Fulton County Superior Court Judge Robert McBurney ruled on September 30 that privacy rights under Georgia\u2019s constitution include the right to make personal health care decisions.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1za8r1300093b6mt3e50mbs@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It was one of a wave of <a href=\"https:\/\/www.cnn.com\/us\/abortion-access-restrictions-bans-us-dg\/index.html\">restrictive abortion laws<\/a> passed in Republican-controlled states after the US Supreme Court\u00a0<a href=\"https:\/\/apnews.com\/article\/abortion-supreme-court-decision-854f60302f21c2c35129e58cf8d8a7b0\" target=\"_blank\" rel=\"noopener\">overturned Roe v. Wade in 2022<\/a>\u00a0and ended a national right to abortion. It prohibited most abortions once a \u201cdetectable human heartbeat\u201d was present. At around six weeks into a pregnancy, cardiac activity can be detected by ultrasound in an embryo\u2019s cells that will eventually become the heart.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1za8r13000a3b6mxumhloxd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Republican Gov. Brian Kemp signed the measure in 2019, but it didn\u2019t take effect until Roe v. Wade fell.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1za8r13000b3b6mwdapzxxi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            McBurney wrote in his ruling that \u201cliberty in Georgia includes in its meaning, in its protections, and in its bundle of rights the power of a woman to control her own body, to decide what happens to it and in it, and to reject state interference with her health care choices.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1za8r13000c3b6mrotdcfvk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWhen a fetus growing inside a woman reaches viability, when society can assume care and responsibility for that separate life, then \u2014 and only then \u2014 may society intervene,\u201d McBurney wrote.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1za8r13000d3b6m0syr14wi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The judge\u2019s decision rolled back limits in Georgia to a prior law allowing abortions until viability, roughly 22 to 24 weeks into a pregnancy.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1za8r13000e3b6mxj74r1p0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cOnce again, the will of Georgians and their representatives has been overruled by the personal beliefs of one judge,\u201d Kemp said in a statement in response to McBurney\u2019s decision. \u201cProtecting the lives of the most vulnerable among us is one of our most sacred responsibilities, and Georgia will continue to be a place where we fight for the lives of the unborn.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm1za8r13000f3b6mkuvzns5c@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Abortion providers and advocates in Georgia had applauded McBurney\u2019s ruling but expressed concern that it would soon be overturned.\n    <\/p>\n<\/p><\/div>\n<p><script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<br \/><div data-type=\"_mgwidget\" data-widget-id=\"1660802\">\r\n<\/div>\r\n<script>(function(w,q){w[q]=w[q]||[];w[q].push([\"_mgc.load\"])})(window,\"_mgq\");\r\n<\/script>\r\n<br \/>\n<br \/><a href=\"https:\/\/www.cnn.com\/2024\/10\/07\/politics\/georgia-abortion-supreme-court\/index.html\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Savannah, Georgia AP \u00a0\u2014\u00a0 The Georgia Supreme Court on Monday halted\u00a0a ruling striking down\u00a0the state\u2019s near-ban on abortions while it considers the state\u2019s appeal.
