Now, their effort to bring the case to court could be hampered by a terms-of-service agreement that they say their 12-year-old daughter signed while ordering pizza using Ms. McGinty\u2019s Uber Eats account.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A <a class=\"css-yywogo\" href=\"https:\/\/www.njcourts.gov\/system\/files\/court-opinions\/2024\/a1368-23.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">New Jersey appeals court found last month<\/a> that the agreement\u2019s arbitration provision \u2014 which says that most disputes between Uber and its customers must be litigated privately \u2014 was \u201cvalid and enforceable,\u201d reversing a lower court\u2019s decision that would have allowed the couple\u2019s personal-injury lawsuit to be heard by a jury.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The car crash left the McGintys severely injured. Ms. McGinty, 51, had cervical and lumbar spine fractures, rib fractures, a protruding hernia and other injuries. She had numerous surgeries and was unable to work for more than a year, until April 2023.
