Though the court order allowed his death warrant to expire at midnight Thursday, a legal battle is still underway and a new execution date could be set\u00a0after his potential testimony before the lawmakers next week, or sooner if ordered by the court.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e6l2uk000b3b6jirs9gvaf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The delay in Roberson\u2019s execution was set in motion Wednesday when a group of lawmakers with the Texas Committee on Criminal Jurisprudence voted to subpoena Roberson as they reconsider the lawfulness of his conviction.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e6sv6h000f3b6jiqg8bwo5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson\u2019s attorney, Gretchen Sween, said her client \u201chopes that his experience can help improve the integrity of our criminal legal system.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e6dnws00093b6j4tpn92eu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe vast team fighting for Robert Roberson \u2013 people all across Texas, the country, and the world \u2013 are elated tonight that a contingent of brave, bipartisan Texas lawmakers chose to dig deep into the facts of Robert\u2019s case that no court had yet considered and recognized that his life was worth fighting for,\u201d Sween said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e4vmp100033b6ma37clx65@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson\u2019s conviction relied on allegations that his daughter, Nikki Curtis, died of shaken baby syndrome, a diagnosis his attorneys argue has since been discredited.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2dvof9800093b6m0naagagy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Though his attorneys have long fought against his execution, Roberson\u2019s fate Thursday was ultimately battled out in a series of last-ditch efforts.<strong> <\/strong>\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e6vzhq000k3b6jbj5m081f@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In a matter of days,\u00a0multiple appeals were rejected in state courts,\u00a0the Texas pardons board rejected his bid for clemency\u00a0and the US Supreme Court declined to intervene.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2dvm2fg00043b6msqirskxo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            That left the House committee\u2019s unusual subpoena and the request for a temporary restraining order that was granted earlier Thursday.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e9mdsc00003b6jq82r7syt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But a state appeals court later sided with the state and vacated the restraining order Thursday night, with four dissenting judges calling the circumstances of the case \u201cunprecedented\u201d and asking for more study of the legal claims at issue.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e2wuqt00093b6mkrq2mevr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Following the appeals court\u2019s decision, the committee fighting for Roberson asked the Texas Supreme Court to issue an injunction against the Texas Department of Criminal Justice and Texas Department of Criminal Justice Correctional Institutions Division.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e6t57o000i3b6jpmum5slx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In its decision Thursday night, the Texas Supreme Court issued a temporary stay halting the execution, but the\u00a0petition for an injunction\u00a0is still pending.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ebh01j000b3b6j1uj4m0aa@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Supreme Court said the state can\u2019t stop Roberson from complying with the subpoena issued by the Texas lawmakers on Wednesday, \u201cincluding by executing Mr. Roberson, until further order of this Court.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2eby23e000h3b6joh9nfuqk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            And in an opinion concurring in the grant of the stay, Texas Supreme Court Justice Evan Young said the district court did not abuse its discretion in granting a restraining order.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ebxzwy000e3b6j9bhode88@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            State lawmakers celebrated the court\u2019s decision Thursday.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2eb9d2200023b6jief6ah7a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cFor over 20 years, Robert Roberson has spent 23.5 hours of every single day in solitary confinement in a cell no bigger than the closets of most Texans, longing and striving to be heard. And while some courthouses may have failed him, the Texas House has not,\u201d state Reps. Joe Moody and Jeff Leach said in a joint statement.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ebfsct00053b6jdwq4mpcw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe look forward to welcoming Robert to the Texas Capitol, and along with 31 million Texans, finally giving him \u2013 and the truth \u2013 a chance to be heard,\u201d the lawmakers added.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ebgg7600083b6jprfcs7t0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            CNN has reached out to the offices of Texas Gov.\u00a0Greg Abbott and Texas Attorney General Ken Paxton for comment on the court\u2019s decision.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ds0x6a00023b6mt53hhqze@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson had arrived at the Huntsville Unit where the execution was to take place on Thursday afternoon, the criminal justice department confirmed to CNN.