We will continue to defend the law, fight for protection of every legal vote, and stop election interference in our country\u2019s most important election,\u201d RNC Chairman Michael Whatley said in a statement celebrating the ruling.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p8jrgo000a3b6meh0qbmmf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Democrats and voting rights advocates fear that a ruling in Republicans\u2019 favor will be used to boost challenges to late-arriving ballots in other states, which could make the difference if the margins are tight in key races.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p8jrgo000b3b6mn7y96v8t@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cCongress statutorily designated a singular \u2018day for the election\u2019 of members of Congress and the appointment of presidential electors,\u201d the 5th\u00a0Circuit panel said. \u201cText, precedent, and historical practice confirm this \u2018day for the election\u2019 is the day by which ballots must be both cast by voters and received by state officials.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p8jrgo000c3b6mwiiwywm9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Among the states that allow for late-arriving ballots are Nevada, Ohio and Virginia, as does Maryland, the site of a competitive Senate race.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p8jrgo000d3b6mrgxls7o7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Also allowing for post-election ballot receipt is California and New York, both states that could make a major difference in which party controls the House of Representatives.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p90fu700173b6moa534udr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Even as the ruling has no immediate effect on the coming election, it could help propel any legal challenges that Republicans seek to bring against any of the roughly other 20 states and jurisdictions that count ballots arriving after Election Day. Nevada\u2019s policies allowing the late arrival of mail ballots are already being challenged in state and federal court by Republicans, but courts in those cases so far have rejected those arguments.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p8vawg00113b6mk3g9x77k@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Casting doubt on ballots that were not counted until after Election Day was key to former President Trump\u2019s efforts to delegitimize and overturn the 2020 election, but Friday\u2019s ruling was careful to specify that it\u2019s not commenting about the actual counting of ballots after Election Day, only those received.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p8ujkv000y3b6m1n88hy3y@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThat is not to say all the ballots must be counted on Election Day,\u201d the opinion states. \u201cEven if the ballots have not been counted, the result is fixed when all of the ballots are received and the proverbial ballot box is closed. The selections are done and final. By contrast, while election officials are still receiving ballots, the election is ongoing: The result is not yet fixed, because live ballots are still being received.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p8w9mf00133b6mqyfuh130@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cAlthough a single voter has made his final selection upon marking his ballot, the entire polity must do so for the overall election to conclude,\u201d the court added. \u201cSo the election concludes when the final ballots are received and the electorate, not the individual selector, has chosen.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p8jrgo000e3b6m5sujjv8g@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The 5th\u00a0Circuit\u2019s ruling is only binding on the three Southern states covered by the circuit, and for now, the panel is not ordering that the policy be blocked in Mississippi for the current election, instead sending the case down for more proceedings.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p8jrgo000f3b6mui9fwd4n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Judge Andrew Oldham, joined by Judges James Ho and Kyle Duncan in Friday\u2019s opinion, instructed the lower court to give \u201cdue consideration to \u2018the value of preserving the status quo in a voting case on the eve of an election\u2019\u201d as it considered the next steps in the case.
