Greg Abbott is limited to issuing a one-time, 30-day reprieve.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c8lux6000e3b6mo740ziyp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson\u2019s attorneys had asked his sentence be commuted to a lesser one, or that he receive a 180-day reprieve so his appeals can play out in court.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c6w33o00023b6m14bru7hz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            <strong>[Previous story, published at 2:30 p.m. ET]<\/strong>\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c8l7a500043b6m744s65ya@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Calls to spare the life of Texas death row inmate <a href=\"https:\/\/www.cnn.com\/2024\/10\/13\/us\/robert-roberson-execution-shaken-baby-syndrome\/index.html\" rel=\"noopener noreferrer\" target=\"_blank\">Robert Roberson<\/a> are growing, with just over a day left before the state plans to execute him for the murder of his 2-year-old daughter \u2013 a crime Roberson\u2019s advocates say did not happen.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bsepkt000e3b6m87yyg70n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            If he\u2019s put to death by lethal injection Thursday evening, Roberson\u2019s attorneys say he would be the first person in the US executed based on a conviction that relied on an allegation of <a href=\"https:\/\/www.cnn.com\/interactive\/2021\/12\/health\/shaken-baby-syndrome-legal-battle\/\">shaken baby syndrome<\/a> \u2013\u00a0a misdiagnosis in Roberson\u2019s case, they argue, and one they say has been discredited.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bsfc0x000j3b6mj7ewkmsq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            While child abuse pediatricians remain firm on the <a href=\"https:\/\/www.jpeds.com\/article\/S0022-3476(16)30402-4\/fulltext\" target=\"_blank\" rel=\"noopener\">validity of the diagnosis<\/a>, Roberson\u2019s attorneys say there is ample evidence his daughter, Nikki Curtis, did not die of child abuse.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bzpyak001r3b6m4aoyktlo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At the time of her death, she had double pneumonia that had progressed to sepsis, and she had been prescribed two medications now seen as inappropriate for children that would have further hindered her ability to breathe, they argue, citing medical experts. Additionally, she had fallen off a bed, and was particularly vulnerable in her sickly condition, Roberson\u2019s attorneys say.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bstnrm00113b6mxzkg5q3u@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Other factors, too, contributed to his conviction, they argue. Doctors treating Nikki \u201cpresumed\u201d abuse based on her symptoms and common thinking at the time of her death without exploring her recent medical history, the inmate\u2019s attorneys claim. His behavior in the emergency room \u2013 viewed as uncaring by doctors, nurses and the police, who believed it a sign of his guilt \u2013 was actually a manifestation of autism spectrum disorder, which went undiagnosed until 2018.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bvm3po002x3b6mheobdkwp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cVery early on, Robert was the focus of everything to the exclusion of any other possibilities,\u201d said Brian Wharton, the former Palestine, Texas, detective who led what he now believes was a too-narrowly focused investigation into Nikki\u2019s death. He has since joined Roberson\u2019s supporters in fighting to spare his life.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bugrbd002i3b6m49ki4wmv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson\u2019s innocence claim underscores an inherent risk of capital punishment: a potentially innocent person could be put to<em>\u00a0<\/em>death. At least 200 people \u2013 18 in Texas \u2013 have been exonerated since 1973 after being convicted and sentenced to die, according to the\u00a0<a href=\"https:\/\/deathpenaltyinfo.org\/policy-issues\/innocence\" target=\"_blank\" rel=\"noopener\">Death Penalty Information Center<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c6vf7q00003b6m0rtu4bc7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The appeals court denied the inmate\u2019s latest appeal on Wednesday. That court last week ordered a new trial for a man sentenced to 35 years in prison for his conviction of injury to a child in a case that also relied on a shaken baby argument.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bsf49r000h3b6mm399wvg1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson\u2019s attorneys have filed a request for a stay of execution with the US Supreme Court, arguing his due process rights were violated when the Texas Court of Criminal Appeals declined to consider additional evidence the inmate says would support his innocence claim.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2btqmss001v3b6myywql00q@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Separately, Roberson\u2019s attorneys have petitioned the Texas Board of Pardons and Paroles and GOP Gov. Greg Abbott for clemency, asking that this sentence be commuted to a lesser one, or that Roberson be granted a 180-day reprieve to allow time for his appeals to be argued in court.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bttcay001y3b6mxdoycvi8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The board is expected to issue its recommendation on clemency Wednesday. If it declines to recommend clemency, Abbott is limited to granting a one-time, 30-day reprieve.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2btua0500213b6m0ugktz1s@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In the meantime, Roberson\u2019s many supporters are taking their own steps to call attention to his case in hopes of pressing the state into halting the execution.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bsgwtc000o3b6mgsvo8ovc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Texas Committee on Criminal Jurisprudence is holding a hearing Wednesday where it will hear testimony \u201crelated to capital punishment\u201d and a Texas law \u2013 commonly referred to as the <a href=\"https:\/\/www.texasbar.com\/AM\/Template.cfm?Section=articles&amp;Template=\/CM\/HTMLDisplay.cfm&amp;ContentID=47776\" target=\"_blank\" rel=\"noopener\">\u201cjunk science writ\u201d<\/a> \u2013 which opened a path for someone to challenge their conviction if there is new scientific evidence unavailable at the time of their trial.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bstkum000y3b6mjfktswoi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            While Roberson\u2019s name is not mentioned in a notice about the hearing, his advocates say he should benefit from this law \u2013 and a member of the committee, Rep. Jeff Leach, a Republican from Collins County, told reporters Tuesday the hearing would \u201cshine a light\u201d on Roberson\u2019s case \u201cfor all 31 million Texans to hear and watch and to see.