{"id":115234,"date":"2024-10-17T16:02:51","date_gmt":"2024-10-17T09:02:51","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=115234"},"modified":"2024-10-17T16:02:51","modified_gmt":"2024-10-17T09:02:51","slug":"los-angeles-county-da-to-decide-on-menendez-brothers-resentencing-within-10-days","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=115234","title":{"rendered":"Los Angeles County DA to decide on Menendez brothers&#8217; resentencing within 10 days"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p class=\"\">LOS ANGELES \u2014\u00a0Los Angeles County District Attorney George Gasc\u00f3n told NBC News on Wednesday he hopes to make a decision within 10 days about <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/menendez-brothers-resentencing-da-rcna173952\" target=\"_blank\" rel=\"noopener\">whether to recommend resentencing <\/a>for the Menendez brothers \u2014 and that, if he does, it\u2019s possible they could be out of prison by the end of the year.\u00a0<\/p>\n<p class=\"\">\u201cIt will be up to the court to decide which way they want to go, but it\u2019s possible they could be,\u201d Gasc\u00f3n said in an interview at the Los Angeles Hall of Justice shortly after a <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/menendez-brothers-relatives-rally-l-courthouse-da-weighs-resentencing-rcna175504\" target=\"_blank\" rel=\"noopener\">news conference by Menendez family members<\/a>, who are calling for the brothers&#8217; release.<\/p>\n<p class=\"\">\u201cIf in fact they have rehabilitated as we are being told, which is what we\u2019re reviewing, then I don\u2019t believe they should spend the rest of their life in prison,\u201d he added.\u00a0<\/p>\n<p class=\"\">Erik and Lyle Menendez are serving life sentences without parole for the 1989 shotgun slayings of their parents, Jos\u00e9 and Mary Louise \u201cKitty\u201d Menendez, at their Beverly Hills home.\u00a0<\/p>\n<p class=\"\">More than a dozen relatives of the brothers argue that not only have they served their time behind bars but that the original case did not properly weigh their allegations that their father sexually and physically abused them.\u00a0<\/p>\n<p class=\"\">\u201cIf Lyle and Erik\u2019s case were heard today, with the understanding we now have about abuse and PTSD, there is no doubt in my mind that their sentencing would have been very different,\u201d Anamaria Baralt, Jos\u00e9 Menendez\u2019s niece, told reporters Wednesday.<\/p>\n<p class=\"\">Gasc\u00f3n said that while he is still reviewing evidence, based on what he has seen so far, he agrees with those family members and also believes the brothers\u2019 claims that they were molested.<\/p>\n<p class=\"\">\u201cI think that there is a certain level of evidence that points out that there were a lot of problems in the household,\u201d he said.\u00a0<\/p>\n<figure class=\"styles_inlineImage__yAWZ0 styles_medium__OMa6x\"><picture class=\"styles_image__1qciH\" data-testid=\"picture\"><source media=\"(min-width: 1000px)\" srcset=\"https:\/\/media-cldnry.s-nbcnews.com\/image\/upload\/t_fit-560w,f_avif,q_auto:eco,dpr_2\/rockcms\/2024-10\/241002-menendez-ch-1920-f99958.jpg 2x, https:\/\/media-cldnry.s-nbcnews.com\/image\/upload\/t_fit-560w,f_auto,q_auto:best\/rockcms\/2024-10\/241002-menendez-ch-1920-f99958.jpg 1x\"\/><source media=\"(min-width: 320px)\" srcset=\"https:\/\/media-cldnry.s-nbcnews.com\/image\/upload\/t_fit-760w,f_avif,q_auto:eco,dpr_2\/rockcms\/2024-10\/241002-menendez-ch-1920-f99958.jpg 2x, https:\/\/media-cldnry.s-nbcnews.com\/image\/upload\/t_fit-760w,f_auto,q_auto:best\/rockcms\/2024-10\/241002-menendez-ch-1920-f99958.jpg 1x\"\/><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/media-cldnry.s-nbcnews.com\/image\/upload\/t_fit-760w,f_auto,q_auto:best\/rockcms\/2024-10\/241002-menendez-ch-1920-f99958.jpg\" alt=\"Menendez brothers.