It was an unprecedented gambit played 24 hours before he was to be put to death for the 2002 \u201cshaken baby\u201d killing of his 2-year-old daughter Nikki Curtis \u2013 a crime he and his advocates say did not occur. By Thursday evening, after a series of court battles and escalating appeals, the Texas Supreme Court had issued a temporary stay of execution.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh90000p3b6mqp3q1246@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            For Roberson, it was a godsend, coming just as the other doors to save his life slammed shut: His team had lost several appeals in the Texas courts, the state Board of Pardons and Paroles had declined to recommend clemency and the US Supreme Court had also declined to intervene.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2iro3ie00043b6mzb68zefv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson is scheduled to speak Monday to lawmakers considering the lawfulness of his case \u2013 and whether it necessitates changes to a \u201cjunk science\u201d law those in his corner feel should benefit Roberson.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ipuo4b00003b6msdxkopza@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But as of Sunday evening, it was unclear whether Roberson would appear at the hearing, his attorney, Gretchen Sween, told CNN, as the Texas Attorney General\u2019s Office and the Texas Department of Criminal Justice have so far failed to reach an agreement with the committee on the logistics of Roberson\u2019s testimony.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2iqcki900033b6m4rnm9xo3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The committee\u2019s subpoena requires Roberson to testify in person, according to Sween, and lawmakers have said they fully expect the inmate to appear at the Capitol.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2iqkbil00063b6m8ybhfsn7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Sween wants Roberson to testify in person so the lawmakers and public can fully understand how his autism affects his interactions with other people, which his advocates say was one of the contributing factors in his conviction.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2it8g8r00013b6myb2iqiod@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But Texas prison officials will allow Roberson to testify only virtually, the attorney general\u2019s office said in a letter to committee chairman Joe Moody Friday night, citing criminal justice department policies, the interest of public safety and Roberson\u2019s well-being.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2iqmtd800093b6ml3ua7y2h@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cOur hands are tied. The AG is representing TDCJ, and is calling the shots, while simultaneously attacking the underlying subpoena before the Texas Supreme Court. We expected that the subpoena would be honored pursuant to Texas law and the Committee\u2019s intent. But there was a sleight of hand here,\u201d Sween said in a statement to CNN.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2iqqm9x000e3b6muqvtw5ap@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Texas prison officials would not directly address whether Roberson would travel to Austin for the hearing or testify virtually, saying they are working with the attorney general\u2019s office.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2iqqkpf000c3b6m53e4x6pb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The attorney general\u2019s office has not responded to multiple requests for comment since the subpoena for Roberson was issued.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2it0otn00003b6mpib8x4fk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The hearing remains on the public schedule and is expected to include other witnesses.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh90000q3b6mree0dxew@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Texas law requires a judge to set a new execution date at least 90 days in the future, and Sween previously told CNN the earliest a new execution could be set would be next year.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh90000r3b6mh7ofr0je@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            How that will play out remains to be seen.  