There were no noted dissents. The order let stand <a class=\"css-yywogo\" href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/23\/23-10246-CV0.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">a decision<\/a> from the U.S. Court of Appeals for the Fifth Circuit that said the federal law did not apply to emergency abortions.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The court\u2019s order was broadly consistent with two rulings in abortion cases in June, one rejecting a challenge to abortion pills on standing grounds and the other letting emergency rooms in Idaho perform the procedure when the patient\u2019s health is at risk. The theme that runs through the rulings is that the justices are not eager to return to the subject of abortion.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In a dissent in the Idaho case, Justice Samuel A. Alito Jr. rued the development.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cApparently,\u201d he wrote, \u201cthe court has simply lost the will to decide the easy but emotional and highly politicized question that the case presents. That is regrettable.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In the new case, Elizabeth B.
