Given the thin margins in battleground states like Georgia, Michigan, Nevada and Wisconsin, the election between\u00a0former President Donald Trump or Vice President Kamala Harris could be in the balance.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt00083b6m2zkgstr2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            While Republicans say they are worried about voter fraud, Democrats fear local officials who buy into conspiracy theories and false claims of fraud will refuse to certify results, leading to a potential legal morass and possible delays that inject uncertainty into the November election.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt00093b6m0rti0bon@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In Georgia, for instance, Trump-backed members of the state election board recently passed controversial rules that could allow local election boards responsible for certifying results to conduct investigations that threaten to delay certification.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000a3b6mgahr9z1m@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Tuesday, the Democratic National Committee, the Georgia Democratic Party and Democratic members of several county election boards will try to convince a Georgia state judge the rules could throw the upcoming presidential election into \u201cchaos.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000b3b6mwebffzcm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe law is very clear in every state that certification is a mandatory duty,\u201d said Ben Berwick, the head of election law and litigation\u00a0at the advocacy group Protect Democracy. The role of those officials, he said, is \u201csimply to affirm that the canvas and tabulation have been completed and that the results are official.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000c3b6m3akh7wkl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cEven unsuccessful attempts to block certification can cause delays, and even small delays in the very tight post-election timeline can have us cascading effect,\u201d Berwick said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000d3b6mjbuf1r4d@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Though every state\u2019s certification rules are slightly different,\u00a0the process\u00a0is\u00a0simple:\u00a0When polls close on Election Day, election officials tally the votes and confirm that every valid\u00a0ballot\u00a0was counted. Those officials then turn to local election boards \u2013 made up of Democrats and Republicans who may or may not have experience in election administration \u2013 to certify the results before passing them along to either a state board of elections or the state\u2019s chief elections officer, who will also certify and finalize that\u00a0result by December 11.\u00a0They then go to Congress for a final certification on January 6.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000e3b6mki01capv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In 2020,\u00a0a pressure campaign from Trump and his allies urging the officials,\u00a0beginning with\u00a0local election boards\u00a0and continuing up to\u00a0then-Vice President Mike Pence,\u00a0not to certify the vote totals\u00a0ended up with a riot at the US Capitol and partisan wrangling over control over the process ever since.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000g3b6md1h3veno@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Lawsuits aiming to preemptively head off challenges to the certification process are beginning to appear nationwide with mixed results.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000h3b6m6jo7jt8h@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In Georgia, the Democratic plaintiffs challenged the new rules around certification shortly before they were supposed to take effect.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000i3b6m6rer8t8s@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            One of the Georgia rules, the \u201cReasonable Inquiry Rule,\u201d would allow election officials to conduct a \u201creasonable inquiry\u201d before certifying election results. The petitioners in the case argue that the rule would give partisan board members a wide ability to cast doubt on, or even reject, election results.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000j3b6mw2xkbccb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The second rule, known as the \u201cExamination Rule,\u201d would allow individual county board members to \u201cexamine all election related documentation\u201d before certifying.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000k3b6myh9hq9ze@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Georgia Republicans and the Republican National Committee, defending the two rule changes, have argued that they ensure local election boards have the tools they need to make sure vote counts are accurate, and that Democrats have only raised \u201cabstract and hypothetical\u201d concerns about their impact.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000l3b6mf8nwojqy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In some cases, the threat of legal action has been enough to deter officials from pursuing challenges to the certification process.\u00a0One Republican canvasser in Kalamazoo County, Michigan,\u00a0was sued by the ACLU over alleged threats to not certify the upcoming presidential race. The canvasser, Robert Froman, denied making the comments and quickly signed an affidavit promising not to interfere in November\u2019s election.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000m3b6mxz8adt26@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Situated in southwest Michigan, the county is home to more than 215,000 registered voters, according to the Michigan Department of State, but it has reliably trended blue in recent presidential history. President Joe Biden won the state in 2020 with 58% of the vote.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000n3b6mg56c0vrx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Asked if he would certify the 2024 presidential election if it unfolded the same way the 2020 one did, Froman told the\u00a0<a href=\"https:\/\/www.aclumich.org\/sites\/default\/files\/field_documents\/complaint_exhibits_as_filed_redacted_for_website.pdf#page=44\" target=\"_blank\" rel=\"noopener\">Detroit News<\/a>, \u201cNo. And that\u2019s why I\u2019m there.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000o3b6mof93885b@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Froman has not responded to attempts to reach him for comment.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000p3b6me6bukfb4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The suit was dropped, and the ACLU sent a letter to every board of county canvassers in Michigan warning that their organization \u201cwill be carefully monitoring their activities come November,\u201d and that \u201ca canvasser who refuses to perform their legal and constitutional obligations by voting to certify the election based solely on the returns may be subject to swift and decisive legal action.