(AP) \u2014 The Georgia Supreme Court on Monday halted <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/georgia-abortion-law-struck-down-632db7d5de815efa18aea52dadbfc59b\">a ruling striking down<\/a><\/span> the state\u2019s near-ban on abortions while it considers the state\u2019s appeal.<\/p>\n<p>The high court\u2019s order came a week after a judge found that Georgia <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-georgia-ban-overturned-appeal-ec732417c9c3b714ccee3b0c9e77bc7d\">unconstitutionally prohibits abortions<\/a><\/span> beyond about six weeks of pregnancy, often before women realize they\u2019re pregnant. Fulton County Superior Court Judge Robert McBurney ruled Sept. 30 that privacy rights under Georgia\u2019s state constitution include the right to make personal healthcare decisions.<\/p>\n<p>The state Supreme Court put McBurney\u2019s ruling on hold at the request of Republican state Attorney General Chris Carr, whose office <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/georgia-abortion-ban-overturned-appeal-38c9c945ad76647223b7252806e14319\">is appealing<\/a><\/span>.<\/p>\n<p>In a dissenting opinion, Justice John J. Ellington argued that the case \u201cshould not be predetermined in the State\u2019s favor before the appeal is even docketed.\u201d<\/p>\n<p>\u201cThe State should not be in the business of enforcing laws that have been determined to violate fundamental rights guaranteed to millions of individuals under the Georgia Constitution,\u201d Ellington wrote. \u201cThe `status quo\u2019 that should be maintained is the state of the law before the challenged laws took effect.\u201d<\/p>\n<p>Clare Bartlett, executive director of the Georgia Life Alliance, called high court\u2019s decision \u201cappropriate,\u201d fearing that without it, women from other states would begin coming to Georgia for surgical abortions.<\/p>\n<p>\u201cThere\u2019s no there\u2019s no right to privacy in the abortion process because there\u2019s another individual involved,\u201d Bartlett said. She added: \u201cIt goes back to protecting those who are the most vulnerable and can\u2019t speak for themselves.\u201d <\/p>\n<p>Monica Simpson, executive director of SisterSong Women of Color Reproductive Justice Collective, said the state Supreme Court had \u201csided with anti-abortion extremists.\u201d Her group is among the plaintiffs challenging the state law.<\/p>\n<p>\u201cEvery minute this harmful six-week abortion ban is in place, Georgians suffer,\u201d Simpson said in a statement. \u201cDenying our community members the lifesaving care they deserve jeopardizes their lives, safety, and health \u2014 all for the sake of power and control over our bodies.\u201d <\/p>\n<p>Leaders of carafem, an Atlanta abortion provider that had planned to expand its services after McBurney\u2019s ruling, expressed dismay at the law\u2019s reinstatement.<\/p>\n<p>\u201cCarafem will continue to offer abortion services following the letter of the law,\u201d said Melissa Grant, the provider\u2019s chief operating officer. \u201cBut we remain angry and disappointed and hope that eventually people will come back to a more sensible point of view on this issue that aligns with the people who need care.\u201d<\/p>\n<p>Georgia\u2019s law, signed by Republican Gov. Brian Kemp in 2019, was one of a wave of restrictive abortion measures that took effect in Republican-controlled states after the U.S. Supreme Court <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-supreme-court-decision-854f60302f21c2c35129e58cf8d8a7b0\">overturned Roe v. Wade in 2022<\/a><\/span> and ended a national right to abortion. It prohibited most abortions once a \u201cdetectable human heartbeat\u201d was present. At around six weeks into a pregnancy, cardiac activity can be detected by ultrasound in an embryo\u2019s cells that will eventually become the heart.<\/p>\n<p>Georgia has a separate criminal law that makes illegal abortions punishable by up to 10 years in prison for providers, but not for women having abortions.