\" height=\"1666\" width=\"2500\"\/><\/picture><figcaption class=\"caption styles_caption__Pe5JC\" data-testid=\"caption\"><span class=\"caption__container\" data-testid=\"caption__container\">Brothers Erik and Lyle Menendez.<\/span><span class=\"caption__source\" data-testid=\"caption__source\">Ted Soqui \/ Sygma via Getty Images file<\/span><\/figcaption><\/figure>\n<p class=\"\">The brothers were first tried together in 1993, but the jury deadlocked. Prosecutors retried them in 1995, when a judge deemed most of the sexual abuse claims inadmissible, with prosecutors convincing jurors that they killed their parents to inherit money and went on a spending spree after the murders.\u00a0<\/p>\n<p class=\"\">But last year, the brothers presented what they said was new evidence backing their allegations of sexual abuse, including a letter that one of the brothers is alleged to have sent to a cousin months before the murders about his father. In it, he wrote, \u201cI\u2019ve been trying to avoid dad &#8230; every night, I stay up thinking he might come in.\u201d\u00a0<\/p>\n<p class=\"\">Roy Rossello, a former member of the band Menudo, also spoke out in the Peacock documentary series \u201cMenendez + Menudo: Boys Betrayed,\u201d alleging he was also raped by Jos\u00e9 Menendez.\u00a0Peacock is owned by NBCUniversal, the parent company of NBC News.<\/p>\n<p class=\"\">Not all the family believes the brothers.\u00a0<\/p>\n<p class=\"\">Kathy Cady, who is representing Milton Andersen, Kitty Menendez&#8217;s, said in an interview that her client does not believe his nephews were molested and that they were motivated by greed.\u00a0<\/p>\n<p class=\"\">\u201cEven should those allegations have been true, it doesn\u2019t excuse what they did to their parents, and it doesn\u2019t excuse the murders that they committed,\u201d Cady said. \u201cAnd again, the timing that they only committed the murders when they learned that they were going to be taken out of the will would seem to suggest otherwise.\u201d<\/p>\n<p class=\"\">Gasc\u00f3n, who polls show is trailing in his bid to be re-elected, recently began speaking publicly about his office\u2019s role in the case as it reviews the new evidence.\u00a0<\/p>\n<p class=\"\">The case has been getting renewed attention after the release of the <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/ryan-murphy-defends-menendez-brothers-netflix-series-erik-menendez-bla-rcna172472\" target=\"_blank\" rel=\"noopener\">popular Netflix series<\/a> \u201cMonsters: The Lyle and Erik Menendez Story,\u201d which dramatizes their story.<\/p>\n<p class=\"\">Laurie Levenson, a Loyola Law School professor who specializes in criminal cases, said that despite <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/kim-kardashian-menendez-brothers-rcna173750\" target=\"_blank\" rel=\"noopener\">considerable public interest<\/a> in the case, their release is by no means assured.\u00a0<\/p>\n<p class=\"\">\u201cThe court of public opinion can provide some moral support for the defendants, but it\u2019s in the judicial court where the decision will be made,\u201d Levenson said. \u201cNobody should confuse this with significant legal issues that have to be resolved when this goes to court.\u201d<\/p>\n<p class=\"\">Gasc\u00f3n acknowledged prosecutors in the DA\u2019s office differ about whether the brothers should be resentenced and ultimately released.\u00a0<\/p>\n<p class=\"\">He said that over the next 10 days he plans to talk to the prosecutors handling the case and review prison files on the brothers to corroborate the family\u2019s claims that they have been rehabilitated.\u00a0<\/p>\n<p class=\"\">\u201cI\u2019m looking to make sure that there was no misbehavior while they were in prison.
