But <a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trump-casts-election-interference-label-everything-facing-federal-char-rcna173754\">Trump\u2019s accusations are<\/a>, as usual, projection\u2014election interference has long been his own political brand.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"40\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zeno81004r3b707ngkj2tq@published\">Ironically, a Manhattan jury has <a href=\"https:\/\/apnews.com\/article\/trump-trial-deliberations-jury-testimony-verdict-85558c6d08efb434d05b694364470aa0\">actually convicted Trump<\/a> of interfering in the 2016 election. He did that via a successful October scheme that year to \u201ccatch and kill\u201d the story of his one-night stand with adult film star Stormy Daniels.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"60\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zel0rw001y3b703xo37qq5@published\">Then, of course, there\u2019s Trump\u2019s attempt to interfere with the 2020 election by his <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/the-key-findings-and-criminal-referrals-from-the-jan-6-committee-report-summary\">multiple then-secret schemes<\/a> to overturn the will of the people. That makes the irony of Trump\u2019s accusation against Smith especially rich. After all, what the federal court did in releasing the special counsel\u2019s evidence was to shine light on previously unknown information about Trump\u2019s 2020 scheme.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"48\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zeo1jp004y3b70ohuxdjny@published\">Plainly put, a public informed about its government and leaders is the currency of democracy. In this case, being informed means having the fullest information about a former president <a href=\"https:\/\/apnews.com\/article\/trump-election-interference-2020-pence-capitol-riot-c6b616ad45a33f4614cd73e9b77ea0cd\">relentlessly pressing<\/a> his vice president to unconstitutionally reject or delay the Jan. 6 certification of President Joe Biden\u2019s election.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"67\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zeo6qd00553b70vwny9d1z@published\">Moreover, Trump\u2019s effort to overturn the previous election was unmistakably a precursor to what is afoot if he loses again in 2024. Because the past is so often prologue, Trump has tried his damnedest to keep us from connecting the dots between what he did last time and what he <a href=\"https:\/\/www.theguardian.com\/us-news\/article\/2024\/aug\/12\/trump-overturn-result-presidential-election-vote\">intends to do<\/a> this time if he ends up on the short end of the electoral vote.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"81\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zeo84h005b3b70azywdkai@published\">On that score, one of many bombshells in Smith\u2019s filing stands out. At a critical moment in 2020, Nick Luna, the White House director of Oval Office operations, overheard Trump <a href=\"https:\/\/s3.documentcloud.org\/documents\/25193113\/annotated-doj-presidential-immunity-brief-oct-24-just-security.pdf\">telling his family members<\/a>, \u201cIt doesn\u2019t matter if you win or lose. You have to fight like hell.\u201d That is vital information for citizens in 2024 because Trump <a href=\"https:\/\/newrepublic.com\/post\/186624\/trump-election-threat-before-vp-debate\">has repeatedly refused<\/a> to say he would accept the election results if he loses, just as he didn\u2019t accept the result in 2020.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"86\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zel0ry00233b70dqtkznm6@published\">Let\u2019s consider seriously for a moment whether there\u2019s anything wrong with Smith releasing this evidence so close to the election. In its section on \u201c<a href=\"https:\/\/www.americanbar.org\/groups\/criminal_justice\/standards\/crimjust_standards_fairtrial_blk\/\">Fair Trials and Public Discourse<\/a>,\u201d the American Bar Association\u2019s <em>Standards of Criminal Justice<\/em> manual recognizes that \u201ca transparent and open criminal justice system is of critical importance in our democracy.\u201d The standard treats as proper prosecutors\u2019 \u201cstatements reasonably necessary to warn the public of any ongoing dangers that may exist.\u201d The above statement by Trump to his family four years ago qualifies.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"31\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zel0s000243b70j4kpx1w3@published\">Moreover, Smith submitted his prosecutorial evidence in court filings and a judge approved its disclosure; there were no \u201cextrajudicial statements\u201d by prosecutors, the primary vice against which the <a href=\"https:\/\/www.americanbar.org\/groups\/criminal_justice\/standards\/crimjust_standards_fairtrial_blk\/\">ABA standards warn<\/a>.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"34\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zeovut005r3b70roogrlx0@published\">And contrary to the <a href=\"https:\/\/www.foxnews.com\/politics\/trump-blasts-doj-election-interference-calls-federal-case-scam-after-judge-unseals-smiths-key-filing\">claims of Trump<\/a> and his allies\u2014like <a href=\"https:\/\/thehill.com\/opinion\/campaign\/4917230-justice-department-october-surprise\/\">right-wing favorite<\/a> Jonathan Turley and, in this case, even former prosecutor <a href=\"https:\/\/www.cnn.com\/2024\/10\/04\/politics\/video\/jack-smith-trump-filing-elie-honig-reaction-cnc-digvid\">Elie Honig<\/a>\u2014the special counsel adhered to the rules of the criminal justice system.