And Trump falsely claimed that the statistics are specifically about people who are now living freely in the US; the figures actually <a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/R\/R45804#:~:text=40%20The%20ICE%20non%2Ddetained,removal%20(e.g.%2C%20fugitives).\" target=\"_blank\" rel=\"noopener\">include people who are currently in jails and prisons serving criminal sentences<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl60004356mglw0l4u5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cKamala should immediately cancel her News Conference because it was just revealed that 13,000 convicted murderers entered our Country during her three and a half year period as Border Czar,\u201d Trump wrote in\u00a0<a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/113210828555097495\" target=\"_blank\" rel=\"noopener\">one<\/a>\u00a0post on Friday, the day Harris <a href=\"https:\/\/www.cnn.com\/2024\/09\/27\/politics\/harris-southern-border-arizona\/index.html\">visited<\/a> the southern border in Arizona. Harris \u201callowed almost 14,000 MURDERERS to freely and openly roam our Country,\u201d Trump wrote in another Friday <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/113212754737717443\" target=\"_blank\" rel=\"noopener\">post<\/a>. They \u201croam free to KILL AGAIN,\u201d he <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/113216005392669748\" target=\"_blank\" rel=\"noopener\">wrote<\/a>, escalating his rhetoric, on Saturday.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl60005356ma4wwl33h@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            <strong>Facts First<\/strong>:\u00a0<em>Trump\u2019s claims are false in two big ways. First, the\u00a0<\/em><a href=\"https:\/\/homeland.house.gov\/wp-content\/uploads\/2024\/09\/24-01143-ICEs-Signed-Response-to-Representative-Tony-Gonzales.pdf\" target=\"_blank\" rel=\"noopener\"><em>statistics he was referring to<\/em><\/a><em>\u00a0are not specifically about people who entered the country during the Biden-Harris administration. Rather, those statistics are about noncitizens who entered the country under any\u00a0administration, including Trump\u2019s; were convicted of a crime at some point, usually in the US after their arrival; and are now living in the US while being listed on Immigration and Customs Enforcement\u2019s \u201cnon-detained docket\u201d \u2014 where some have been listed for years, including while Trump was president, because their country of citizenship won\u2019t let the US deport them back there. Second, that ICE \u201cnon-detained\u201d list includes people who are still serving jail and prison sentences for their crimes; they are on the list because they are not being held in immigration detention in particular.<\/em>\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl60006356m8qvxkv0k@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The new statistics, released by ICE in\u00a0<a href=\"https:\/\/homeland.house.gov\/wp-content\/uploads\/2024\/09\/24-01143-ICEs-Signed-Response-to-Representative-Tony-Gonzales.pdf\" target=\"_blank\" rel=\"noopener\">a letter<\/a>\u00a0to a Republican congressman this week, said there were 425,431 total convicted criminals on the non-detained docket as of July 21, 2024, including 13,099 people with homicide convictions.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl60007356m5jb7btjh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The statistics have been deployed by Trump and various <a href=\"https:\/\/x.com\/RepMaryMiller\/status\/1839735183668588589\" target=\"_blank\" rel=\"noopener\">Republican lawmakers<\/a> and right-wing commentators as alarming evidence of Harris\u2019 supposed mismanagement of immigration policy. But in addition to exaggerating her role on the file \u2014 she was <a href=\"https:\/\/www.cnn.com\/2024\/07\/25\/politics\/fact-check-trump-false-claims-kamala-harris\/index.html\">never actually \u201cborder czar\u201d<\/a> \u2014 much of the chatter has inaccurately described what the statistics show.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl60008356mqirln1jt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A spokesperson for the Department of Homeland Security, which oversees ICE, said in a Saturday email: \u201cThe data in this letter is being misinterpreted.\u00a0The data goes back decades;\u00a0it includes individuals who entered the country over the past 40 years or more, the vast majority of whose custody determination was made long before this Administration. It also includes many who are under the jurisdiction or currently incarcerated by federal, state or local law enforcement partners.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl60009356m5a3pxxbl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It\u2019s not clear how many of the 13,099 people with homicide convictions on ICE\u2019s non-detained docket as of July 21 are currently incarcerated in jails and prisons. Regardless, <a href=\"https:\/\/www.nixonpeabody.com\/people\/sandweg-john\" target=\"_blank\" rel=\"noopener\">John Sandweg<\/a>, an attorney who served as acting director of ICE during the Obama administration, said in a Saturday interview that it is \u201c100% false\u201d to say all the homicide offenders on the non-detained docket entered the US during Harris\u2019 vice presidency. Sandweg added: \u201cThese are individuals who undoubtedly entered the United States over a long period of time. \u2026 A lot of them have probably been on the list for 20 years, where the US has just been unable to deport.