Walker of the Northern District of Florida granted a temporary restraining order against Florida\u2019s surgeon general\u00a0after the state\u00a0health department\u00a0threatened to bring criminal charges against broadcasters\u00a0airing the ad.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e1zu9200053d5vzu6bhpwn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The controversy stems from a campaign ad by the group Floridians Protecting Freedom, which is behind the \u201cYes on 4 Campaign,\u201d promoting a ballot measure that seeks to overturn Florida\u2019s six-week abortion ban by enshrining abortion rights in the state\u00a0constitution.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e1zu9200063d5vpgdek8yb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In the\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=7jJiEE_AkPA\" target=\"_blank\" rel=\"noopener\">30-second ad<\/a>, a brain cancer survivor named Caroline\u00a0says\u00a0the state law\u00a0would have\u00a0prevented her from receiving a life-saving abortion.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e1zu9200073d5v6v0w9xcq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe doctors knew that if I did not end my pregnancy, I would lose my baby, I would lose my life, and my daughter would lose her mom,\u201d she says\u00a0on camera. \u201cFlorida has now banned abortions, even in cases like mine.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e1zu9200083d5v1hzy7xto@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The\u00a0state\u00a0health department \u2013 part of Gov. Ron DeSantis\u2019s administration, which has aggressively campaigned against the pro-abortion amendment \u2013 said the ad\u2019s claims are \u201cfalse\u201d and \u201cdangerous\u201d to the public health.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e1zu9200093d5vitwow121@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            John Wilson, the health department\u2019s general counsel,\u00a0<a href=\"https:\/\/www.cnn.com\/2024\/10\/08\/media\/florida-tv-abortion-rights-ad-fcc-desantis\/index.html\">sent cease-and-desist letters<\/a>\u00a0to multiple\u00a0television\u00a0stations airing the ad. Floridians Protecting Freedom then filed a lawsuit against Wilson and the state\u2019s surgeon general, Joseph Ladapo, saying the threats\u00a0amounted to \u201cunconstitutional coercion and viewpoint discrimination\u201d and pressed the court to bar the\u00a0state\u00a0from following up on threats to sue.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e1zu92000a3d5vle75ikqd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On Thursday,\u00a0the judge\u00a0agreed the health department\u2019s threats were \u201cviewpoint discrimination\u201d and wrote that the group presented \u201ca substantial likelihood of proving an ongoing violation of its First Amendment rights through the threatened direct penalization of its political speech.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e1zu92000b3d5vsszph0m0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The judge\u2019s order, which is valid through October 29, effectively bars Ladapo from intimidating local stations for airing the Amendment 4 ad.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e1zu92000c3d5vl5xvxcqq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Walker\u2019s granting of the restraining order comes less than a week after Wilson resigned from his post. In\u00a0<a href=\"https:\/\/www.miamiherald.com\/news\/politics-government\/state-politics\/article294111439.html\" target=\"_blank\" rel=\"noopener\">a letter obtained<\/a>\u00a0by the\u00a0Tampa Bay Times and Miami\u00a0Herald, Wilson wrote that \u201ca man is nothing without his conscience,\u201d adding that \u201cit has become clear in recent days that I cannot join you on the road that lies before the agency.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e1zu92000d3d5vgimxngrl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Wilson\u00a0did not mention the ad controversy.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e1zu92000e3d5vgyuo0kek@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The state\u2019s health department continues to assert that the\u00a0abortion rights\u00a0ad \u201cunequivocally false and detrimental to public health in Florida.\u201d Jae Williams, the department\u2019s communications director, told CNN on Thursday that \u201cthe media continues to ignore the truth that Florida\u2019s heartbeat protection law always protects the life of a mother and includes exceptions for victims of rape, incest, and human trafficking.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e1zu92000f3d5v2o84zwpb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Some medical experts have said otherwise. \u201cFlorida\u2019s extreme abortion ban has created an unworkable legal landscape that endangers both patients and clinicians,\u201d the nonprofit group Physicians for Human Rights stated in a report last month. The ban \u201cleads to preventable suffering\u201d and \u201ccompels clinicians to deviate from established standards of care and medical ethics,\u201d the group said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e1zu92000g3d5vqxe9rdrb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The health department\u2019s threats were so chilling that WINK, a CBS affiliate, pulled the ad from its broadcasts,\u00a0<a href=\"https:\/\/floridapolitics.com\/archives\/701815-a-tv-station-stopped-playing-pro-abortion-rights-ads-after-states-threats-lawsuit-says\/\" target=\"_blank\" rel=\"noopener\">Florida Politics reported<\/a>.