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c0heia00033b6magjvfico@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson would have become the first person in the US executed for a conviction that relied on an allegation of <a href=\"https:\/\/www.cnn.com\/interactive\/2021\/12\/health\/shaken-baby-syndrome-legal-battle\/\">shaken baby syndrome<\/a>, a misdiagnosis in Roberson\u2019s case, his attorneys argue, and one they say has been discredited.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c0heia00043b6myvd0msel@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            While child abuse pediatricians fiercely <a href=\"https:\/\/www.jpeds.com\/article\/S0022-3476(16)30402-4\/fulltext\" target=\"_blank\" rel=\"noopener\">defend the legitimacy<\/a> of the diagnosis, Roberson\u2019s advocates say the courts have yet to consider ample evidence his daughter died not of a homicide, but a variety of causes, including an illness and medicine now seen as unfit for such a sickly child.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c72vh0000a3b6mgnfxovro@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson\u2019s attorneys have argued<strong> <\/strong>his due process rights were violated when the Texas Court of Criminal Appeals declined to consider additional evidence the inmate says would support his innocence claim.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c0j3sz000e3b6mvidseupo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson\u2019s innocence claim underscores an inherent risk of capital punishment: A potentially innocent person could be put to<em>\u00a0<\/em>death. At least 200 people \u2013 including 18 in Texas \u2013 have been exonerated since 1973 after being convicted and sentenced to die, according to the\u00a0<a href=\"https:\/\/deathpenaltyinfo.org\/policy-issues\/innocence\" target=\"_blank\" rel=\"noopener\">Death Penalty Information Center<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c7oxa6000y3b6mnmj69fqi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At the time of her death, Nikki had double pneumonia that had progressed to sepsis, they say, and she had been prescribed two medications now seen as inappropriate for children that would have further hindered her ability to breathe. Additionally, the night before Roberson brought her to a Palestine, Texas, emergency room, she had fallen off a bed \u2013 and was particularly vulnerable given her illness, Roberson\u2019s attorneys say, pointing to all these factors as explanations for her condition.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c0heia00063b6m7tf3p32y@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Other factors, too, contributed to his conviction, they argue: Doctors treating Nikki \u201cpresumed\u201d abuse based on her symptoms and common thinking at the time of her death without exploring her recent medical history, the inmate\u2019s attorneys claim. And his behavior in the emergency room \u2013 viewed as uncaring by doctors, nurses and the police, who believed it a sign of his guilt \u2013 was actually a manifestation of autism spectrum disorder, which went undiagnosed until 2018.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c0heia00073b6mi8p69dij@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI told my wife last week that I\u2019m ashamed. I\u2019m ashamed that I was so focused on finding an offender and convicting someone that I did not see Robert. I did not hear his voice,\u201d Brian Wharton, the former detective who oversaw the investigation into Nikki\u2019s death, told state lawmakers Wednesday at a hearing featuring the case.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c2anbw00003b6mw4ti203t@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cHe\u2019s an innocent man, and we are very close to killing him for something he did not do,\u201d  Wharton previously said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2edqyb700003b6jkyovhrr0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On Thursday night, Wharton said he was relieved when he heard of the court\u2019s decision.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2edr4mx00043b6jkfyopr0i@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cHis wife started crying, and everybody else just kind of took a deeper breath. Because we all know he\u2019s innocent. We\u2019ve been fighting this fight for a while, and trying to get a fair hearing,\u201d Wharton told CNN.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c7v3el00143b6mfegizv7e@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Wharton is one of many supporters of Roberson: More than 30 scientists and medical experts who agree with the doctors cited by the inmate\u2019s attorneys, a bipartisan group of more than 80 Texas legislators, autism advocacy groups and author John Grisham have all called for mercy, a fervent movement that mounted strong opposition to the execution in recent days.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c0heia00083b6mwy9awdno@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Support in the legislature includes members of the Texas Committee on Criminal Jurisprudence, which on Wednesday held a hearing highlighting Roberson\u2019s case, calling Wharton, Sween and others who gave voice to the doubts surrounding the shaken baby syndrome diagnosis.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c730os000d3b6mxf5h9iy2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The hearing was ostensibly about Texas Article 11.073, a state law commonly referred to as the \u201cjunk science writ,\u201d which was meant to give defendants a way to challenge their convictions when there was new scientific evidence unavailable at the time of their trial.