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000a356mgfk3319c@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            CNN could not immediately find public statistics on how many people with criminal convictions were on the non-detained docket during Trump\u2019s presidency. But there are public statistics from just before and just after his presidency \u2014 and those statistics, which we\u2019ll discuss later in this article, make clear that Trump, too, presided over a non-detained docket that included hundreds of thousands of people with criminal convictions.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000b356ml082c3o2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            <strong>A Supreme Court decision requires ICE to release some offenders<\/strong>\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000c356mcb3qw460@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump\u2019s posts left open the impression that the homicide offenders on the non-detained docket had foreign homicide convictions but were nonetheless allowed to cross the US border and live freely in this country. In reality, public\u00a0<a href=\"https:\/\/www.cbp.gov\/newsroom\/stats\/cbp-enforcement-statistics\/criminal-noncitizen-statistics\" target=\"_blank\" rel=\"noopener\">data<\/a>\u00a0makes it clear that the overwhelming majority of people with criminal convictions on the non-detained docket were convicted in the US, as Sandweg and\u00a0<a href=\"https:\/\/www.americanimmigrationcouncil.org\/staff\/aaron-reichlin-melnick\" target=\"_blank\" rel=\"noopener\">Aaron\u00a0Reichlin-Melnick<\/a>, senior fellow at the American Immigration Council, which supports immigration, both told CNN.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000d356m65pts9gt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Why aren\u2019t these people in immigration detention if they have been convicted of a crime as serious as homicide? Under a\u00a0<a href=\"https:\/\/www.oyez.org\/cases\/2000\/99-7791\" target=\"_blank\" rel=\"noopener\">2001 Supreme Court decision<\/a>, the US government is not allowed to indefinitely keep someone in immigration detention after they have been ordered removed from the country. So if someone has served their criminal sentence for homicide and then is ordered to be removed from the US, but their\u00a0<a href=\"https:\/\/www.migrationpolicy.org\/article\/recalcitrant-uncooperative-countries-refuse-deportation\" target=\"_blank\" rel=\"noopener\">country is uncooperative with the US<\/a>\u00a0on immigration and won\u2019t take them back, they must be released in the US \u2014\u00a0<a href=\"https:\/\/www.americanimmigrationcouncil.org\/research\/removal-system-united-states-overview\" target=\"_blank\" rel=\"noopener\">usually after no more than six months in immigration detention<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000e356mdd4f5pop@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cLet\u2019s say you have a Russian who was convicted of homicide. There\u2019s nothing we can do there,\u201d Sandweg said, given how Russia simply won\u2019t accept the deportation. \u201cThere comes a point where you just have to release them.\u201d He added that this doesn\u2019t mean the person is \u201ccompletely free\u201d \u2014 people on the non-detained docket often have to check in with ICE or be monitored electronically \u2014 \u201cbut there\u2019s just no more legal authority to continue the detention.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000f356ml7au8yre@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Sandweg added: \u201cICE, of course, is not willy-nilly saying, \u2018Okay, people convicted of murder, you\u2019re not a priority.\u2019 \u2026 We have a guy convicted of homicide, our strong preference is not to release them onto the streets.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000g356mwq7otkc0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Reichlin-Melnick, who <a href=\"https:\/\/x.com\/ReichlinMelnick\/status\/1840136242991673411\" target=\"_blank\" rel=\"noopener\">noted Saturday<\/a> on social media that the non-detained docket includes people in jails and prisons,\u00a0<a href=\"https:\/\/x.com\/ReichlinMelnick\/status\/1839752787414134933\" target=\"_blank\" rel=\"noopener\">wrote on social media on Friday<\/a>\u00a0that \u201canyone on ICE\u2019s non-detained docket with a homicide conviction has likely been in the country for decades, served a full criminal sentence, and can\u2019t be removed because they\u2019re from a country which restricts US deportations.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000h356m944txd05@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Reichlin-Melnick continued: \u201cThere are others on ICE\u2019s non-detained docket who have serious criminal records who, after serving their time, managed to win some form of protection and relief from removal. They are now here legally, but remain on the docket and are required to check in with ICE periodically.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000i356m8lbm56ka@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The list of convicted criminals on the non-detained docket includes both people who crossed the border illegally and people who came to the US legally, such as with a visa or green card, and then committed a crime and were placed in removal proceedings or were given a removal order.