Specifically, Harvey says that viewers concluded that she was also \u201ca twice convicted criminal that spent five years in prison for stalking,\u201d had \u201cstalked a police officer,\u201d \u201csexually assaulted Gadd in an alley,\u201d \u201cviolently attacked Gadd \u2026 gouged his eyes with her thumbs,\u201d and \u201cstalked Gadd by waiting outside his home every day for up to 16 hours a day.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1p3uce0000g356mjqavgvgu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In his order, Judge Klaussner addresses Netflix\u2019s<strong> <\/strong>argument that these examples were \u201csubstantially true,\u201d a commonly used defense against defamation which contends that the overall gist of a claim is true. The streaming company argued that although Harvey is not a twice-convicted criminal, \u201cshe could have been convicted and sentenced to five years in prison,\u201d and that she got \u201c\u2019handsy\u2019 with (Gadd), pinching him and touching various parts of his body including his \u201cbum\u201d without consent.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1p3uce0000h356msb7ctx26@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Klausner disagreed with Netflix\u2019s argument,\u00a0writing\u00a0that \u201cthere is a major difference between stalking and being convicted of stalking in a court of law. Likewise, there are major differences between inappropriate touching and sexual assault, as well as between shoving and gouging another\u2019s eyes.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1p3uce0000j356ml3b6p49d@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Klausner also held Harvey may be able to show \u201cactual malice\u201d if\u00a0Netflix knowingly depicted fictionalized events as fact.
