The <a href=\"https:\/\/www.cnbc.com\/2024\/09\/04\/republican-led-states-sue-to-block-bidens-student-loan-forgiveness-plan.html\" target=\"_blank\" rel=\"noopener\">lawsuit was brought in September by seven <\/a><a href=\"https:\/\/www.cnbc.com\/2024\/09\/04\/republican-led-states-sue-to-block-bidens-student-loan-forgiveness-plan.html\" target=\"_blank\" rel=\"noopener\">GOP-led<\/a><a href=\"https:\/\/www.cnbc.com\/2024\/09\/04\/republican-led-states-sue-to-block-bidens-student-loan-forgiveness-plan.html\" target=\"_blank\" rel=\"noopener\"> states<\/a> \u2014 Alabama, Arkansas, Florida, Georgia, Missouri, North Dakota and Ohio \u2014 against Biden and Education Secretary Miguel Cardona.<\/p>\n<p class=\"\">U.S. District Judge Randall Hall wrote in his order, filed in the Southern District of Georgia, that Georgia lacks standing to challenge the plan &#8220;because it failed to show an injury that is concrete, particularized, actual, or imminent.&#8221; <\/p>\n<p class=\"\">&#8220;Without standing, the Court finds it proper to dismiss Georgia as a party to the suit for lack of subject matter jurisdiction and turns to Defendants\u2019 arguments related to venue,&#8221; he wrote. <\/p>\n<p class=\"\">The judge also wrote that the court agrees with the federal government&#8217;s argument that the venue was improper. <\/p>\n<p class=\"\">&#8220;Without standing, Georgia cannot provide the proper venue for suit because a plaintiff that lacks standing cannot create venue where it would not otherwise exist,&#8221; he wrote. <\/p>\n<p class=\"\">The judge said that the &#8220;most equitable result&#8221; is to transfer the case to a district &#8220;in which venue is proper.&#8221; He wrote that he would transfer the case to the U.S. District Court for the Eastern District of Missouri. <\/p>\n<p class=\"\">The states that brought the lawsuit have argued that the administration\u2019s rule that would mass-cancel student debt would be detrimental to income tax revenue.\u00a0<\/p>\n<p class=\"\">Last month, Hall had extended a temporary restraining order on the plan for an additional 14 days.<\/p>\n<p class=\"\">This comes ahead of the Biden administration publishing its final rule on the plan this month, which could cancel student debt for more than  25 million borrowers.\u00a0<\/p>\n<p class=\"\">Biden <a href=\"https:\/\/www.nbcnews.com\/politics\/white-house\/biden-announce-new-plans-provide-student-debt-relief-millions-rcna146806\" target=\"_blank\" rel=\"noopener\">laid out the revised plan in April<\/a> after the Supreme Court nullified the administration\u2019s original student debt forgiveness program in 2023. That plan would have benefitted 43 million borrowers by canceling up to $20,000 in debt, potentially costing more than $400 billion.\u00a0<\/p>\n<p class=\"endmark\">The states sued the administration last month after <a href=\"https:\/\/www.ed.gov\/about\/news\/press-release\/biden-harris-administration-takes-next-step-toward-additional-debt-relief-for-tens-of-millions-of-student-loan-borrowers-this-fall\" target=\"_blank\" rel=\"noopener\">it said over the summer that it would begin <\/a><a href=\"https:\/\/www.ed.gov\/about\/news\/press-release\/biden-harris-administration-takes-next-step-toward-additional-debt-relief-for-tens-of-millions-of-student-loan-borrowers-this-fall\" target=\"_blank\" rel=\"noopener\">contacting<\/a><a href=\"https:\/\/www.ed.gov\/about\/news\/press-release\/biden-harris-administration-takes-next-step-toward-additional-debt-relief-for-tens-of-millions-of-student-loan-borrowers-this-fall\" target=\"_blank\" rel=\"noopener\"> all borrowers<\/a> with at least one outstanding federally held student loan about their relief options.
