A hearing is set for Nov. 26. \u00a0<\/p>\n<p>Lyle and Erik Men\u00e9ndez have spent nearly 35 years behind bars for fatally shooting their parents, Jos\u00e9 and Kitty Men\u00e9ndez,\u00a0<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/menendez-brothers-inside-the-notorious-case-48-hours\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\" rel=\"noopener\">at their Beverly Hills mansion on the evening<\/a><\/span> of Aug. 20, 1989. Prosecutors argued it was a murder motivated by greed \u2014 not long after their parents&#8217; deaths, the brothers were alleged to have spent money on Rolex watches, cars and real estate investments.<\/p>\n<p>But the Men\u00e9ndezes testified that they killed their parents in self-defense. The brothers told the jury about the alleged sexual abuse they said they experienced at the hands of their father during an emotional, highly publicized first trial \u2014 with separate juries for each of them.<\/p>\n<p>With jurors divided, the judge declared a mistrial.\u00a0<\/p>\n<p>The brothers were later convicted of first-degree murder during a second trial in 1995. Prosecutors argued the brothers, who were 21 and 18 at the time of the killings, were lying about the alleged abuse.<\/p>\n<p>On Thursday, Gasc\u00f3n mentioned a 1988\u00a0<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/menendez-brothers-lyle-erik-abuse-claims-supported-by-newly-discovered-evidence-48-hours\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\" rel=\"noopener\">letter from Erik Men\u00e9ndez<\/a><\/span>\u00a0to a cousin that appears to reference alleged abuse by his father, as well as an abuse allegation made by Roy Rossell\u00f3, a former member of boy band Menudo, against Jos\u00e9 Men\u00e9ndez, who worked as a record company executive.\u00a0<\/p>\n<p>Gasc\u00f3n said prosecutors are reviewing those potential pieces of new evidence as they reconsider the convictions.<\/p>\n<p>Later on Thursday, attorney Mark Geragos said at a separate news conference that the new evidence, including a declaration from Rossell\u00f3, &#8220;provides an ample basis to set aside the result of the second trial.&#8221;<\/p>\n<p>He described the brothers as &#8220;model prisoners&#8221; during their more than three-decade sentence.\u00a0<\/p>\n<p>&#8220;I think we&#8217;re at a point now where any reasonable person taking a look at this case believes they should be out,&#8221; he said.\u00a0<\/p>\n<p>The Men\u00e9ndez case has received renewed attention in recent weeks after the release of the Netflix true crime drama series, &#8220;Monsters: The Lyle and Erik Menendez Story.&#8221; A documentary about the case, &#8220;The Menendez Brothers,&#8221; premieres Monday on Netflix.\u00a0<\/p>\n<p>Gasc\u00f3n said his office received an influx of calls following the release of the Netflix series.\u00a0<\/p>\n<p>&#8220;We&#8217;re here to tell you that we have a moral and an ethical obligation to review what is being presented to us,&#8221; Gasc\u00f3n said.<\/p>\n<p>    <!-- data-recirc-source=\"queryly\" --><\/p>\n<aside class=\"component list recirculation component--type-recirculation \">\n<p><h3 class=\"component__title\">More from CBS News<\/h3>\n<\/p>\n<\/aside>\n<p><!-- tags --><\/p>\n<div class=\"content-author\">\n      <a href=\"https:\/\/www.cbsnews.com\/team\/marissa-wenzke\/\" class=\"content-author__name\" data-invalid-url-rewritten-http=\"\">Marissa Wenzke<\/a><\/p>\n<div class=\"content-author__bio\">\n<div class=\"content-author__full-information\">\n<p class=\"content-author__text\">Marissa Wenzke is a journalist based in Los Angeles.
