The Michigan judge called the lawsuit an \u201cattempt to disenfranchise\u201d voters, and the North Carolina judge said Republicans \u201cpresented no substantial evidence\u201d of the fraud they claimed they were trying to prevent.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2jj08tx000f3b6mpd58nhyr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The RNC sued in Michigan and North Carolina to block state policies that allow for citizens abroad to cast ballots in those states if their parents (or, in Michigan, their spouse) resided in those states before leaving the country,\u00a0even if the voters themselves never lived there.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2jj08tx000g3b6mj6pdutuw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            <a href=\"https:\/\/www.courts.michigan.gov\/4aa11f\/siteassets\/case-documents\/opinions-orders\/coc-opinions-(manually-curated)\/2024\/24-000165-mz.pdf\" target=\"_blank\" rel=\"noopener\">Judge Sima Patel of Michigan\u2019s Court of Claims said in her ruling<\/a> that Republicans were too late in filing their lawsuit, calling it\u00a0\u201c11th hour attempt to disenfranchise\u201d spouses and children of former Michigan residents who now live abroad.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2jj08tx000h3b6mqpfnjhss@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In\u00a0North Carolina, <a href=\"https:\/\/www.documentcloud.org\/documents\/25245032-north-carolina-overseas-voting-lawsuit-ruling\" target=\"_blank\" rel=\"noopener\">Wake County Superior Court Judge John W. Smith denied the RNC\u2019s request<\/a> for an emergency court order that would require election officials to set aside ballots from overseas voters who hadn\u2019t themselves lived in the state.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2jj08tx000i3b6meibobfdl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Smith\u00a0said that the RNC\u00a0was\u00a0challenging voting policies that were passed with bipartisan support by the North Carolina legislature and that the Republicans\u00a0\u201chave presented no substantial evidence of any instance where the harm that plaintiffs seek to prevent has ever \u2018fraudulently\u2019 occurred.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2jj08tx000j3b6mqeezanxh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            CNN has reached out to the RNC and election officials in Michigan and North Carolina for comment.\u00a0DNC spokesperson Alex Floyd said in a statement that the GOP-backed litigation \u201cwas nothing more than a transparent ploy to threaten the voting rights of military families and try to sow chaos in this election for cynical political ends.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2kebjtr00023b6m83wbuve6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            And Vice President Kamala Harris\u2019 campaign used the rulings to accuse Republicans of \u201cpulling out all the stops to block your vote,\u201d in a statement Tuesday morning.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2jnpr1100003b6m9e8uw6ru@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \ufeffMichigan Secretary of State Jocelyn Benson, who oversees the state\u2019s elections and was sued by the RNC, hailed Patel\u2019s court ruling as \u201ca win for voters and democracy today in Michigan!\u201d In a social media\u00a0<a href=\"https:\/\/x.com\/jocelynbenson\/status\/1848490404330762375?s=43&amp;t=4_2OKgCJcp5BkC5zJraDSw\" target=\"_blank\" rel=\"noopener\">post<\/a>, Benson, a second-term Democrat, touted the judge\u2019s conclusion that the GOP was trying to \u201cdisenfranchise\u201d some voters.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2jj08tx000k3b6ms4o30wou@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In Michigan and North Carolina, the policy of accepting ballots from those overseas voters have been on the books for several years. But starting in 2016, civilian voters abroad began outnumbering the military vote overseas \u2013 which itself is not as conservative as it once was. Democrats announced earlier this cycle a six-figure investment into turning out eligible Democrats abroad, particularly those who can vote in battleground states.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2jj08tx000l3b6m8mjis31h@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Michigan Republicans cited\u00a0the reports of that turnout effort in their court filings in their challenge there.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2jj08tx000m3b6mwm6t1zmg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Still, Patel noted in her ruling that the RNC\u2019s Michigan lawsuit was filed just a few weeks before Election Day and well after the federal deadline for states to transmit ballots to overseas voters.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2jj08tx000n3b6m9v4nhn7x@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt would be extremely difficult or impossible for defendants to design and carry out a program to reject potentially thousands of [absent voter ballots] at this time,\u201d Patel wrote, while noting the \u201cmyriad tasks in the final days leading up to a general election\u201d that election officials currently face.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2jj08tx000o3b6m0o1knrm2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt is hard to imagine a more prejudicial situation arising from plaintiffs\u2019 delay,\u201d she wrote.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2jj08tx000p3b6m2e3fb5k7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Patel was also not convinced by Republicans\u2019 arguments that voter residency requirements in the Michigan Constitution preclude the state law that allows overseas citizens who had never lived in Michigan to vote there if they had a sufficient family tie. The judge embraced the arguments put forward by election officials defending the policy, who asserted that Michigan\u2019s Constitution also gave the legislature the power to expand the pool of eligible voters.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2jj08tx000q3b6mh9pfuzem@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Michigan officials said last week that they have received about 16,000 requests for overseas ballots.
