Even if a user creates a bot intentionally designed to cause emotional distress, the tech platform likely can\u2019t be sued for that.<\/p>\n<p class=\"paywall\">He points out that <a href=\"https:\/\/www.wired.com\/story\/section-230-internet-sacred-law-false-idol\/\">Section 230<\/a> of the 1996 Communications Decency Act has long protected platforms at the federal level from being liable for certain harms to their users, even though various rights to publicity laws and privacy laws exist at the state level.<\/p>\n<p class=\"paywall\">\u201cI\u2019m not an anti-tech person by any means, but I really think Section 230 is just massively overbroad,\u201d Sag says. \u201cIt\u2019s well past time we replaced it with some kind of notice and takedown regime, a simple expedient system to say, \u2018This is infringing on my rights to publicity,\u2019 or \u2018I have a good faith belief that there\u2019s been an infliction of emotional distress,\u2019 and then the companies would either have to take it down or lose their liability shield.\u201d<\/p>\n<p class=\"paywall\">Character.AI, and other AI services like it, have also protected themselves by emphasizing that they serve up \u201cartificial\u201d conversations. \u201cRemember, everything characters say is made up!\u201d Character.AI warns at the bottom of its chats. Similarly, when Meta created chatbot versions of celebs in its messaging apps, the company headlined every conversation with a disclaimer. A chat with Snoop, for example, would lead with \u201cYa dig?! Unfortunately, I\u2019m not Snoop D-O-double-G himself, but I can chat with you in his style if you\u2019d like!\u201d<\/p>\n<p class=\"paywall\">But while Meta\u2019s system for messaging with celebrity chatbots is tightly controlled, Character.AI\u2019s is a more open platform, with options for anyone to create and customize their own chatbot.<\/p>\n<p class=\"paywall\">Character.AI has also positioned its service as, essentially, personal. (Character.AI\u2019s <a data-offer-url=\"https:\/\/www.instagram.com\/characterai\/?hl=en\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.instagram.com\/characterai\/?hl=en&quot;}\" href=\"https:\/\/www.instagram.com\/characterai\/?hl=en\" rel=\"nofollow noopener\" target=\"_blank\">Instagram bio<\/a> includes the tagline, \u201cAI that feels alive.\u201d) And while most users may be savvy enough to distinguish between a real-person conversation and one with an AI impersonator, others may <a href=\"https:\/\/www.wired.com\/story\/chatbot-kill-the-queen-eliza-effect\/\">develop attachments<\/a> to these characters\u2014especially if they\u2019re facsimiles of a real person they feel they already know.<\/p>\n<p class=\"paywall\">In a conversation between the real-life Sarkeesian and a bot made of her without her knowledge or consent, the Character.AI bot told her that \u201cevery person is entitled to privacy.\u201d<\/p>\n<p class=\"paywall\">\u201cPrivacy is important for maintaining a healthy life and relationships, and I think it\u2019s important to set boundaries to keep certain things to myself,\u201d the bot said in screenshots viewed by WIRED.<\/p>\n<p class=\"paywall\">Sarkeesian pushed the bot on this point. \u201cYour intentions does not mean that harm hasn\u2019t happened or that you did not cause harm,\u201d she wrote.<\/p>\n<p class=\"paywall\">Character.AI\u2019s bot agreed. \u201cEven if my intentions were not malicious, there is still potential for harm,\u201d it replied. \u201cThis is a complex issue with many factors to consider, including ethical concerns about using someone\u2019s work without their consent.
