They got life without the possibility of parole. I just think that given the current state of the law and given our assessment of their behavior in prison, they deserve the opportunity to be re-evaluated and perhaps reintegrated into the community.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o2qi60000c3b6m3aerr21r@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A hearing on the matter could be held in\u00a030\u00a0to\u00a045\u00a0days, when a Los Angeles Superior Court judge will ultimately decide whether the brothers will be resentenced. Gasc\u00f3n<strong>\u00a0<\/strong>said he supports the resentencing of the brothers to life with the possibility of parole \u2013 which normally would mean 50 years to life in prison. But because the crimes happened when the brothers were under 26 years old, they would be eligible for youthful parole under California law.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o6ywek00023b6jb5vx1kt1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Calling the brothers \u201cmodel prisoners,\u201d Gasc\u00f3n told CNN he believes there\u2019s a good chance they would be paroled if the decision reaches the parole board. An attorney for one of the brothers said he hopes they\u2019ll be home by Thanksgiving.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o3020i000h3b6mmg2orag9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The reexamination of the case comes more than 35 years after the 1989 fatal shooting of Jose and Kitty Menendez in their Beverly Hills mansion. Their sons, who were 21 and 18 at the time, were arrested less than a year later, in 1990, and convicted of first-degree murder in 1996.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o3llfm000u3b6mhvytq8if@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At the two high-profile trials, the brothers did not deny killing their parents, but argued they should not be convicted because they acted in self-defense after enduring a lifetime of physical and sexual abuse by their father. The first trial \u2013 one of the first cases to be televised \u2013 ended in a mistrial after jurors deadlocked on the charges. In their second trial, much of the defense evidence about sexual abuse was excluded, and the brothers were found guilty in 1996 and sentenced to life in prison.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o2xdfl000e3b6m70ikbq85@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Multiple factors ultimately led to the resentencing recommendation, but whether the brothers \u2013 now in their 50s \u2013 could be released from prison remains uncertain. Here\u2019s what led to the decision and what could happen next:\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o36pfj000k3b6me7vgdz90@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Although Gasc\u00f3n believes that Lyle and Erik Menendez were appropriately sentenced during their trial more than three decades ago, they deserve a chance to be re-evaluated, he told CNN\u2019s Stephanie Elam Thursday. Gasc\u00f3n said that he believes the brothers had been sexually abused prior to the killings, and they have served enough time behind bars.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o3lmzf000x3b6m2hc0aese@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Gasc\u00f3n\u2019s decision was made just an hour before he made the announcement Thursday because there were vastly different opinions on the case within his office, he told CNN. Multiple factors went into the decision to recommend a resentencing, including that multiple family members \u201cmade it very clear that not only that there might have been sexual molestation, but they say this is a very dysfunctional, very abusive home, and it was so for many years,\u201d Gasc\u00f3n said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o3lmzf000y3b6mfko4axan@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI believe they have served enough time,\u201d he said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o3lmzf000z3b6mz6w502vz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Gasc\u00f3n\u2019s reexamination of the case came after attorneys for the Menendez brothers filed <a href=\"https:\/\/www.cnn.com\/2023\/05\/05\/us\/menendez-brothers-new-evidence-claims\/index.html\">a habeas corpus petition<\/a> in 2023, citing what they argue is <a href=\"https:\/\/www.cnn.com\/2024\/10\/15\/us\/menendez-brothers-district-attorney-letter\/index.html\">new evidence<\/a>, as well as a recent <a href=\"https:\/\/legiscan.com\/CA\/text\/AB1104\/id\/2827135\" target=\"_blank\" rel=\"noopener\">California law<\/a> on resentencing in which the court can take into consideration sentences in comparable cases.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o3lmzf00103b6mcexx0qlq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Among the new evidence the 2023 petition asked a court to consider: a sworn statement by former Menudo boy band member Roy Rossell\u00f3, who alleged Jose Menendez sexually assaulted him in the 1980s. The attorneys also said <a href=\"https:\/\/www.cnn.com\/2024\/10\/16\/us\/erik-menendez-letter-to-cousin\/index.html\">a letter Erik Menendez wrote to a cousin<\/a> months before the killings alludes to the abuse he endured.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o5umbd001x3b6morzcpmrt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Gasc\u00f3n, who is campaigning for reelection next month on a platform that includes sentencing reform, told CNN times have changed regarding how the public and the courts treat victims of sexual abuse.