{"id":116928,"date":"2024-10-22T04:08:48","date_gmt":"2024-10-21T21:08:48","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=116928"},"modified":"2024-10-22T04:08:48","modified_gmt":"2024-10-21T21:08:48","slug":"trial-to-start-for-daniel-penny-after-chokehold-death-of-jordan-neely-on-nyc-subway","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=116928","title":{"rendered":"Trial to start for Daniel Penny after chokehold death of Jordan Neely on NYC subway"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p class=\"\">A widely shared video of a former Marine wrapping his arms around a man\u2019s neck and restraining him in a chokehold until he died on the floor of a New York City subway car will play a key role in the trial of Daniel Penny, who is charged in the death of Jordan Neely.<\/p>\n<p class=\"\">Both Penny\u2019s attorneys and those prosecuting him say they will use the four-minute video to bolster their arguments in a case that became a flashpoint in the nation\u2019s long-standing debate over racial justice and, closer to home, the safety of the city\u2019s subway system.<\/p>\n<p class=\"\">Attorneys for Penny, 26, who is white, say their client did not apply enough pressure for the hold to be deadly, while prosecutors argue he used excessive force to take the life of Neely, a 30-year-old Black man who worked as a Michael Jackson impersonator.<\/p>\n<p class=\"\">Jury selection begins Monday in Penny\u2019s trial, which is expected to last six weeks. Some recalled him saying he was homeless, hungry and didn\u2019t care whether he went to jail.<strong> <\/strong>Prosecutors do not dispute that Neely was acting in an aggressive manner, they said in court documents.<\/p>\n<p class=\"\">Steven Raiser, an attorney for Penny, said a half-dozen or so witnesses will testify for the defense.<\/p>\n<p class=\"\">\u201cYou have an individual that\u2019s saying that he was frightened by this gentleman, Mr. Neely, and he had to act,\u201d Raiser said Thursday. \u201cWe have several additional witnesses that come up and say, \u2018Yes, he\u2019s right. That\u2019s exactly how I felt, too.\u2019\u201d<\/p>\n<p class=\"\">But prosecutors said in court documents that witnesses \u201cdiffered sharply in their threat assessments.\u201d<\/p>\n<p class=\"\">One witness said, \u201cIt was like another day typically in New York. That\u2019s what I\u2019m used to seeing,\u201d according to grand jury minutes cited in a court filing.<\/p>\n<p class=\"\">Another witness said, \u201cI personally didn\u2019t feel threatened,\u201d while another said, \u201cI wasn\u2019t really worried about what was going on,\u201d and, \u201cI\u2019m kind of used to that, so I see that all the time.\u201d<\/p>\n<p class=\"\">None of the witnesses who testified before the grand jury said Neely displayed or claimed to have a weapon or that he came into physical contact with anyone before Penny began choking him, prosecutors said in court documents.<\/p>\n<p class=\"\">Penny also said he had not seen Neely put his hands on anyone or display a weapon before Penny brought him to the ground, according to court documents.<\/p>\n<p class=\"\">Penny, who served in the Marine Corps for four years before being discharged in 2021, pinned Neely to the ground with the help of two other passengers, according to prosecutors and bystander video.<strong> <\/strong>Video shows Penny wrapping his legs around Neely\u2019s body as the pair are on the floor of the train car.<\/p>\n<p class=\"\">Prosecutors said in court documents that Penny had Neely in a chokehold for approximately six minutes, including nearly a minute after Neely \u201cceased all purposeful movement,\u201d and after the subway car had pulled into the Broadway-Lafayette Station and the doors had opened.<\/p>\n<p class=\"\">Neely lost consciousness during the struggle, police said. An eyewitness testified<strong> <\/strong>to the grand jury that while he was initially grateful for Penny\u2019s intervention, he believed the hold\u2019s nature and duration\u00a0bordered on excessiveness, prosecutors said in court documents.<\/p>\n<p class=\"\">Raiser said the defense plans to dispute that Penny had Neely in a chokehold at all. He said Penny restrained Neely to hold him down, not to choke him.<\/p>\n<p class=\"\">\u201cThe video\u2019s been cited frequently as supporting the chokehold as going on too long,\u201d Raiser said. \u201cBut in reality, the video proves that he wasn\u2019t applying pressure, and he was holding Mr. Neely.\u201d<\/p>\n<p class=\"\">Penny told multiple officers at the subway station that day that he had approached Neely from behind and put him in a choke or chokehold and that Neely \u201cwas threatening everybody,\u201d according to court documents.<\/p>\n<p class=\"\">Both sides said they will discuss the medical examiner\u2019s toxicology report, which found that synthetic cannabinoids were in Neely\u2019s body when he died, according to court documents.<\/p>\n<p class=\"\">Raiser said Penny, who is from Long Island but now lives in Manhattan, was free on $100,000 bond pending trial and stopped working in construction because of the trial.<\/p>\n<p class=\"\">Supporters have donated more than $3 million to a fund for Penny\u2019s legal expenses started by his attorneys.<\/p>\n<p class=\"\">Outside of Manhattan Criminal Court on Monday, Imani Henry of Equality for Flatbush, a Black Lives Matter organization in Brooklyn, said she felt Neely\u2019s life had been unfairly minimized and that the city needed to do more to aid those facing such issues as mental health and poverty.<\/p>\n<p class=\"\">\u201cJordan Neely was loved in his communities,\u201d Henry said. \u201cHe was a brother, he was a community member. He was a performer \u2014 to continue to keep just focusing on his mental health condition is just unfair and wrong, because we are not simply one component of our lives. We are full and complex people.\u201d<\/p>\n<p class=\"\">Raiser said the case has resonated with people because it highlights the issue of safety for train riders and whether they have a duty to protect one another when they believe a person is in danger.<\/p>\n<p class=\"\">An additional 1,000 police officers were assigned to the subway system in February after the city saw a 45% <a href=\"https:\/\/www.nyc.gov\/site\/nypd\/news\/p00100\/nypd-february-2024-citywide-crime-statistics\" target=\"_blank\" rel=\"noopener\">spike in major crimes<\/a> in January.<\/p>\n<p class=\"\">A month later, New York Gov. Kathy Hochul announced she would <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/gov-kathy-hochul-sending-national-guard-members-new-york-city-subways-rcna142063\" target=\"_blank\" rel=\"noopener\">deploy 750 members of the National Guard <\/a>and an additional 250 state troopers and police officers from the Metropolitan Transportation Authority to the subways to assist the New York Police Department with bag checks at busy train stations.<\/p>\n<p class=\"\">Hochul\u2019s announcement came a week after a passenger had slashed a subway conductor in the neck and following other crimes in the subway system.<\/p>\n<p class=\"endmark\">The NYPD <a href=\"https:\/\/www.nyc.gov\/site\/nypd\/news\/p0528\/nypd-citywide-crime-statistics-september-third-quarter-2024\" target=\"_blank\" rel=\"noopener\">announced<\/a> this month that subway crime was down 4.8% in the third quarter of this year compared to the same period a year ago.