Here\u2019s what we know:\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh90000u3b6m2rlgiyel@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson was convicted of capital murder in a case that relied on allegations his daughter died of <a href=\"https:\/\/www.cnn.com\/interactive\/2021\/12\/health\/shaken-baby-syndrome-legal-battle\/\">shaken baby syndrome<\/a> \u2013 a misdiagnosis, his attorneys claim, and one they say has since been discredited. Child abuse pediatricians and medical organizations like the American Academy of Pediatrics remain firm on the <a href=\"https:\/\/www.jpeds.com\/article\/S0022-3476(16)30402-4\/fulltext\" target=\"_blank\" rel=\"noopener\">legitimacy of the diagnosis<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh90000v3b6mxc5lhywh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But Roberson, his attorneys and advocates point to a variety of other possible causes for Nikki\u2019s death, citing their own medical experts: She had double pneumonia that had progressed to sepsis, they say, and she had been prescribed two medications now seen as inappropriate for children that would have further hindered her ability to breathe. Additionally, the night before Roberson brought her to a Palestine, Texas, emergency room, she had fallen off a bed, and was particularly vulnerable given her illness, Roberson\u2019s attorneys say. They point to all these factors as explanations for her condition.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh90000w3b6mi2a1ka7i@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson brought Nikki to the hospital on the morning of January 31, 2002. He told investigators he had woken in the night to find she\u2019d fallen off the bed, with some blood on her lips and a bruise under her chin, according to the criminal complaint. He kept her up for two hours to make sure she was OK, he said, but when he woke that morning, she was unresponsive.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh90000x3b6mhl0wu6mf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Doctors treating Nikki \u201cpresumed\u201d abuse based on her symptoms and common thinking at the time of her death without exploring her recent medical history, the inmate\u2019s attorneys claim. And they say his behavior in the emergency room \u2013 viewed as uncaring by doctors, nurses and the police, who believed it a sign of his guilt \u2013 was a manifestation of autism spectrum disorder, which went undiagnosed until 2018.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh90000y3b6mdsxfx4vm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Indeed, police never explored explanations for Nikki\u2019s death other than shaken baby syndrome, according to Brian Wharton, the former lead detective of the Palestine police. The guidance of medical experts paired with Roberson\u2019s demeanor led authorities to focus on Roberson as a suspect \u201cto the exclusion of any other possibilities,\u201d he has told CNN.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh9000103b6mpe4ru3ik@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson\u2019s attorneys do not dispute babies can and do die from being shaken. But they contend more benign explanations, including illness, can mimic the symptoms of shaken baby syndrome, and those alternative explanations should be ruled out before a medical expert testifies with certainty the cause of death was abuse.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh9000113b6m3sj7dx9m@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Shaken baby syndrome is accepted as a\u00a0<a href=\"https:\/\/publications.aap.org\/aapnews\/news\/8666\/Despite-Media-Reports-Most-Doctors-Don-t-Dispute\" target=\"_blank\" rel=\"noopener\">valid diagnosis<\/a>\u00a0by the\u00a0<a href=\"https:\/\/publications.aap.org\/pediatrics\/article\/145\/4\/e20200203\/36936\/Abusive-Head-Trauma-in-Infants-and-Children\" target=\"_blank\" rel=\"noopener\">American Academy of Pediatrics<\/a>\u00a0and supported by child abuse pediatricians who spoke with CNN. Today, it is more commonly referred to as a type of \u201cabusive head trauma,\u201d a broader term doctors began to use around 2009 to reflect it can be caused by actions other than shaking, like an impact to a child\u2019s head.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh9000123b6miuqbhyfv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Abusive head trauma generally occurs when a frustrated parent or caregiver violently shakes a child and\/or causes a blunt impact injury, the\u00a0<a href=\"https:\/\/www.cdc.gov\/child-abuse-neglect\/about\/about-abusive-head-trauma.html\" target=\"_blank\" rel=\"noopener\">US Centers for Disease Control and Prevention<\/a>\u00a0and others say. It is the leading cause of child abuse deaths in children under age 5, the CDC says.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh9000133b6m5tq4levc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Criminal defense lawyers also have oversimplified how doctors diagnose abusive head trauma, child abuse pediatricians say, noting many factors are considered to determine it.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh9000143b6m9vv3sy29@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Still, courts across the country have been reconsidering the role shaken baby syndrome plays in convictions that rely upon it: Since 1992, courts in at least 17 states and the US Army have exonerated 32 people convicted in shaken baby syndrome cases, according to\u00a0<a href=\"https:\/\/www.law.umich.edu\/special\/exoneration\/Pages\/detaillist.aspx\" target=\"_blank\" rel=\"noopener\">the National Registry of Exonerations<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh9000153b6m9e7petx5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Those who question the diagnosis point to research they say undermines its reliability. But within the context of the law, they are also concerned the diagnosis appears to encompass multiple elements of a crime, including the suspect, their state of mind and how the crime was committed.