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o3lmzf00113b6m5ti7qul5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The district attorney\u2019s office also considered the brothers\u2019 behavior while incarcerated, and they have \u201cshown tremendous amount of efforts to rehabilitate,\u201d Gasc\u00f3n said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o3lmzf00123b6mwd4zvuuc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThey have been model prisoners by all accounts. Not only have they worked on their own self-improvement, but they have done a lot of work to better the life of those around them, which<strong> <\/strong>that part is unusual,\u201d Gasc\u00f3n told CNN, indicating that the men created groups to address how to deal with untreated trauma and help inmates with physical disabilities.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o3lmzf00133b6m557pbwlk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Citing their conduct during the last three decades in prison, Gasc\u00f3n said he believes that there\u2019s a strong possibility that the brothers will be paroled.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o3lmzf00143b6mxlomsasi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWhat they did was horrible. They premeditated the murder of their parents and killed them. But I think they\u2019re different people today, and we base our opinion on the last 35 years of behavior,\u201d Gasc\u00f3n said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o6u2gp00003b6j35s629vm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The decision on whether the brothers should be paroled will however ultimately lie with the parole board if the court agrees with the district attorney\u2019s office on the resentencing, according to the district attorney.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o67q6r002a3b6muywarxm1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            When asked about mounting criticism from opponents who suggested reconsidering the Menendez brothers\u2019 sentence was a political move, Gasc\u00f3n said, \u201cThere\u2019s nothing political about this,\u201d adding that more than 300 resentencings have happened in the county since he took Thursday\u2019s decision brought a ray of hope for the brothers\u2019 attorneys and family, who said they anticipate the men can soon be reunited with loved ones and live a life outside of prison.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o4e492001f3b6mlh11y2gm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI believe before Thanksgiving, they will be home,\u201d one of the brothers\u2019 attorneys, Mark Geragos, said Thursday.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o6dt6l002k3b6mme52wqbj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe are grateful the district attorney recognized not only the extraordinary contributions Erik and Lyle have made while in prison, but the role that sexual abuse played in their actions as well,\u201d another attorney, Cliff Gardner, told CNN.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o4c8ty001d3b6m1lr18mh1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The petition for resentencing will be filed on Friday with accompanying exhibits supporting Gascon\u2019s recommendation, said Nancy Theberge, deputy in charge of Gasc\u00f3n\u2019s resentencing unit.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o4gqd4001k3b6m3gmnixxu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Then, her unit will coordinate with the defense and court staff to set dates for next proceedings, she said. Once a hearing date is set, the defense can decide whether to have the brothers physically in the courtroom or appear via video or conference. All arguments and evidence will be admitted at that time. The judge will make a ruling based on what is presented, Theberge said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o4gqd4001m3b6mt6di3f18@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe\u2019re just starting the process,\u201d she said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o4gqd4001n3b6mhlgilk8y@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Separate from the resentencing recommendation, the habeas corpus petition filed last year is scheduled to be heard in November. The defense was asking the court to either vacate the brothers\u2019 conviction and sentence, or permit discovery and an evidentiary hearing during which they can provide proof, the petition says.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o8nhkq00093b6j8yjv19cs@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But if the defense team agrees with the DA\u2019s resentencing request, they may withdraw that petition \u2013 which would also become moot if the court agrees to a resentencing, Gasc\u00f3n told CNN Thursday.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o4gqd4001o3b6m5s5fcq09@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI don\u2019t agree with the arguments of the habeas. I think that the conviction was appropriate given what was there,\u201d Gasc\u00f3n told CNN. \u201cBut I do believe the resentencing is an appropriate vehicle for them to be provided some avenues of relief.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2o4gj9f001i3b6m31a3dug6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The brothers\u2019 story has taken on new interest following the September release of the Netflix series, \u201cMonsters: The Lyle and Erik Menendez Story,\u201d co-created by Ryan Murphy and Ian Brennan. Netflix also\u00a0<a href=\"https:\/\/www.cnn.com\/2024\/10\/08\/entertainment\/menendez-brothers-netflix-documentary\/index.html\">released a documentary<\/a>\u00a0on the Menendez case this month featuring both men discussing what led to the killings.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2oahoqg00003b6m97kuyijx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Nery Ynclan, executive producer of docuseries \u201cMenendez + Menudo: Boys Betrayed,\u201d said it was a \u201cmiraculous\u00a0day\u00a0for\u00a0the\u00a0Menendez\u00a0brothers.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2oai0qz00023b6mhx5evuy3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThey had exhausted their appeals so many years ago.
