The finished weapons don\u2019t have serial numbers, making them nearly impossible to trace. <\/p>\n<p>The regulation came after the number of ghost guns seized by police around the country <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/supreme-court-ghost-guns-federal-regulations-atf-fb38d09a44ddc8fb7074a4273ae4bcd5\">soared<\/a><\/span>, going from fewer than 4,000 recovered by law enforcement in 2018 to nearly 20,000 in 2021, according to Justice Department data. Nearly 700 were linked to murder or attempted homicide investigations during that time. <\/p>\n<p>Finalized after an <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/biden-bureau-of-alcohol-tobacco-firearms-and-explosives-gun-politics-5f0f26cdb5d3bcbc6f9c5daf471c118d\">executive action<\/a><\/span> from President Joe Biden, the rule requires companies to treat the kits like other firearms by adding serial numbers, running background checks and verifying that buyers are 21 or older. <\/p>\n<p>The number of <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/what-are-ghost-guns-aab2ded78314603e8e87e92dbe4def3f\">ghost guns<\/a><\/span> has since flattened out or declined in several major cities, including New York, Los Angeles, Philadelphia and Baltimore, according to court documents. <\/p>\n<p>But manufacturers and gun-rights groups challenged the rule in court, arguing it\u2019s long been legal to sell gun parts to hobbyists and that most people who commit crimes use traditional guns.<\/p>\n<p>They say the Bureau of Alcohol Tobacco Firearms and Explosives overstepped its authority. \u201cCongress is the body that gets to decide how to address any risks that might arise from a particular product,\u201d a group of more than two dozen GOP-leaning states supporting the challengers wrote in court documents. <\/p>\n<p>U.S. District Judge Reed O\u2019Connor in Texas agreed, striking down the rule in 2023. The U.S. 5th Circuit Court of Appeals largely upheld his decision in the case, Garland v. VanDerStok.<\/p>\n<p>The administration, on the other hand, argues the law allows the government to regulate weapons that \u201cmay readily be converted\u201d to shoot. The 5th Circuit\u2019s decision would allow anyone to \u201cbuy a kit online and assemble a fully functional gun in minutes \u2014 no background check, records, or serial number required. The result would be a flood of untraceable ghost guns into our nation\u2019s communities,\u201d <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/joe-biden-us-supreme-court-only-on-ap-19ad9190f158f5df1ac5d2f569dcdc80\">Solicitor General Elizabeth Prelogar<\/a><\/span> wrote. <\/p>\n<p>The case is not directly about Second Amendment gun rights, but rather over the powers of federal agencies. In a similar case, the high court struck down a Trump-era gun regulation on bump stocks this summer, finding the ATF had overstepped its authority by banning them as illegal machine guns. <\/p>\n<p>In the ghost gun case, the Supreme Court <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/supreme-court-ghost-guns-biden-administration-c619b0212be94de9ff043e3a0040b1da\">sided with<\/a><\/span> the Biden administration last year, allowing the regulation to go into effect by a 5-4 vote.
