Gary Klausner on Friday found that Netflix could\u2019ve defamed Fiona Harvey, the inspiration behind Jessica Gunning\u2019s Martha depicted as a twice-convicted stalker sentenced to five years in prison for sexual assault, by stating that the series was \u201cbased on a true story.\u201d Netflix may have \u201cinsisted on adding\u201d the disclaimer despite Gadd\u2019s concerns, the court said.<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\t\u201cThis suggests a reckless disregard of whether the statements in the series were false,\u201d the order stated.<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\t<em>Baby Reindeer<\/em> follows Gadd\u2019s Donny Dunn, a struggling comedian who encounters Martha at the bar where he works. Martha is then revealed to be a dangerous, serial stalker. Over the course of multiple years, she\u2019s depicted as sending him more than 41,000 emails, 744 tweets, 100 pages of letters and 350 hours of voicemails.<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\tIn June, Harvey <a href=\"https:\/\/www.hollywoodreporter.com\/business\/business-news\/netflix-defamation-lawsuit-baby-reindeer-1235916772\/\">brought a lawsuit<\/a> in California federal court against Netflix seeking at least $170 million, including the company\u2019s profits from the series.<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\tNetflix moved to dismiss the lawsuit under California\u2019s anti-SLAPP law, which allows for the early dismissal of lawsuits intended to chill free speech. The court, however, found that Harvey has a \u201cprobability of prevailing\u201d on allegations over defamation. <\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\tClaims for negligence, right of publicity and punitive damages were dismissed, while a claim for intentional infliction of emotional distress was allowed to proceed.<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\tThe series depicts Martha as a convicted criminal who spent five years in prison for stalking Gadd and another woman. She\u2019s also shown to stalk a policeman and sexually assault Gadd.
