{"id":109367,"date":"2024-10-02T03:53:01","date_gmt":"2024-10-01T20:53:01","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=109367"},"modified":"2024-10-02T03:53:01","modified_gmt":"2024-10-01T20:53:01","slug":"georgia-judge-signals-a-need-to-clarify-vague-new-election-certification-rule","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=109367","title":{"rendered":"Georgia judge signals a need to clarify \u2018vague\u2019 new election certification rule"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div data-editable=\"content\" itemprop=\"articleBody\" data-reorderable=\"content\">\n<p>\n    <cite class=\"source__cite\"><br \/>\n      <span class=\"source__location\" data-editable=\"location\"\/><br \/>\n      <span class=\"source__text\" data-editable=\"source\">CNN<\/span><br \/>\n        \u00a0\u2014\u00a0<br \/>\n    <\/cite>\n<\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqdi9a000la3nx93bd4ymg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A Georgia judge signaled Tuesday that he sees a need to bring clarity to the meaning of a \u201cvague\u201d <a href=\"https:\/\/www.cnn.com\/2024\/10\/01\/politics\/certification-lawsuits-georgia-swing-states\/index.html\">new election certification rule<\/a> approved by Donald Trump allies that critics say will inject chaos into the battleground state after Election Day.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqgc6s00063b6ma9uhhuni@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            State and national Democrats have <a href=\"https:\/\/www.cnn.com\/2024\/08\/26\/politics\/democrats-lawsuit-georgia-certification-rules\/index.html\">sued the GOP-controlled Georgia State Election Board<\/a> over a pair of rules passed in August that require county election officials to conduct a \u201creasonable inquiry\u201d into election results before certifying them and allow them to \u201cexamine all election related documentation created during the conduct of elections prior to certification of results.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqgc6s00073b6meyywd5o9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            During a bench trial in the case on Tuesday, Fulton County Superior Court Judge Robert McBurney said the \u201creasonable inquiry\u201d rule \u201con its face is vague and needs clarification.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqgc6s00083b6m08zmcvqw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At several other points during the trial, McBurney also raised concerns about the election board changing election rules so close to this year\u2019s contest, saying that \u201cnew rules seem to pop up every 20 minutes.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqgc6s00093b6m7lsdm63v@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cAnd the election is getting closer, not further away,\u201d the judge said, pushing back on an argument from Republicans that intervened in the case to defend the new rules that his hands are tied by a judicial principle established in a 2006 Supreme Court case,\u00a0<em>Purcell v. Gonzalez.\u00a0<\/em>\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqgc6s000a3b6ma5nz8pz3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The high court said in its decision in that case that federal courts should not change rules \u201con the eve of an election.\u201d But, the judge said, that puts court in a difficult situation if the rules shouldn\u2019t have been approved in the first place.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqgc6s000b3b6mjqwy08kv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThat would mean that there is a window where unreviewable rules can be issued,\u201d McBurney said. \u201cThey can be procedurally defective. They can be substantively defective. They can be unconstitutional and they\u2019re incapable of review because this agency, this rulemaking body, says, \u2018Oh, we\u2019re within the Purcell window, now\u2019s the perfect time to say let\u2019s count ballots by hand and we know a court can\u2019t look at that new rule because it\u2019s too close to the election.\u2019\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqgc6s000c3b6mzxlhvazz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Last month, three Trump allies on the board approved a rule that requires counties to hand-count the number of ballots cast at polling places on Election Day. <a href=\"https:\/\/www.cnn.com\/2024\/09\/30\/politics\/georgia-hand-ballots-rule-democrats-lawsuit\/index.html\">Democrats sued<\/a> to block that new rule on Monday.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqgc6s000d3b6msopcksov@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But as McBurney on Tuesday seemed to agree that clarity needed to be brought to the \u201creasonable inquiry\u201d rule passed by the board in August, he threw cold water on Democrats\u2019 argument that the \u201cexamination rule\u201d will disrupt the certification process, which must be completed this year by November 12.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqgc6s000e3b6ms9apqr3r@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThat seems to be a permissive rule, and I struggle to see how that presents uncertainty to anyone because it permits access but doesn\u2019t obligate anyone to do anything. It says you may, but not that you must,\u201d McBurney said of the examination rule.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqgc6s000f3b6mj6tws9ck@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At the start of Tuesday\u2019s trial, attorneys for all sides agreed that certification must be completed by 5:00 p.m. on November 12, as state law requires. But Democrats are still arguing that a ruling still needs to guard against county election officials who may refuse to certify the election results under the new rules.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqdjzv00003b6m1b0w9sds@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The case is among the most closely watched pre-election disputes, with Democrats warning that if the rules are allowed to stand, they\u2019ll unleash \u201cchaos\u201d throughout the critical battleground state in the days following the election, when county election officials face a short window of time to certify the results of the presidential contest.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqnbia000m3b6m470ofsyn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The judge\u2019s decision is not expected to be the final say in the matter, as both sides are likely to appeal any adverse ruling against them.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqnc7c000o3b6mch6eclvu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump and his allies unsuccessfully tried to overturn the results of Georgia\u2019s 2020 election, and the lawsuit, which is backed by Vice President Kamala Harris\u2019 campaign, underscores renewed fears from Democrats that his supporters might try to subvert this year\u2019s result should he lose the state again.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqocmf000r3b6mwadvxnuq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At the center of the case are claims by the Democratic National Committee, the Democratic Party of Georgia and several others that the new rules conflict with state law that says local officials have a mandatory duty to certify election results by November 12. The new rules, they argue, undermine that duty by giving those officials broad authority to delay or decline altogether their certification of the results \u201cin a hunt for purported election irregularities.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqoq6q000u3b6m4w9ymliy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Democrats say that the State Elections Board exceeded its authority when it took the job of handling allegations of \u201cfraud or election misconduct\u201d out of state courts and put it in the hands of local partisan officials.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqppt3000z3b6mbgaolgfx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cCounty-level discretion over certification is not needed to address misconduct, fraud, or error; an expedited, orderly, and evidence-based judicial process exists to do so instead,\u201d attorneys for the rule\u2019s challengers wrote in court papers.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqpp2d000x3b6m3owgv36y@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The plaintiffs are asking McBurney to \u201cconfirm that the duty of county superintendents to certify election results by the statutory deadline is mandatory\u201d and to invalidate the new rules should he find that state law leaves no room to \u201cwithhold or delay certification.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1qqrbsy00183b6mszbpkd9t@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The attorneys also argued that the Democrats\u2019 concerns are over potential \u201cfuture contingencies\u201d that don\u2019t meet the legal threshold required to bring the lawsuit in the first place.
