Smith, filed the lawsuit in U.S. District Court in Los Angeles. The complaint also names Tesla and Warner Bros. Discovery as defendants, saying that Alcon had denied a request by Mr. Musk and the companies to use imagery from \u201cBlade Runner 2049\u201d as part of an Oct. 10 <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/10\/10\/business\/tesla-robotaxi-elon-musk.html\" title=\"\">marketing event<\/a> on the Warner lot.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cHe did it anyway,\u201d the suit says.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Musk\u2019s live-streamed presentation \u2014 a grand unveiling of a car that Tesla says will be able to drive itself \u2014 did not use exact \u201cBlade Runner 2049\u201d images, according to the complaint. Rather, the event showcased \u201cA.I.-created images mirroring scenes from \u2018Blade Runner 2049,\u2019 including one featuring a Ryan Gosling look-alike,\u201d Alcon said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The lawsuit called the use of artificial intelligence tools to create near-identical images \u201ca bad-faith and intentionally malicious gambit\u201d to make the event \u201cmore attractive to a global audience and to misappropriate the \u2018Blade Runner 2049\u2019 brand to help sell Teslas.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Mr. Musk, Tesla and Warner Bros. Discovery could not immediately be reached for comment.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">As described by Alcon, the episode bears a striking resemblance to one earlier this year involving the actress <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/05\/20\/technology\/scarlett-johannson-openai-voice.html\" title=\"\">Scarlett Johansson and the artificial intelligence start-up OpenAI<\/a>. Days before it demonstrated a new virtual assistant, OpenAI had requested that Ms. Johansson license her voice for it. She declined.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Despite her refusal, OpenAI used a voice called \u201cSky\u201d that sounded \u201ceerily similar to mine,\u201d Ms. Johansson said at the time, noting that she had hired a lawyer. OpenAI denied that it had intended to copy her voice, but pulled \u201cSky\u201d as a voice option, saying in a blog post that \u201cA.I. voices should not deliberately mimic a celebrity\u2019s distinctive voice.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201c<a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2017\/10\/02\/movies\/blade-runner-2049-review-ryan-gosling-harrison-ford.html\" title=\"\">Blade Runner 2049<\/a>,\u201d a sequel, was financed and produced by Alcon and released by Warner Bros. in 2017. The movie stars Mr. Gosling as a bioengineered human living in a postapocalyptic America and prominently features an artificially intelligent, fully autonomous car.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Alcon denied a request to allow Mr. Musk to use imagery from the film because of his \u201chighly politicized, capricious and arbitrary behavior, which sometimes veers into hate speech,\u201d according to the complaint.
