Instead, the already grief-stricken Rocha found himself in the midst of a feud between the police department and the Longo Toyota of Proper dealership.<\/p>\n<h2>Don&#8217;t miss<\/h2>\n<p>Moments after taking a truck out for a test drive, Rocha was pulled over by an officer and given a citation for &#8220;operating a vehicle without license plates.&#8221;<\/p>\n<p>&#8220;He said this has been ongoing with these dealers,&#8221; Rocha <a href=\"https:\/\/www.wfaa.com\/article\/news\/local\/texas-driver-receives-citation-for-license-plates-during-test-drive-at-dealership\/287-e65e2d5d-f9b8-45c6-9e76-aed1580e4a93\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:told;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">told<\/a> WFAA-TV.<\/p>\n<p>Rocha added that the officer then told him: &#8220;&#8216;In order for us to make [the dealerships] abide, we&#8217;re going to start citing the customers.\u2019\u201d He was then handed a $250 ticket.<\/p>\n<p>But is it fair for innocent customers to get caught in the crosshairs of an ongoing issue between police and dealerships?<\/p>\n<h2>Dealership mistakes are costing customers<\/h2>\n<p>The Prosper Police Department confirmed Rocha\u2019s account, telling WFAA-TV that it\u2019s the dealership\u2019s responsibility to ensure their vehicles have proper tags.<\/p>\n<p>&#8220;Failure to properly display dealer tags on test-driven vehicles is a violation of Texas law and can pose safety risks, potentially resulting in enforcement action by law enforcement,\u201d read a statement to the news outlet. \u201cUnder state law, vehicle operators are held responsible for any citations if this law is ignored.&#8221;<\/p>\n<p>A general manager at the dealership also confirmed the incident with WFAA-TV; however, they claim this is the first time police had issued a citation to one of their customers.<\/p>\n<p>Typically, dealers are supposed to issue a demo plate for test drives. In the state of Texas, they\u2019re referred to as an <a href=\"https:\/\/texasdealereducation.com\/temporary-tags-and-metal-plates\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:authorized agent tag;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">authorized agent tag<\/a> and they\u2019re meant solely for \u201ctest drives, loaners, road tests and transportation to and from the auction, another dealer, or service.\u201d<\/p>\n<p>The police tactic of issuing citations to the customers is presumably meant to scare people out of buying cars from dealerships that don\u2019t have plates properly in place for test drives. However the laws differ for dealerships and customer test-drives.<\/p>\n<p>Dealerships are <a href=\"https:\/\/www.txdmv.gov\/dealers\/dealer-license-plates\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:required;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">required<\/a> to apply, and use, metal dealer tags on vehicles being test driven.<\/p>\n<p>According to Texas Transportation law <a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/TN\/htm\/TN.503.htm\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Sec. 503.063;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Sec. 503.063<\/a>, the dealer is the one responsible for ensuring the license plate is properly displayed and is \u201cliable for missing or misused license plates.&#8221;<\/p>\n<p>This law may seem at odds with the Prosper police department&#8217;s stance that the <em>customers<\/em> can also be held responsible for the dealership tags.<\/p>\n<p>However, Texas Transportation Code \u00a7 504.943 Operation Of Vehicle Without License Plate <a href=\"https:\/\/law.onecle.com\/texas\/transportation\/504.943.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:states;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">states<\/a> that \u201ca person commits an offense if the person operates on a public highway, during a registration period, a motor vehicle that does not display two license plates.\u201d<\/p>\n<p>In this case, the Longo Toyota of Prosper dealership was not operating a vehicle according to the law, since it lacked dealer plates. However, the transportation code offers a loophole that could see a customer out on a test drive found responsible.<\/p>\n<p>This can leave any consumer vulnerable to similar citations if they go for a test drive in a vehicle without plates.<\/p>\n<p>If you find yourself in a similar situation, ensure that there is a valid rear license plate \u2014 or an authorized agent tag \u2014 before taking a dealership car out for a test spin.
