Within its pages, the document provides a detailed recounting of the hours leading up to the US Capitol riot and the deterioration of the relationship between the two men that led crowds of Trump supporters to call for violence against Pence.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1smi34900003b6l4oz6x2ud@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The role that Trump\u2019s vice president is playing in federal prosecution against him has always been one of the most remarkable things about Smith\u2019s case. But a <a href=\"https:\/\/www.cnn.com\/2024\/07\/01\/politics\/takeaways-trump-immunity-scotus\/index.html\">ruling over the summer by the Supreme Court<\/a>, which granted Trump sweeping immunity for official actions but left the door open for prosecutors to pursue him for unofficial steps he took, also explains why those interactions make a hefty part of the historic new brief.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000c3b6lxl9ad1hr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            While the Supreme Court did not fully strip away allegations against Trump related to Pence from the case, the conservative majority indicated that it was skeptical that Trump\u2019s conduct toward Pence could be prosecuted. Addressing the allegations that Trump pressured Pence to disrupt Congress\u2019 certification, the high court deemed that conduct a \u201cpresumptively immune\u201d official act and set a high bar for prosecutors to clear if they wanted to keep it in their case.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000d3b6l0w1jlovc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Smith, in an attempt to clear that hurdle, went into granular detail about the circumstances around various Trump-Pence conversations \u2013 where they occurred, who else was there and what each party said \u2013 to argue that those interactions were beyond immunity as they could serve no executive function.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000e3b6ldicm4xwv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At least some of that evidence came from Pence\u2019s book, according to footnotes, while other pieces came from his contemporaneous notes and likely other non-public sources, including perhaps his own grand jury testimony.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000g3b6lbt6h13j8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Smith\u2019s team in the filing attempted to cast Pence\u2019s communications with Trump outside of his official vice presidential duties by framing a series of interactions between the two as conversations between \u201crunning mates\u201d and friends, where Pence looked to console Trump and urged him to accept his electoral defeat in the weeks following the election.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000h3b6lydx97cdb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On November 7, when many outlets called the 2020 election for Biden, Pence allegedly \u201ctried to encourage\u201d the defendant \u201cas a friend,\u201d according to prosecutors. He told Trump that he should focus on how he revived the Republican Party and \u201cgave it a new lease on life.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000i3b6lew3nf5xt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At a November 12 lunch, Pence told Trump that he didn\u2019t have to concede but he could \u201crecognize process is over,\u201d prosecutors said. And four days later at another lunch, Pence again tried to get Trump to accept the results and suggested running again in 2024, the filing says. Trump, though, responded: \u201cI don\u2019t know, 2024 is so far off.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000j3b6lr5px225w@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            And during a November 23 phone call, Trump allegedly told Pence that one of his private attorneys was skeptical about the election challenges.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000k3b6l0s0s3rxf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            During a December 21 private lunch, prosecutors say Pence \u201cencouraged\u201d Trump \u201cnot to look at the election \u2018as a loss \u2013 just an intermission.\u2019\u201d Later that day, Trump asked Pence during a private discussion in the Oval Office what they should do, to which Pence said, \u201cAfter we have exhausted every legal process in the courts and Congress, if we still came up short, [Trump] should \u2018take a bow.\u2019\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000l3b6ls36bdx87@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The file also details how Pence relayed to Trump responses from the governors of Arizona and Georgia, who told him they \u201cdid not report evidence of fraud in the elections in their states\u201d and \u201ccould not take actions to convene their states.\u201d Trump disregarded his running mate, prosecutors say.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000n3b6l8pljrpax@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump, after Pence told him he did not have the authority to decertify the election, began to up the intensity of his request, prosecutors say.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000o3b6lska7ep7u@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Prosecutors cite contemporaneous notes written by Pence \u2013 that allegedly show Trump and his co-conspirators \u201cplotted to manipulate\u201d the then-vice president about his role in the election certification process in the lead up to January 6.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000p3b6lifp0dl99@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump personally asked one of his co-conspirators, John Eastman, to explain to Pence why he should reject the official Electoral College votes on January 6. Pence took notes during that meeting, Smith says, which allegedly memorialized Trump saying that \u201cwhen there\u2019s fraud the rules get changed\u201d and \u201cthis whole thing is up to MP.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000q3b6l4mji6nk5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201c[H]as to do w\/you \u2013 you can be bold,\u201d Pence\u2019s notes allegedly say.