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2cpypky00053b6jn2dyim4p@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The committee voted Wednesday to subpoena Roberson, calling on him in the motion to \u201cprovide all relevant testimony and information concerning the committee\u2019s inquiry.\u201d Though the committee is not totally confident that Roberson\u2019s execution will be delayed, they are hopeful, a source with knowledge of the proceedings told CNN.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c7573e000i3b6mwpbflmeq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Last week, the appeals court ordered a new trial for a man sentenced to 35 years in prison for his conviction of injury to a child in a case that also relied on a shaken baby syndrome argument.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c7573e000j3b6moai7tige@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson\u2019s supporters believe he, too, should benefit from this law, which\u00a0\u201cwas meant exactly for cases like this one,\u201d the committee said in a letter brief to the Texas Court of Criminal Appeals.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c7hfgc000q3b6mndzm63nh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The committee asked for a stay of execution in Roberson\u2019s case while the legislature considered making changes to it in the coming legislative session. But the appeals court denied Roberson\u2019s appeal on Wednesday, rejecting it on procedural grounds \u201cwithout reviewing the merits of the claims raised.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c7501v000g3b6m5kikjx6p@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            GOP Rep. Leach, a member of the committee, expressed hope the governor and parole board were listening to the hearing, \u201cbecause the law that the legislature passed and our governor signed into law is being ignored by our courts, and all we\u2019re seeking to do here is to push the pause button to make sure that it\u2019s enforced.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c410ku00163b6my8q71kok@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson\u2019s attorneys are not disputing babies can and do die from being shaken. But they contend more benign explanations, including illness, can mimic the symptoms of shaking, and those alternative explanations should be ruled out before a medical expert testifies with certainty the cause of death was abuse.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c4scul001f3b6my718b2wq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Shaken baby syndrome is accepted as a\u00a0<a href=\"https:\/\/publications.aap.org\/aapnews\/news\/8666\/Despite-Media-Reports-Most-Doctors-Don-t-Dispute\" target=\"_blank\" rel=\"noopener\">valid diagnosis<\/a>\u00a0by the\u00a0<a href=\"https:\/\/publications.aap.org\/pediatrics\/article\/145\/4\/e20200203\/36936\/Abusive-Head-Trauma-in-Infants-and-Children\" target=\"_blank\" rel=\"noopener\">American Academy of Pediatrics<\/a>\u00a0and supported by child abuse pediatricians who spoke with CNN. The condition, first described in the mid-1970s, has for the past 15 or so years been considered a type of \u201cabusive head trauma\u201d \u2013 a broader term used to reflect actions other than shaking, like an impact to a child\u2019s head.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c4scul001g3b6mr7iwn32t@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Criminal defense lawyers also have oversimplified how doctors diagnose abusive head trauma, child abuse pediatricians say, noting many factors are considered to determine it.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c4rzb3001b3b6mk1g2tkn3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Still, the diagnosis has been the focus of debates in courtrooms across the country. Since 1992, courts in at least 17 states and the US Army have exonerated 32 people convicted in shaken baby syndrome cases, according to\u00a0<a href=\"https:\/\/www.law.umich.edu\/special\/exoneration\/Pages\/detaillist.aspx\" target=\"_blank\" rel=\"noopener\">the National Registry of Exonerations<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c4sjal001j3b6m7qmkh4rj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Child abuse pediatricians such as Dr. Antoinette Laskey, chair of the American Academy of Pediatrics\u2019 Council on Child Abuse and Neglect, dispute these statistics. She pointed to\u00a0<a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/34743053\/\" target=\"_blank\" rel=\"noopener\">a 2021 paper<\/a>\u00a0that found just 3% of all convictions in shaken baby syndrome cases between 2008 and 2018 were overturned, and only 1% of them were overturned because of medical evidence. The thoroughness of that study, however,\u00a0<a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S0145213422000977\" target=\"_blank\" rel=\"noopener\">has been called into question<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2c4sqiy001o3b6m3zcfi74f@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI don\u2019t know what to say about the legal controversy,\u201d Laskey told CNN of the courtroom debate (She did not speak to Roberson\u2019s case). \u201cThis is real, it affects children, it affects families \u2026 I want to help children; I don\u2019t want to diagnose abuse: That\u2019s a bad day.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2e2us3o00023b6m3wi5yfya@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            <em>CNN\u2019s Ashley R.