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"63\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zel0rx00203b70wfhfe9lf@published\">First, it was the radical <a href=\"https:\/\/www.washingtonpost.com\/politics\/2024\/07\/01\/supreme-court-immunity-trump-democracy\/\">July 1 immunity ruling<\/a> of the Supreme Court majority that sent the case back to the district court to apply its <a href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/2024-09-24_-_testimony_-_lacovara.pdf\">anti-constitutional holding<\/a> that <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-939_e2pg.pdf\">only \u201cnonofficial\u201d presidential actions<\/a> could be subject to criminal prosecution. The court directed that the trial judge must determine before any trial which charges could go forward and even which evidence could be used.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"97\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zel0rv001w3b70i4m8e848@published\">Accordingly, on Aug. 30, after narrowing the scope of the original indictment, Smith <a href=\"https:\/\/www.cbsnews.com\/news\/trump-special-counsel-federal-2020-election-case\/\">filed his proposal<\/a> for complying with the Supreme Court\u2019s decision. He suggested that the first step be his submitting the government\u2019s evidence of Trump\u2019s \u201cunofficial\u201d criminal conduct related to the 2020 election. If the court found such evidence sufficient to sustain the grand jury\u2019s newly tailored Aug. 27 <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4850566-superseding-indictment-trump-election-subversion-case\/\">superseding indictment<\/a>, the next step in the process\u2014another Trump appeal\u2014would follow. On the other hand, if the court found insufficient evidence of nonofficial criminal conduct, under the July 1 immunity decision, that case would be over.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"47\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zel0rx00213b70eerve4wf@published\">With the <a href=\"https:\/\/www.washingtonpost.com\/national-security\/2024\/09\/05\/trump-jan6-election-interference-case-hearing\/\">court\u2019s consent<\/a>, on Sept. 27, Smith <a href=\"https:\/\/www.axios.com\/2024\/09\/27\/trump-jan-6-case-filing-seal\">filed under seal<\/a> his motion and the evidence of Trump\u2019s criminal conduct that, according to Smith, was unrelated to his official duties. On Wednesday, the <a href=\"https:\/\/www.nytimes.com\/2024\/10\/02\/us\/politics\/trump-jan-6-case-jack-smith-evidence.html\">court unsealed<\/a> a redacted version of the filing, making most of the evidence public.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"31\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zel0rw001x3b70l1ql8rl7@published\">Yet critics <a href=\"https:\/\/www.nytimes.com\/2024\/10\/02\/us\/politics\/trump-jan-6-case-jack-smith-evidence.html\">took the special counsel to task<\/a> for supposedly deviating from judicial and Justice Department rules in order to influence the election. Some of the arguments bordered on the silly.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"105\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zel0rd001v3b70cq9oy6zu@published\">For example, in a New York magazine commentary entitled \u201cJack Smith\u2019s October Cheap Shot,\u201d former prosecutor <a href=\"https:\/\/nymag.com\/intelligencer\/article\/jack-smith-october-surprise-donald-trump.htm\">Honig criticized Smith<\/a> and the court for not waiting until the defendants filed a motion, the usual order in pretrial proceedings. Nonsense. Both the <a href=\"https:\/\/www.justice.gov\/usao\/justice-101\/pretrial-motions\">DOJ\u2019s procedures and the<\/a> Federal Rules of Criminal Procedure <a href=\"https:\/\/www.federalrulesofcriminalprocedure.org\/title-iv\/rule-12-pleadings-and-pretrial-motions\/\">permit a prosecutor<\/a> to file motions first, and prosecutors commonly do so. In particular, as Justice Samuel Alito <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/547\/489\/\">has written<\/a>, the Speedy Trial Act \u201cwas designed not just to benefit defendants but also to serve the public interest.\u201d It is the role of prosecutors to vindicate that interest by initiating judicial action when a defendant dawdles.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"29\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zel0rx00223b70ylkxvote@published\">Trump and Smith\u2019s critics also asserted that the special counsel was violating DOJ rules about prosecutorial actions against candidates undertaken shortly before an election. The Justice Department manual <a href=\"https:\/\/www.justice.gov\/jm\/jm-9-85000-protection-government-integrity#9-85.500\">states<\/a>:<\/p>\n<blockquote data-uri=\"slate.com\/_components\/slate-blockquote\/instances\/cm1zel3c9002e3b70r48813yy@published\" class=\"slate-blockquote\" data-word-count=\"58\">\n<div data-editable=\"text\">\n<p>Federal prosecutors and agents may never select the timing of any action \u2026 <em>for the purpose of <\/em>affecting any election. \u2026 Any action<em> <\/em>likely to raise an issue or the perception of an issue \u2026 shall not be taken <em>if the Public Integrity Section advises that further consultation is required<\/em> with the Deputy Attorney General or Attorney General.<\/p>\n<\/div>\n<\/blockquote>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"81\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zelac3002l3b70oa3elckm@published\">Note that this internal DOJ policy merely bars prosecutors from \u201cselecting the timing\u201d of actions that could have political effects. But the timing of Smith\u2019s action arose from Trump\u2019s success in getting the Supreme Court to defer ruling on the immunity issue until the last day of the court\u2019s term. At Trump\u2019s urging, the court last year <a href=\"https:\/\/www.scotusblog.com\/2023\/12\/court-wont-hear-trump-immunity-dispute-now\/\">rejected Smith\u2019s application<\/a> to take up the issue. Had the court acted when Smith asked, the current proceedings could have taken place months ago.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"36\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cm1zelfco002s3b70enbfshb7@published\">When the court eventually took up the case, it waited additional months to decide it.