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000r3b6lgnjxky6p@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            While Trump began to \u201cdirectly and repeatedly\u201d pressure Pence, his co-conspirators worked to orchestrate the pressure campaign behind the scenes, Smith says.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000s3b6li3gai4ok@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On January 1, Trump called Pence to berate him for filing a brief opposed to a suit brought by Trump and his allies that sought to force Pence to help throw the election to Trump, prosecutors say. On the call, Trump told Pence that \u201chundreds of thousands\u201d of people \u201care gonna hate your guts\u201d and \u201cpeople are gonna think you\u2019re stupid,\u201d also calling Pence \u201ctoo honest,\u201d according to the filing.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000u3b6lq0vsgo3k@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On January 5, 2021, according to the filing, Trump once again met with Pence to allegedly try to pressure him not to certify the electoral college votes. It was in that meeting that Trump threatened to criticize Pence publicly, Smith wrote, citing <a href=\"https:\/\/www.cnn.com\/2022\/11\/15\/politics\/mike-pence-book-trump-january-6\/index.html\">Pence\u2019s book<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000v3b6ltzm7x4co@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Smith says that Pence told someone identified in the filing only as \u201cP8\u201d about that comment, and that \u201cP8\u201d was so concerned by the prospect that he alerted Pence\u2019s Secret Service detail.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000w3b6lhbor18pg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump tried again to pressure Pence on the morning of January 6, shortly before driving to deliver his speech at the Ellipse, prosecutors say.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000x3b6le3n1amay@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Pence, however, again refused and Trump \u201cwas incensed,\u201d the filing states.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000y3b6lsyikhn6i@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It was then that Trump \u201cset into motion the last plan in furtherance of his conspiracies: if Pence would not do as he asked, [Trump] needed to find another way to prevent the certification of Biden as president,\u201d according to the filing.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t1000z3b6lyi4pv3e9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cSo on January 6, [Trump] sent to the Capitol a crowd of angry supporters, whom the defendant had called to the city and inundate with false claims of outcome-determinative election fraud, to induce Pence not to certify the legitimate electoral votes and to obstruct the certification,\u201d the filing states.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t100103b6ljorckkjv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            According to prosecutors, Trump also showed his \u201cdesperate conduct as a candidate rather than a President\u201d when rioters stormed the Capitol, forcing Pence to be moved to a secure location.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t100113b6l6q9zw5df@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            An unnamed White House aide, according to the filing, ran to Trump when he received a phone call that Pence had been taken to a secure location \u201cin hopes that [Trump] would take action to ensure Pence\u2019s safety.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t100123b6lxai5v66t@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump, however, according to prosecutors, looked at the aide and simply replied, \u201cSo what?\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t100143b6lde33dk6g@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump personally posted on Twitter as the riot unfolded at the Capitol, saying that Pence \u201cdidn\u2019t have the courage\u201d to overturn the election results, according to prosecutors.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t100153b6l87yhjes6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At the time he posted the tweet, prosecutors say, Trump knew his request for Pence to block the Electoral College votes was illegal, knew that his supporters gathered in Washington, DC, believed his lies during his speech at the Ellipse that the election had been stolen, and knew that those supporters had now breached the Capitol building.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t100163b6lyk3ad5j6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt was at that point \u2014 alone, watching news in real time, and with knowledge that rioters had breached the Capitol building \u2014 that the defendant issued the 2:24 p.m. Tweet attacking Pence for refusing the defendant\u2019s entreaties to join the conspiracy and help overturn the results of the election,\u201d Smith wrote.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t100173b6l1d27327y@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The tweet communicated \u201cto his angry supporters that Pence had let him \u2014 and them \u2014 down,\u201d Smith wrote, adding that it was \u201cnot a message sent to address a matter of public concern and ease unrest; it was the message of an angry candidate upon the realization that he would lose power.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t100183b6li3le04w9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A rioter at the Capitol used a bullhorn to read out the post, according to the filing. One minute after the Tweet was posted, Smith wrote, the Secret Service was forced to evacuate Pence to a secure location in the Capitol.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1sml5t100193b6lk3g0vlrn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Some of those inside the Capitol then later began chanting, \u201cHang Mike Pence!,\u201d \u201cWhere is Pence?
