A lower court initially sided with the couple, denying Uber\u2019s motion to compel arbitration in November 2023.<\/p>\n<p>Uber appealed the decision, and late last month, the appeals court ruled in its favor.<\/p>\n<p>\u201cWe hold that the arbitration provision contained in the agreement under review, which Georgia or her minor daughter, while using her cell phone agreed to, is valid and enforceable,\u201d the three-judge panel wrote in September. \u201cWe, therefore, reverse the portion of the order denying arbitration of the claims against Uber.\u201d<\/p>\n<p>Shapiro tells NPR that the couple \u201c100%\u201d wants to keep pursuing their case and are mulling their options, including asking the trial court to reconsider it or potentially trying to bring it to the New Jersey Supreme Court.<\/p>\n<aside id=\"ad-secondary-wrap\" class=\"ad-wrap secondary\" aria-label=\"advertisement\">\n<\/aside>\n<p>\u201cUber has just been extremely underhanded in their willingness to open the same cabinets that they\u2019re forcing the McGintys to open up and have to peek around in,\u201d Shapiro says. \u201cIt\u2019s unfortunate that that\u2019s the way that they\u2019re carrying on their business because this is truly something that subjects millions and millions of Americans and people all over the world to a waiver of their hard-fought rights.\u201d<\/p>\n<p>The case calls to mind another recent example of what Shapiro described as an \u201cinfinite arbitration agreement,\u201d in which <a href=\"https:\/\/www.npr.org\/2024\/08\/14\/nx-s1-5074830\/disney-wrongful-death-lawsuit-disney\"><u>Disney tried to block a man\u2019s wrongful death lawsuit<\/u><\/a> on behalf of his wife \u2014 who died following an allergic reaction at a Disney World restaurant \u2014 because he had signed up for a trial of Disney+. The company backtracked on its push for arbitration after considerable media coverage and outcry.<\/p>\n<p>When asked for comment about the McGinty case, Uber pointed to quotes from the court\u2019s decision supporting that Georgia had agreed to its terms of use \u2014 including its arbitration agreement \u2014 on multiple occasions.<\/p>\n<p>\u201cWhile the plaintiffs continue to tell the press that it was their daughter who ordered Uber Eats and accepted the Terms of Use, it&#8217;s worth noting that in court they could only \u2018surmise\u2019 that that was the case but could not recall whether \u2018their daughter ordered food independently or if Georgia assisted,\u2019&#8221; the company added.<\/p>\n<h3 class=\"edTag\">An Uber Eats dinner, a \u2018T-bone\u2019 car crash and lasting pain<\/h3>\n<p>Georgia McGinty originally signed up for an Uber account in 2015, and her account agreed to its updated terms of use two more times in April 2021 and January 2022, according to court filings.<\/p>\n<p>Uber says all of those terms included language about arbitration, the most recent of which was a clause about any disputes arising between McGinty and Uber \u2014 including concerning auto accidents or personal injuries \u2014 being resolved through binding arbitration and \u201cnot in a court of law.\u201d<\/p>\n<aside id=\"ad-third-wrap\" class=\"ad-wrap third\" aria-label=\"advertisement\">\n<\/aside>\n<p>But the McGintys say it was their daughter who clicked the \u201cconfirm\u201d button in early 2022, while she was using her mom\u2019s phone to order dinner for the family through Uber Eats as they packed for an upcoming ski trip.<\/p>\n<p>Her parents say they don\u2019t remember seeing the terms and conditions \u201cclickbox\u201d pop-up on the screen, or whether they helped their daughter with the order. Riley, a young girl with long brown hair, is behind him, with one arm over each of her father's shoulders.\" loading=\"lazy\"\/><\/picture><\/a>         <\/p>\n<p><!-- END CLASS=\"BUCKETBLOCK\" -->\n      <\/div>\n<p><!-- END CLASS=\"BUCKET IMG\" -->\n   <\/div>\n<p><!-- END ID=\"RESNX-S1-5136615-102\" CLASS=\"BUCKETWRAP INTERNALLINK INSETTWOCOLUMN INSET2COL \" --><\/p>\n<p>The original court found Uber had \u201cfail[ed] to clearly and unambiguously inform plaintiff of her waiver of the right to pursue her claims in a judicial forum,\u201d and that the updated agreement language \u201clacks any specificity on what the resolution would look like or what the alternative to such resolution might be,\u201d court records show.<\/p>\n<p>\u201cEssentially, [the judge] said, \u2018Look, there\u2019s no magic words that are required, but you can\u2019t have none of the language that\u2019s used to enforce these arbitration agreements,\u2019\u201d Shapiro explains, pointing to examples like waiver, right, jury and litigation. \u201cThe way I describe it, you may not need magic words but you have to be speaking the same language.\u201d<\/p>\n<p>In their appeal, Uber countered that Georgia had formed \u201can enforceable arbitration with Uber\u201d and \u201ccannot escape her agreement with Uber by claiming that her daughter agreed to the December Terms on her behalf.\u201d<\/p>\n<aside id=\"ad-overflow-4-wrap\" class=\"ad-wrap overflow\" aria-label=\"advertisement\">\n<\/aside>\n<p>The appeals court, after parsing the language of the multiple agreements and examining precedent, agreed with the company. The judges said they are \u201csatisfied there is no ambiguity when Georgia agreed to resolve disputes related to Uber\u2019s services by binding arbitration \u2018and not in a court of law.\u2018\u201d<\/p>\n<p>And they said the McGinty&#8217;s statements about being preoccupied with packing, and their daughter being \u201ccapable\u201d of frequently ordering food, supports \u201cthe interference that the daughter acted knowingly on Georgia\u2019s behalf.\u201d<\/p>\n<p>Shapiro says the \u201cmost unfair\u201d aspect of the appeals court\u2019s ruling is that it essentially skipped the due process of requiring Uber to provide his clients with the technical information they requested about how those agreement pop-ups work.<\/p>\n<h3 class=\"edTag\">The couple\u2019s lawyer warns of a \u2019slippery slope\u2019 <\/h3>\n<p>Shapiro worries not only about his clients, but about the countless other people who might be affected by these kinds of arbitration agreements in previously unfathomable circumstances.<\/p>\n<p>\u201cIt\u2019s amazing to me the reach that these things are going to go to,\u201d he says. \u201cIf you shop at a store, and you\u2019re a member of their loyalty program, you\u2019re gonna be agreeing to arbitration.
