A close U.S. Senate race and <a href=\"https:\/\/www.npr.org\/2024\/05\/23\/nx-s1-4977323\/abortion-law-legal-florida-arizona-amendment\">abortion measures<\/a> are also on the state ballot.<\/p>\n<aside id=\"ad-backstage-wrap\" class=\"ad-wrap backstage\" aria-label=\"advertisement\">\n<\/aside>\n<p><!-- END ID=\"RESNX-S1-5155077-100\" CLASS=\"BUCKETWRAP INTERNALLINK INSETTWOCOLUMN INSET2COL \" --><\/p>\n<p>For two decades, formerly incarcerated Nebraskans had to wait two years after completing every part of their felony sentence \u2014 including probation and parole \u2014 before their voting rights were restored. Earlier this year, though, a bipartisan group of state lawmakers <a href=\"https:\/\/nebraskalegislature.gov\/bills\/view_bill.php?DocumentID=50027\">passed<\/a> Legislative Bill 20, or LB 20, which eliminated that waiting period.<\/p>\n<p>But in July, before LB 20 went into effect, Nebraska Secretary of State Robert Evnen directed election officials to stop registering former felons. His order followed <a href=\"https:\/\/ago.nebraska.gov\/sites\/default\/files\/docs\/opinions\/AG%20Opinion%2024-004.pdf\">an opinion<\/a> from the state\u2019s attorney general, Mike Hilgers, that said LB 20 was unconstitutional because only the state\u2019s Board of Pardons \u2014 not the legislature \u2014 could restore a felon\u2019s voting rights. The board is currently <a href=\"https:\/\/pardons.nebraska.gov\/board\">made up of<\/a> Evnen, Hilgers and Gov. Jim Pillen \u2014 all Republicans.<\/p>\n<p>In <a href=\"https:\/\/supremecourt.nebraska.gov\/courts\/supreme-court\/opinions\">their ruling<\/a>, though, a majority of the state Supreme Court\u2019s panel of judges found Evnen \u201cwas unable to establish his defense that the statutes were unconstitutional.\u201d So, the court ordered Evnen to \u201cremove any disqualification on registration he has imposed that is not contained within L.B. 20\u201d and to comply with the new state law ahead of the election.<\/p>\n<p>In a statement, Evnen said, \u201cThe Supreme Court has resolved this issue and we are following the requirements of the decision. In recent years, some states have sought to <a href=\"https:\/\/www.npr.org\/2023\/08\/27\/1195632138\/minnesota-felon-voting-rights-restoration\">expand voting rights<\/a> to felons, while some, mostly Republican-led states have tried to <a href=\"https:\/\/www.npr.org\/2023\/08\/04\/1192295228\/mississippi-felon-voting-law-blocked\">tighten<\/a> restrictions.<\/p>\n<p>One of the plaintiffs in Nebraska&#8217;s case, Gregory Spung, said in <a href=\"https:\/\/www.aclunebraska.org\/en\/press-releases\/nebraska-supreme-court-orders-elections-officials-let-thousands-nebraskans-felony\">a statement<\/a> issued by the ACLU of Nebraska that he is \u201cecstatic\u201d the court upheld the state\u2019s law.<\/p>\n<p>\u201cFor so long, I was uncertain if my voice would truly count under this law,\u201d he said. \u201cToday\u2019s decision reaffirms the fundamental principle that every vote matters.
