Trump on Thursday <a class=\"css-yywogo\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.258149\/gov.uscourts.dcd.258149.260.0_2.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">approved a limited release of a compilation of evidence against him<\/a>, but stayed her order for a week in case Mr. Trump\u2019s legal team wants to challenge the disclosure.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Even if the court filing at issue \u2014 an appendix to a <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/10\/02\/us\/politics\/trump-jan-6-case-jack-smith-evidence.html\" title=\"\">165-page brief<\/a> by the special counsel, Jack Smith, that was unsealed last week \u2014 becomes public, it appears unlikely to contain significant new revelations. The judge, Tanya S. Chutkan of the Federal District Court in Washington, said all nonpublic sensitive material in the appendix, like grand jury transcripts and witness interview reports, would remain entirely redacted.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump\u2019s legal team has objected to unsealing any portion of the appendix, arguing that doing so amounts to interference in next month\u2019s presidential election. The jostling over the material is the latest step in the case against Mr. Trump for his attempts to overturn his loss of the 2020 election, culminating in the Jan. 6, 2021, riot at the Capitol.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In July, the Supreme Court granted Mr. Trump partial immunity from prosecution based on his official acts as president and sent the case back to Judge Chutkan to sort through which evidence and allegations are immune and which can still be used at any eventual trial. (Should Mr. Trump win the election and return to the presidency, he could use his power over the Justice Department to fire Mr. Smith and terminate the case.)<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">As an initial step, Mr. Smith filed under seal a lengthy brief detailing the evidence he wants to use and laying out arguments for why none of it should be considered immune. That brief contained no major new revelations that were not in the indictment, but added some new details and texture supporting the major allegations against Mr. Trump.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Smith also filed under seal a much lengthier appendix of the underlying transcripts, documents and other materials from which the quoted portions in his brief were derived.
