{"id":117240,"date":"2024-10-23T00:22:14","date_gmt":"2024-10-22T17:22:14","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=117240"},"modified":"2024-10-23T00:22:14","modified_gmt":"2024-10-22T17:22:14","slug":"january-6-riot-conviction-of-cowboys-for-trump-founder-is-upheld-in-precedent-setting-case","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=117240","title":{"rendered":"January 6 riot conviction of \u2018Cowboys for Trump\u2019 founder is upheld in precedent-setting case"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div data-editable=\"content\" itemprop=\"articleBody\" data-reorderable=\"content\">\n<p>\n    <cite class=\"source__cite\"><br \/>\n      <span class=\"source__location\" data-editable=\"location\"\/><br \/>\n      <span class=\"source__text\" data-editable=\"source\">CNN<\/span><br \/>\n        \u00a0\u2014\u00a0<br \/>\n    <\/cite>\n<\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2kjz6qh001n2cqk5uey34ka@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The federal appeals court in Washington, DC, on Tuesday <a href=\"https:\/\/media.cadc.uscourts.gov\/opinions\/docs\/2024\/10\/22-3042-2081254.pdf\" target=\"_blank\" rel=\"noopener\">upheld the conviction of the\u00a0Cowboys for Trump founder\u00a0<\/a>who entered the restricted area of the US Capitol on January 6, 2021, saying rioters\u00a0didn\u2019t have to know the Secret Service was protecting then-Vice President Mike Pence inside when they breached the area.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2klch8q000b3b6mr4dazuff@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The case is among a handful that tested the foundational approach the Justice Department took to\u00a0prosecute\u00a0hundreds of Capitol\u00a0rioters<strong>,<\/strong>\u00a0and the decision has been long-awaited since it was argued last December by those handling cases coming through the DC federal court.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2klch8q000c3b6m1lcrvskn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It also strengthens federal protection the Secret Service can offer, by defining more clearly the law around trespassing in areas where public officials are being protected.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2klch8q000d3b6mpyw88mlf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe basis of the Secret Service\u2019s authority to prevent access to designated areas for the safety of its protectees \u2026 need not be in the mind of the trespasser,\u201d DC Circuit Judge Nina Pillard wrote in the opinion Tuesday.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2klch8q000e3b6m6nhtnyvr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The unsuccessful challenge to the law was brought by Couy Griffin, a New Mexico local official who organized a group called Cowboys for Trump, who\u00a0jumped a stone wall outside the Capitol to board the inauguration\u00a0stage.\u00a0Griffin was convicted of two misdemeanors, including the trespassing charge, and was sentenced to 14 days in jail and a year of supervised release.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2klch8r000f3b6m5gl1s77s@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIn [Griffin\u2019s] view, the statute also requires proof that he knew why the Capitol grounds were so restricted when he entered or remained there \u2014i.e. that a Secret Service protectee was or would be temporarily visiting the Capitol grounds. We decline to adopt such a rule,\u201d Pillard wrote in the 2-1 opinion. \u201cGriffin\u2019s approach would surely hinder the Secret Service\u2019s capacity to handle the full range of potential threats.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2klch8r000g3b6mzrqct7yb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It\u2019s possible Griffin continues to fight his trespass charge with further appeals, including potentially to the US Supreme Court, which has shown interest in\u00a0<a href=\"https:\/\/www.cnn.com\/2024\/06\/28\/politics\/takeaways-supreme-court-january-6-obstruction-charges-donald-trump\/index.html\">reinterpreting the law<\/a>\u00a0around the Capitol riot.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2klch8r000h3b6mupb89wdt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Griffin\u00a0<a href=\"https:\/\/amp.cnn.com\/cnn\/2024\/03\/18\/politics\/couy-griffin-supreme-court-january-6\">previously asked the Supreme Court\u00a0<\/a>to hear a different legal challenge he brought related to January 6, following his removal from an elected public office. A judge <a href=\"https:\/\/www.cnn.com\/2022\/09\/06\/politics\/couy-griffin-new-mexico-january-6\/index.html\">jettisoned Griffin from his role as a New Mexico county commissioner<\/a>, and the high court declined to hear his case seeking reinstatement.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2klch8r000i3b6mhxlk4s2n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            An attorney for Griffin from the federal public defender service\u00a0didn\u2019t immediately respond\u00a0to CNN\u2019s request for comment.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2klch8r000j3b6m669m985u@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The three-judge panel had one dissenter, Judge Greg Katsas, a Trump appointee.