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh9000163b6mztcv4mrl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt\u2019s the entire case, and that is Mr. Roberson\u2019s case,\u201d Keith Findley, professor emeritus with the University of Wisconsin Law School, testified before the Texas Committee on Criminal Jurisprudence last week. \u201cWhen you have a prosecution, a conviction that rests entirely upon medical, scientific opinion, and it turns out that medical science is, at best, deeply disputed, you have a recipe for real problems.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hpgh9000173b6my86sncc2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Child abuse pediatricians, however, fiercely defend the diagnosis.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hue72200013b6mpyh9zmlh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI don\u2019t know what to say about the legal controversy,\u201d Dr. Antoinette Laskey, chair of the American Academy of Pediatrics\u2019 Council on Child Abuse and Neglect, told CNN. \u201cThis is real, it affects children, it affects families.\u201d\n    <\/p>\n<div data-uri=\"cms.cnn.com\/_components\/image\/instances\/cm2hsusqc002d3b6mm00zqkvj@published\" class=\"image image__hide-placeholder\" data-image-variation=\"image\" data-name=\"AP24292007257815.jpg\" data-component-name=\"image\" data-observe-resizes=\"\" data-breakpoints=\"{\" image--eq-extra-small=\"\" data-original-ratio=\"0.6666666666666666\" data-original-height=\"2000\" data-original-width=\"3000\" data-url=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/ap24292007257815.jpg?c=original\" data-editable=\"settings\">\n<div class=\"image__container \" data-image-variation=\"image\" data-breakpoints=\"{\" image--eq-extra-small=\"\">\n       <picture class=\"image__picture\"><source height=\"2000\" width=\"3000\" media=\"(min-width: 1280px)\" srcset=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/ap24292007257815.jpg?q=w_1110,c_fill\/f_webp\" type=\"image\/webp\"><source height=\"2000\" width=\"3000\" media=\"(min-width: 960px)\" srcset=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/ap24292007257815.jpg?q=w_1015,c_fill\/f_webp\" type=\"image\/webp\"><source height=\"2000\" width=\"3000\" media=\"(min-width: 480px)\" srcset=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/ap24292007257815.jpg?q=w_1160,c_fill\/f_webp\" type=\"image\/webp\"><source height=\"2000\" width=\"3000\" media=\"(max-width: 479px)\" srcset=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/ap24292007257815.jpg?q=w_680,c_fill\/f_webp\" type=\"image\/webp\"><img decoding=\"async\" src=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/ap24292007257815.jpg?q=w_1110,c_fill\" alt=\"Dani Allen, center left with microphone, an anti-death penalty advocate, speaks during a protest outside the prison where Robert Roberson was scheduled for execution Thursday in Huntsville, Texas.\" class=\"image__dam-img image__dam-img--loading\" onload=\"this.classList.remove('image__dam-img--loading')\" onerror=\"imageLoadError(this)\" height=\"2000\" width=\"3000\" loading=\"lazy\"\/><\/source><\/source><\/source><\/source><\/picture>\n    <\/div>\n<\/div>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hqi6cd001l3b6mqxz2ts8a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson\u2019s possible testimony Monday is scheduled to take place before the House Committee on Criminal Jurisprudence, which includes state legislators who have championed the inmate\u2019s case. Their subpoena calls for Roberson to \u201cprovide all testimony and information concerning the committee\u2019s inquiry.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hs8h3g001w3b6mej2zzv7r@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Last Wednesday, the same committee held a hearing about Roberson\u2019s case, and whether he should have benefited from a Texas law commonly referred to as the \u201cjunk science writ.\u201d The law, formally known as Article 11.073, dates to 2013, and was meant to open a path for someone to challenge their conviction if there is new scientific evidence that was unavailable at the time of their trial.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2hs8h3g001x3b6mgo4e010v@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Roberson\u2019s advocates feel he should have benefited from this law. The Texas Court of Criminal Appeals previously issued a stay of execution in Roberson\u2019s case in 2016, sending a claim under Article 11.073 (among others) back to the trial court.
