitrogen gas execution method is constitutional.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt1anu000i356kfd7xcltb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe resolution of this case confirms that Alabama\u2019s nitrogen hypoxia system is reliable and humane,\u201d Marshall <a href=\"https:\/\/www.alabamaag.gov\/alabama-attorney-general-marshall-successfully-defends-constitutionality-of-nitrogen-hypoxia-method-of-execution\/\" target=\"_blank\" rel=\"noopener\">said<\/a> in August.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt1anu000j356kstzq7tcc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Proponents of the nitrogen hypoxia execution method, which replaces oxygen breathed by an inmate with 100% nitrogen, <a href=\"https:\/\/www.cnn.com\/2024\/01\/25\/us\/nitrogen-gas-execution\/index.html\">say<\/a> a person would likely lose consciousness shortly into the procedure, making it more humane than other execution methods. However, doctors have said that they could not pinpoint if or when a person will lose consciousness when exposed to high concentrations of nitrogen gas.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1hoxgam000e3b6kp7w509aq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            CNN has repeatedly reached out to lawyers for Miller for comment on his settled lawsuit and execution.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1jzzt38001u356khkdv12zr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On Thursday in the hours before the execution, Miller had nine visitors and had a final meal of hamburger steak, baked potato and French fries, the Alabama Department of Corrections said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt113s000e356ky3eu8ti3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Miller has been staring down the end of his life for more than two decades. He was sentenced to death in 2000 for the 1999 murders of Lee Holdbrooks, Scott Yancy, and Terry Lee Jarvis.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt1vpb000q356k9ms1zuoz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Miller had worked with each of the victims and became upset when he believed the three \u201cspread rumors about him,\u201d <a href=\"https:\/\/www.alabamaag.gov\/alabama-attorney-general-marshall-successfully-defends-constitutionality-of-nitrogen-hypoxia-method-of-execution\/\" target=\"_blank\" rel=\"noopener\">according<\/a> to a release from the Alabama attorney general\u2019s office.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt1vpb000r356k5tt2ymra@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On the morning of August 5, 1999, Miller shot two of the three men at Ferguson Enterprises in Pelham, Alabama, <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/20\/20-7592\/172990\/20210325142709753_Miller_Pet.%20App..pdf\" target=\"_blank\" rel=\"noopener\">according<\/a> to court documents.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt1tta000o356krfnf2s6l@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI\u2019m tired of people starting rumors on me,\u201d Miller said, armed with a pistol while walking out of his employer\u2019s office, <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/20\/20-7592\/172990\/20210325142709753_Miller_Pet.%20App..pdf\" target=\"_blank\" rel=\"noopener\">court documents say<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt26js000u356kl77kf2dj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Yancy was shot three times, <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/20\/20-7592\/172990\/20210325142709753_Miller_Pet.%20App..pdf\" target=\"_blank\" rel=\"noopener\">according to court documents<\/a>, and was unable to move after the first shot, \u201ctraveled through his groin and into his spine, paralyzing him.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt2pr80010356krxc222op@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Holdbrooks was shot six times and tried to crawl down a hallway to escape before Miller shot him in the head, \u201ccausing him to die in a pool of blood,\u201d the documents say.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt2rjy0012356k5r9u7ixt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            After killing Holdbrooks and Yancy, Miller headed to his previous employer, Post Airgas, where Jarvis worked.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt3i4n0019356ka9rbri7a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Miller walked in and said, \u201cHey, I hear you\u2019ve been spreading rumors about me.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt3veu001e356kygbeyjc7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Jarvis replied that he had not been spreading rumors about Miller but moments later, Miller shot Jarvis \u201ca number of times.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt3veu001f356kvopsqjfk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Miller was later captured on the highway, court documents say, <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/20\/20-7592\/172990\/20210325142709753_Miller_Pet.%20App..pdf\" target=\"_blank\" rel=\"noopener\">with<\/a> \u201ca Glock pistol with one round in the chamber and 11 rounds in the ammunition magazine.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt3veu001h356k1w9bb4xl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A forensic psychiatrist <a href=\"https:\/\/www.cnn.com\/2022\/09\/23\/us\/alan-eugene-miller-execution-alabama-friday\/index.html\">who testified<\/a> for Miller\u2019s defense determined he was mentally ill and suffering a delusional disorder, leading him to believe the victims were spreading rumors about him. The psychiatrist concluded, however, that Miller\u2019s mental illness didn\u2019t meet the standards for an insanity defense in Alabama.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1hp0udf000h3b6k9ddboqn2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI feel that it has taken way too long to get here,\u201d Tara Barnes, Holdbrooks\u2019 widow told CNN Tuesday.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt4qmt001j356k7cmppdk0@published\" data-editable=\"text\" data-component-name=\"paragraph\" lower court injunction in a long-running dispute over whether he would die by that method or nitrogen hypoxia.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt5j0b001s356ks8jr2ruy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n process of death by nitrogen gas involves forcing an inmate to inhale 100% nitrogen gas, depriving them of the oxygen needed to survive. But death by nitrogen gas has been criticized as experts have said it could lead to excessive pain or even torture.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt5j0b001x356kiqujl7vn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            During Smith\u2019s <a href=\"https:\/\/www.cnn.com\/2024\/01\/25\/us\/kenneth-smith-nitrogen-gas-execution-alabama\/index.html\">execution<\/a> earlier this year, he appeared conscious for \u201cseveral minutes,\u201d and for two minutes after that, he \u201cshook and writhed on a gurney,\u201d according to the media witness report.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt5j0b001y356k8jtc0va5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            That was followed by several minutes of deep breathing before his breath began slowing \u201cuntil it was no longer perceptible for media witnesses,\u201d the media witness report said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt5j0b001z356knb6a6w0j@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cClearly it was not the instant, painless death that they promised,\u201d Dr. Jonathan Groner, a professor of surgery at The Ohio State University College of Medicine told CNN last week. \u201cThere\u2019s a lot of suggestion that it wasn\u2019t good, wasn\u2019t pleasant.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt5j0b0020356kobl9vu1w@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            United Nations experts \u201cunequivocally condemned\u201d Smith\u2019s execution and the use of nitrogen gas inhalation, saying in a <a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2024\/01\/united-states-un-experts-horrified-kenneth-smiths-execution-nitrogen-alabama\" target=\"_blank\" rel=\"noopener\">statement<\/a> it \u201cwas nothing short of State-sanctioned torture.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1hpb03o000k3b6kpm6imm43@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe use, for the first time in humans and on an experimental basis, of a method of execution that has been shown to cause suffering in animals is simply outrageous,\u201d the UN experts said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt5j0b0022356kgyurhixn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe theory is that if you just get rid of all the oxygen, just breathing pure nitrogen, you won\u2019t feel that intense pressure, like you\u2019re holding your breath, right? It doesn\u2019t really work out that way,\u201d Groner, who\u2019s studied capital punishment for more than two decades, said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1dt5j0b0023356koh4smllw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            While Alabama is the only state that\u2019s put this execution method to the test, it\u2019s not the only state that\u2019s adopted the use of the procedure.
