{"id":107904,"date":"2024-09-28T11:15:47","date_gmt":"2024-09-28T04:15:47","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=107904"},"modified":"2024-09-28T11:15:47","modified_gmt":"2024-09-28T04:15:47","slug":"judge-rules-netflix-baby-reindeer-was-not-a-true-story","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=107904","title":{"rendered":"Judge Rules Netflix&#8217; &#8216;Baby Reindeer&#8217; Was Not a &#8216;True Story&#8217;"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tA judge ruled Friday that the <a href=\"https:\/\/variety.com\/t\/netflix\/\" id=\"auto-tag_netflix\" data-tag=\"netflix\">Netflix<\/a> show \u201c<a href=\"https:\/\/variety.com\/t\/baby-reindeer\/\" id=\"auto-tag_baby-reindeer\" data-tag=\"baby-reindeer\">Baby Reindeer<\/a>\u201d did not live up to its billing as a \u201ctrue story,\u201d  allowing the real-life \u201cMartha\u201d to pursue her defamation lawsuit.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe woman, <a href=\"https:\/\/variety.com\/t\/fiona-harvey\/\" id=\"auto-tag_fiona-harvey\" data-tag=\"fiona-harvey\">Fiona Harvey<\/a>, <a href=\"https:\/\/variety.com\/2024\/tv\/global\/baby-reindeer-real-martha-fiona-harvey-sues-netflix-1236019699\/\">alleged<\/a> that the series, created by Richard Gadd, falsely implied that she sexually assaulted Gadd and gouged his eyes, and had been sent to prison for stalking him.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tNetflix filed a <a href=\"https:\/\/variety.com\/2024\/tv\/news\/baby-reindeer-richard-gadd-netflix-fiona-harvey-lawsuit-response-stalking-1236089425\/\">motion to throw out the suit<\/a> in July. In his defense, Gadd revealed that Harvey had stalked him for years when he worked at a London pub, would sometimes pinch his buttocks, and had sent him thousands of disturbing emails and voicemail messages. He ultimately reported her to the police and got a \u201charassment warning\u201d \u2014 though she was not criminally prosecuted or sent to jail.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn his <a rel=\"nofollow noopener\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cacd.928856\/gov.uscourts.cacd.928856.69.0.pdf\" target=\"_blank\">ruling on Friday<\/a>, Judge Gary Klausner noted that the series opens with the line \u201cThis is a true story,\u201d inviting the viewer to take what follows as fact. But he found that Martha\u2019s behavior on the show is significantly worse than what Harvey is accused of in real life.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cThere is a major difference between stalking and being convicted of stalking in a court of law,\u201d the judge wrote. \u201cLikewise, there are major differences between inappropriate touching and sexual assault, as well as between shoving and gouging another\u2019s eyes. While plaintiff\u2019s purported actions are reprehensible, Defendants\u2019 statements are of a worse degree and could produce a different effect in the mind of a viewer.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tHarvey was never named on the show, though online sleuths were quickly able to identify her based on digital breadcrumbs.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tGadd was an aspiring comedian when he worked in the Hawley Arms pub, and has said the Netflix series is based on his experience there. But he has also said that show, and the stage play on which it was based, were both fictionalizations, and not meant to be a \u201cbeat-for-beat recounting\u201d of events.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe Sunday Times <a rel=\"nofollow noopener\" href=\"https:\/\/www.thetimes.com\/uk\/arts\/article\/will-the-baby-reindeer-scandal-kill-true-story-tv-9v26txpgm#:~:text=In%20its%20first%20episode%2C%20Baby,line%20was%20a%20request%20from\" target=\"_blank\">reported<\/a> in June that Gadd had reservations about including the line \u201cThis is a true story,\u201d but that it was included at Netflix\u2019 request. The judge noted that article in his ruling, arguing that it could show \u201cactual malice\u201d \u2014 that is, that Netflix knew the show was fictionalized, but consciously chose to represent it otherwise.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tKlausner did dismiss Harvey\u2019s claims for negligence, violation of her publicity rights, and for punitive damages. But the judge allowed her to pursue a claim of intentional infliction of emotional distress, which applies to \u201cextreme and outrageous\u201d false statements.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cIt appears that a reasonable viewer could understand the statements about Martha to be about Plaintiff,\u201d the judge wrote. \u201cThe Series states that Plaintiff is a convicted criminal who sexually and violently assaulted Gadd.
