The former \u201cDancing With the Stars\u201d pro was ultimately <a href=\"https:\/\/nypost.com\/2024\/09\/24\/entertainment\/artem-chigvintsev-wont-face-criminal-charges-over-arrest-amid-nikki-garcia-divorce\/\">not charged<\/a>.\u00a0<\/p>\n<p>In a statement given to The Post on Chigvintsev\u2019s behalf by his lawyer, Ilona Antonyan, Chigvintsev denies Bella\u2019s allegations that he tackled her and insists \u201che was not the primary aggressor.\u201d<\/p>\n<p>\u201cIt is crucial to consider the motivations of both parties in this situation,\u201d Antonyan said.<\/p>\n<p>\u201cMr. Chigvintsev contacted law enforcement on 8\/29\/24 seeking protection from his wife\u2019s persistent aggression. While he was on the phone with the police, Ms. Garcia-Colace made a pointed statement, saying, \u2018Do you understand where this is going now, Artem? You just ruined my career, and you know it.&#8217;\u201d<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Artem Chigvintsev and Nikki Bella, a k a Nikki Garcia <span class=\"credit\">theartemc\/Instagram<\/span><\/figcaption><\/figure>\n<aside class=\"single__inline-module aligncenter wp-block-nypost-editor-primary-tag\">\n<\/aside>\n<p>Antonyan continued, \u201cThat day, someone was going to be arrested, and it wouldn\u2019t have been Mr. Chigvintsev if Ms. Garcia Colace had told the truth.<\/p>\n<p>\u201c[Chigvintsev] denies ever tackling her. He was shocked to learn two weeks after the incident that she made this allegation against him; at that point it made sense to him why he was arrested.\u201d<\/p>\n<p>The dance pro\u2019s lawyer went on, \u201cAs a result of wife\u2019s self-serving statement, Mr. Chigvintsev\u2019s career suffered, with numerous opportunities being canceled due to these false allegations. Men can also be victims of domestic violence; Mr. Chigvintsev\u2019s case highlights this reality. He was not the primary aggressor.\u201d<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Former \u201cDWTS\u201d pro Artem Chigvintsev provided photos showing what he says are injuries he sustained after his wife, Nikki Bella (a k a Nikki Garcia) allegedly physically attacked him on August 29, 2024.  <span class=\"credit\">SUPERIOR COURT OF CALIFORNIA<\/span><\/figcaption><\/figure>\n<p>In his complaint obtained by The Post, Chigvintsev, 42, agreed with Bella\u2019s claim in her petition that their altercation began with a fight over their 4-year-old son, Matteo, and his breakfast, though each tells a different version of how this dispute arose. In his petition, Chigvintsev says Bella criticized him on the morning of August 29 for not having their child\u2019s breakfast and packed lunch prepared and complained that their son\u2019s muffin was not toasted enough.<\/p>\n<p>According to Chigvintsev, Bella seemed \u201cstressed due to her job that was coming up\u201d as host of the Netflix live competitive eating special, \u201cUnfinished Beef.\u201d<\/p>\n<p>\u201cShe continued saying that she does everything, and I don\u2019t help, which is absolutely false,\u201d Chigvintsev went on, claiming that his wife continued to berate him as he took their son toward the door to leave for school.\u00a0<\/p>\n<p>The fight then allegedly escalated during a discussion about their son\u2019s shoes. \u201c[Bella] completely lost it and started screaming \u2018get the f \u2013 \u2013 k out of my house, I am sick of all of it, I had enough,\u2019\u201d Chigvintsev said in his restraining order request.\u00a0<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Chigvintsev says he \u201cwas not the primary aggressor\u201d in the altercation that led to his arrest on suspicion of domestic violence. No charges were brought against the dancer. <span class=\"credit\">SUPERIOR COURT OF CALIFORNIA<\/span><\/figcaption><\/figure>\n<p>This was \u201cfollowed by [her] forcefully throwing both of Matteo\u2019s sneakers at me,\u201d he continued, saying that \u201cshe hit my chest area\u201d but \u201cfortunately the shoes did not hit Matteo although he was right next to me.\u201d\u00a0<\/p>\n<p>\u201c[M]y first reaction was obviously safety of Matteo because he was standing right by my side,\u201d he recalled.\u00a0<\/p>\n<p>Matteo was \u201cvery confused and look[ed] frightened\u201d while Bella \u201ccontinue[d] yelling about wanting a divorce,\u201d according to Chigvintsev.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>According to both Chigvintsev and Bella, their altercation began with a dispute over their son\u2019s breakfast. <span class=\"credit\">SUPERIOR COURT OF CALIFORNIA<\/span><\/figcaption><\/figure>\n<p>At this point, the \u201cDWTS\u201d vet alleged he \u201chad to protect\u201d their son and was \u201cpleading with [Bella] to please stop this and calm down.<\/p>\n<p>\u201cI took Matteo into my arms, and tried to deescalate the situation and take him upstairs to his room,\u201d he continued. But he says this only had the effect of escalating the conflict.<\/p>\n<p>Once inside their son\u2019s room, Chigvintsev alleged the former WWE Diva \u201ctried to force herself in to open the door.