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000q3b6mh1czn0jl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            And in Nevada, the state Supreme Court dismissed\u00a0a lawsuit filed by Democratic Secretary of State Francisco Aguilar asking the justices to force the Washoe County commissioners to certify an election over the summer.\u00a0Washoe County, home to Reno, is a critical swing county with more than 380,000 registered voters, according to the Nevada secretary of state.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000r3b6me1dzg7az@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The justices dismissed the suit because the commissioners certified the election on their own. But, the justices said, Aguilar could raise the issue again if the commissioners failed to certify an election in the future.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000s3b6m2qzr2fbf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Still, not every suit has ended with resounding wins for officials or advocacy groups aiming to insulate the certification process from challenges. Last week, a federal judge in Arizona <a href=\"https:\/\/apnews.com\/article\/arizona-certification-county-challenge-judge-blocked-fontes-de29778b4cf06469e0633b5926bfc0b1\" target=\"_blank\" rel=\"noopener\">blocked a state provision<\/a> that, in the event local officials failed to certify their county\u2019s votes, instructed the Arizona secretary of state to proceed with the state canvass anyway. Officials believed that the provision would act as a contingency plan should some local boards miss their legal deadline.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000t3b6mtt5hdin2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            That judge sided with conservative groups who claimed the provision likely violated the constitutional right to vote because it, in the judge\u2019s words, \u201cgives the secretary of state nearly carte blanche authority to disenfranchise the ballots of potentially millions of Arizona voters.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000u3b6md9tbgpp7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Several election experts told CNN they believe that state and federal laws surrounding the certification process will ultimately ensure local boards certify their results this year, heading off potential chaos.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000v3b6mhr4qc3bm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cSo far, courts have done a very good job of getting to the heart of the matter on this,\u201d said Gideon Cohn-Postar, senior adviser for election infrastructure at the Institute for Responsive Government, a nonpartisan good governance group.\u00a0\u201cMy concern is much more one of narrative than of legality.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000w3b6mtl7t4pg8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            He worried, for instance, of the optics if election skeptics on dozens of boards across the country refuse to certify and are then forced to do so by the courts.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000x3b6mrk3flrz5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt\u2019s going to look suspect and can be used by bad faith actors that this is somehow compelling people to do things that are illegal,\u201d Cohn-Postar added. \u201cThat will kind of drive conspiracy theories.\u201d\n    <\/p>\n<h2 class=\"subheader inline-placeholder\" data-editable=\"text\" data-uri=\"cms.cnn.com\/_components\/subheader\/instances\/cm1paigjj001e3b6myma5exuy@published\" data-component-name=\"subheader\" id=\"what-happened-in-2020-and-2022\" data-article-gutter=\"true\">\n        What happened in 2020 and 2022<br \/>\n<\/h2>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt000z3b6matktwd33@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Legal challenges to the certification process have been playing out over the past four years in states across the country, including Pennsylvania, New Mexico, Georgia and North Carolina. None of those challenges have succeeded.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt00103b6mqfjmake3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The first warning signs of major challenges to the certification process came about in 2020, when Republican officials in Michigan\u2019s largest county temporarily blocked the certification of Biden\u2019s win.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt00113b6m6p1p5ad0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The two Republicans on the Wayne County Board of Canvassers cited concerns of voting irregularities in Detroit as their reason, though they reversed course hours later and certified the votes.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt00123b6mpk6doh8u@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It was\u00a0later reported\u00a0that Trump and then-Chairwoman of the Republican National Committee Ronna McDaniel had called the two\u00a0Republican officials to encourage them not to certify.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt00133b6m7pp1luhy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Efforts from Republican officials to block certification only increased in the midterms, when challenges to certification popped up all over the country. In rural Arizona, county officials only certified the midterm election results after an order from a judge\u00a0\u2013 and two of the county supervisors who refused to certify\u00a0<a href=\"https:\/\/www.azag.gov\/press-release\/attorney-general-mayes-announces-grand-jury-indictment\" target=\"_blank\" rel=\"noopener\">were indicted<\/a>\u00a0on state charges for refusing to certify.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt00143b6mss94epmf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Similar delays played out in\u00a0Otero County, New Mexico, when the county commission initially refused to certify election results over concerns about\u00a0<a href=\"https:\/\/www.cnn.com\/factsfirst\/politics\/factcheck_829bf37c-cbd5-4a5c-8d87-7e53504997cb\">Dominion voting machines<\/a>\u00a0and questions about a handful of individual votes, and in North Carolina, where the election board delayed certification in one district allegations of irregularities with absentee ballots.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt00153b6modxefkmk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In Pennsylvania, the then-acting secretary of the Commonwealth and Pennsylvania Department of State sued the boards of election in three counties over their failure to certify results too.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1pah5jt00163b6mgyt7skvj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In all those instances, votes were eventually certified.