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000j356m2phy85nv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            <strong>What the numbers show<\/strong>\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000k356m78cf4ghw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The non-detained docket is not a new creation of the Biden-Harris administration. In fact, there were hundreds of thousands of people with criminal convictions on the non-detained docket during the Trump presidency, too.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000l356mf49yapfx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A reporter for Fox News, the right-wing outlet whose reporting on these statistics Trump repeatedly\u00a0<a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/113210828119177293\" target=\"_blank\" rel=\"noopener\">promoted<\/a>\u00a0on Friday,\u00a0<a href=\"https:\/\/x.com\/BillMelugin_\/status\/1839810916373983514\" target=\"_blank\" rel=\"noopener\">noted<\/a>\u00a0Friday evening on social media that \u201cnot all of these criminals entered during the Biden admin, as some are claiming\u201d and that \u201csome of these criminals go back many years across multiple administrations.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000m356ml3bwj7yk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A previous\u00a0<a href=\"https:\/\/www.oig.dhs.gov\/sites\/default\/files\/assets\/2017\/OIG-17-51-Apr17.pdf\" target=\"_blank\" rel=\"noopener\">official federal report<\/a>\u00a0said there were 368,574 total convicted criminals on the non-detained docket as of August 2016, under the Obama administration, about five months before Trump became president. And another\u00a0<a href=\"https:\/\/www.dhs.gov\/sites\/default\/files\/2022-03\/U.S.%20Immigration%20and%20Customs%20Enforcement_Remediated.pdf\" target=\"_blank\" rel=\"noopener\">federal document<\/a>\u00a0said there were 405,786 total convicted criminals on the non-detained docket as of early June 2021, less than five months into the Biden-Harris administration. Again, the July 2024 number was 425,431 total convicted criminals.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000n356mo6udd445@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In other words, the list grew about 10% between August 2016 and June 2021 \u2014 a roughly five-year period that included the four-year Trump administration \u2014 and then grew about another roughly 5% in the three-plus years under the Biden-Harris administration between June 2021 and July 2024.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000o356m4lv053yw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Because official information on people on the non-detained docket with criminal convictions has only been released sporadically, with dates that don\u2019t line up with the start and end dates of presidential administrations, it\u2019s not possible to say how much of the increase happened under the Trump administration versus how much happened during the final months of the Obama administration and the first months of the Biden-Harris administration.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000p356mcus1y829@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Regardless, there\u2019s no basis for saying, as Trump kept doing Friday, that all of the people on the docket with homicide convictions came in during the Biden-Harris administration \u2014 and the numbers show \u201cthe docket certainly grew under the Trump administration,\u201d Sandweg said. (He added that, to be fair, Trump faced the same stubborn issues with uncooperative foreign countries as\u00a0other presidents.)\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000q356m04noc2fa@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The crimes committed by people on the non-detained docket in July 2024 ranged from the most serious offenses, like homicide and sexual assault, to \u201cgambling,\u201d \u201cliquor,\u201d and \u201cobscenity\u201d offenses. The conviction categories with the highest number of people on the non-detained docket were \u201ctraffic offenses\u201d (77,074), \u201cassault\u201d (62,231), \u201cdangerous drugs\u201d (56,533) and \u201cimmigration\u201d (51,933).\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000r356mmc8lfptm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            CNN could not immediately find public data on the number of people with homicide convictions specifically who were on the non-detained docket in past years, including during the Trump administration.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000s356m53eorwiw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It is clear that the\u00a0<em>total\u00a0<\/em>number of people on the non-detained docket, including people without any criminal conviction, has spiked during the Biden-Harris administration. (There are <a href=\"https:\/\/www.nbcnews.com\/investigations\/13000-immigrants-convicted-homicide-living-freely-us-ice-data-rcna173125\" target=\"_blank\" rel=\"noopener\">numerous reasons<\/a> that people can end up on the docket; we won\u2019t get into those here.) ICE\u00a0<a href=\"https:\/\/www.ice.gov\/doclib\/eoy\/iceAnnualReportFY2023.pdf\" target=\"_blank\" rel=\"noopener\">says<\/a>\u00a0the docket jumped from roughly 3.3 million in the 2020 fiscal year, the last full fiscal year under Trump, to roughly 6.2 million in the 2023 fiscal year.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1n31vl6000t356mkyeh2eh4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Harris critics are entitled to cite this real increase.