<\/p>\n<p>\u201cI could not hold it, because she\u2019s quite strong. As soon as the door began opening, Matteo start[ed] crying,\u201d he alleged. \u201cI did not want him seeing his mother angry and confrontational in his bedroom. I wanted to protect Matteo from her lack of self-control at the moment.\u201d<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Artem Chigvintsev arrives at \u201cDancing with the Stars\u201d on October 13, 2023 in Los Angeles. <span class=\"credit\">GC Images<\/span><\/figcaption><\/figure>\n<p>Chigvintsev added, \u201cI squeezed myself through the door opening and tried to push myself out, while Petitioner continued to physically attack me and push her way in.<\/p>\n<p>\u201cI tried to get her off me and away from the door frame so that Matteo would not witness any further conflict. I cannot stress enough how many times I pleaded with her to stop and calm down.\u201d\u00a0<\/p>\n<p>Chigvintsev conceded in his filing at this point, \u201cThere was a mutual struggle, and both ended up on the ground.\u201d<\/p>\n<p>Eventually, he alleged, he was able to find his phone and call 911, waiting outside for law enforcement to show up. He said he was shocked when he was arrested and claims his wife lied to sheriffs.\u00a0<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Artem Chigvintsev and Nikki Bella <span class=\"credit\">theartemc\/Instagram<\/span><\/figcaption><\/figure>\n<p>\u201cI had no idea what she told the police, but to my surprise I ended up getting arrested,\u201d Chigvintsev said in his filing. \u201cI was not the primary aggressor, she definitely was.<\/p>\n<p>\u201cSince the 8\/29\/24 incident, I learned on 9\/13\/24 that she lied to the police that I tackled her twice, which is absolutely false.\u201d\u00a0<\/p>\n<p>Chigvintsev also disputed Bella\u2019s claim that \u201cshe was holding our son and I grabbed Matteo from her and barricaded myself in the room.\u201d\u00a0<\/p>\n<p>\u201cThis was a complete LIE,\u201d he said. \u201cBut it mase [sic] sense why I was arrested instead of her.\u201d<\/p>\n<p>In his restraining order request, the dancer also provided photos that purportedly show wounds he sustained as a result of his fight with Bella.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Artem Chigvintsev\u2019s mugshot. He was ultimately not charged after being arrested on suspicion of felony domestic violence.<br \/>\n <span class=\"credit\">Napa County Department of Corrections<\/span><\/figcaption><\/figure>\n<p>The counter claims made in Chigvintsev\u2019s restraining order request directly contradict claims Bella made in her protective order request filed Monday.\u00a0<\/p>\n<p>\u201c[Artem] tackled me multiple times and pinned me to the ground while our child was present,\u201d the \u201cTotal Divas\u201d star alleged in court documents viewed by <a href=\"https:\/\/www.tmz.com\/2024\/10\/03\/nikki-bella-files-restraining-order-against-artem-chigvintsev\/\" target=\"_blank\" rel=\"noreferrer noopener\">TMZ<\/a>.<\/p>\n<p>According to Bella, Chigvintsev had become \u201cincreasingly angry, snapping at me, and yelling\u201d after learning that he wasn\u2019t being asked back for <a href=\"https:\/\/nypost.com\/2024\/08\/29\/entertainment\/artem-chigvintsevs-dwts-season-33-fate-revealed-after-arrest\/\">Season 33 of \u201cDancing With the Stars.\u201d<\/a> As she tells it, it was the dance pro who became angry because of how she had toasted their son\u2019s English muffin, blaming her for the 4-year-old being a \u201cpicky eater.\u201d <\/p>\n<p>Bella confessed to throwing her son\u2019s shoes at the dancer, striking him in the leg. She alleged he then grabbed their toddler and ran upstairs, with the child screaming, \u201cMommy! Mommy!\u201d <\/p>\n<p>The reality star claimed her husband tackled her to the ground, pushed her across a hall and forced her to the floor of their bathroom before allegedly starting to press down on her chest near her sternum. Bella said she then grabbed at Chigvintsev\u2019s neck to get him off her.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Nikki Bella and Artem Chigvintsev. <span class=\"credit\">Getty Images for Prime Video<\/span><\/figcaption><\/figure>\n<p>Per the court order granting Chigvintsev\u2019s restraining order request, for the time being the pair will share joint custody of their son and \u201cthere shall be reasonable daily FaceTime contact between the child and non custodial parent.\u201d<\/p>\n<p>A judge also decreed that \u201cneither parent shall make negative statements about the other in the presence of hearing of the child or question the child about the other parent.\u201d<\/p>\n<p>Both parties are seeking permanent restraining orders against the other and are due back in court on October 21 for a hearing to consider the requests.\u00a0<\/p>\n<p><a href=\"https:\/\/nypost.com\/2024\/09\/11\/entertainment\/nikki-garcia-files-for-divorce-from-artem-chigvintsev-after-his-arrest\/\">Bella filed for divorce<\/a> from her husband of two years on September 11 and asked for <a href=\"https:\/\/nypost.com\/2024\/09\/12\/entertainment\/nikki-garcia-asks-for-custody-of-son-after-filing-for-divorce-from-artem-chigvintsev\/\">sole legal and physical custody<\/a> of their son.