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bskz5i000t3b6m9lpcy9pc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cAnd we\u2019re hopeful that by Thursday evening, we\u2019re able to secure that pause button in this case,\u201d said Leach, who supports the death penalty but has emerged as a key critic of its administration in cases featuring <a href=\"https:\/\/www.cnn.com\/2022\/04\/08\/us\/melissa-lucio-clemency-support\/index.html\">wrongful conviction claims<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bw6tek000c3b6mggxwcxxa@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The committee \u2013 made up of both Republicans and Democrats \u2013 has also urged the Texas Court of Criminal Appeals to halt the execution, citing the \u201cjunk science\u201d law. Committee members want Roberson to be granted a stay while lawmakers consider amendments to the \u201cjunk science\u201d law, they wrote in a letter brief filed before the court.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bwdl04000n3b6mqi6q1v23@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt is beyond dispute that medical evidence presented at Mr. Roberson\u2019s trial in 2003 is inconsistent with modern scientific principles,\u201d the lawmakers wrote.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bwtyzw000x3b6mzs6c5ztb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe believe it would be a stain on the conscience of the State of Texas for an execution to proceed while efforts are underway to remedy deficiencies in how the law was applied to this case.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2btxp7z00273b6mximv89xj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A bipartisan group of more than 80 Texas legislators has supported Roberson\u2019s case, and his request for clemency. Rep. Joe Moody, chair of the criminal jurisprudence committee, <a href=\"https:\/\/x.com\/moodyforelpaso\/status\/1844813899272515892\" target=\"_blank\" rel=\"noopener\">said on X<\/a> last week the state needed to \u201cpump the brakes before this stains Texas justice for generations.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bsvq5500173b6mh1joh2ge@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The author John Grisham \u2013 a board member of the Innocence Project, which has backed Roberson\u2019s claim \u2013 also called for mercy Tuesday in an <a href=\"https:\/\/www.washingtonpost.com\/opinions\/2024\/10\/15\/john-grisham-texas-death-penalty-robert-roberson\/\" target=\"_blank\" rel=\"noopener\">op-ed for the Washington Post<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bsxbda001f3b6m9zmgqimv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe evidence is assembled and available to the Texas authorities, but no one with the power to stop Roberson\u2019s execution is paying attention,\u201d Grisham wrote. \u201cThe courts\u00a0<a href=\"https:\/\/www.texastribune.org\/2024\/10\/11\/robert-roberson-texas-execution-appeal\/\" target=\"_blank\" rel=\"noopener\">slammed all the doors<\/a>\u00a0on the basis of technicalities, and even politicians\u2019 pleas have been ignored.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2byvcgn00143b6mlpgbg2jh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson\u2019s attorneys are not disputing babies can and do die from being shaken. But they contend more benign explanations, including illness, can mimic the symptoms of shaking, and those alternative explanations should be ruled out before a medical expert testifies with certainty that the cause of death was abuse.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bz1x35001c3b6moa3iei7o@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Shaken baby syndrome is accepted as a <a href=\"https:\/\/publications.aap.org\/aapnews\/news\/8666\/Despite-Media-Reports-Most-Doctors-Don-t-Dispute\" target=\"_blank\" rel=\"noopener\">valid diagnosis<\/a> by the <a href=\"https:\/\/publications.aap.org\/pediatrics\/article\/145\/4\/e20200203\/36936\/Abusive-Head-Trauma-in-Infants-and-Children\" target=\"_blank\" rel=\"noopener\">American Academy of Pediatrics<\/a> and supported by child abuse pediatricians who spoke with CNN. The condition, first described in the mid-1970s, has for the past 15 or so years been considered a type of \u201cabusive head trauma\u201d \u2013 a broader term used to reflect actions other than shaking, like an impact to a child\u2019s head.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bz5f3h001j3b6m5jrhblsv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Criminal defense lawyers also have oversimplified how doctors diagnose abusive head trauma, child abuse pediatricians say, noting many factors are considered to determine it.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bzt4gn001x3b6mkdupl2ce@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe conclusion is simply (Nikki) was a victim of abusive head trauma. Unequivocally,\u201d Dr. Sandeep Narang, a child abuse pediatrician and a lawyer, told CNN after he said he was asked by a supporter of Roberson\u2019s defense to review trial testimony in the case.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bz2z7x001h3b6mg1hfronj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Still, the diagnosis has been the focus of debates in courtrooms across the country. Since 1992, courts in at least 17 states and the US Army have exonerated 32 people convicted in shaken baby syndrome cases, according to\u00a0<a href=\"https:\/\/www.law.umich.edu\/special\/exoneration\/Pages\/detaillist.aspx\" target=\"_blank\" rel=\"noopener\">the National Registry of Exonerations<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bz94vi001p3b6mgvjslkc1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Child abuse pediatricians like Dr. Antoinette Laskey, chair of the American Academy of Pediatrics\u2019 Council on Child Abuse and Neglect, dispute these statistics. She pointed to <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/34743053\/\" target=\"_blank\" rel=\"noopener\">a 2021 paper<\/a> that found just 3% of all convictions in shaken baby syndrome cases between 2008 and 2018 were overturned, and only 1% of them were overturned because of medical evidence.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bzqz67001u3b6m268oa9wt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI don\u2019t know what to say about the legal controversy,\u201d Laskey told CNN of the courtroom debate (She did not speak to Roberson\u2019s case). \u201cThis is real, it affects children, it affects families \u2026 I want to help children; I don\u2019t want to diagnose abuse: That\u2019s a bad day.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2bz7071001m3b6mou0fe3jb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Last week, however, the Texas Court of Criminal Appeals ordered a new trial for a man sentenced to 35 years in prison for his conviction of injury to a child in a case that also relied on a shaken baby syndrome argument.
