{"id":118567,"date":"2024-10-26T11:51:13","date_gmt":"2024-10-26T04:51:13","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=118567"},"modified":"2024-10-26T11:51:13","modified_gmt":"2024-10-26T04:51:13","slug":"federal-judge-halts-virginias-pre-election-voter-roll-purge-aimed-at-suspected-noncitizens","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=118567","title":{"rendered":"Federal judge halts Virginia\u2019s pre-election voter roll purge aimed at suspected noncitizens"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div data-editable=\"content\" itemprop=\"articleBody\" data-reorderable=\"content\">\n<p>\n    <cite class=\"source__cite\"><br \/>\n      <span class=\"source__location\" data-editable=\"location\"\/><br \/>\n      <span class=\"source__text\" data-editable=\"source\">CNN<\/span><br \/>\n        \u00a0\u2014\u00a0<br \/>\n    <\/cite>\n<\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ov9z4p002e26qf0nsmbfaj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A federal judge on Friday halted a Virginia program that purged the state\u2019s voter rolls based\u00a0on indications that a person might be a noncitizen and\u00a0ordered officials to restore the registrations of\u00a0roughly 1,600 people\u00a0who had been removed under the process.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p26e0b00003b6mvj335r1w@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The ruling, from US District Judge Patricia Tolliver Giles, an appointee of President Joe Biden, does not give noncitizens the right to vote.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p26owj00023b6mj5qy4qxi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Rather, Giles is siding with\u00a0the Biden administration and others in finding that Virginia\u2019s program violated a federal law that forbids systematic removals from the voter rolls 90 days before a federal election.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ovsj0r00083b6mol86f344@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWhen it is within the 90-day period, it must be done on individualized basis,\u201d she said Friday.<strong> <\/strong>Virginia\u2019s approach \u201cleft no room for individualized inquiry.\u201d The challengers also put forward evidence that citizens were being wrongly removed from the rolls under Virginia\u2019s systems, the judge noted.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p27cas00053b6mbhljko2p@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            As part of Giles\u2019 order, election officials are to send the 1,600 people notices informing them their registrations have been restored. Those letters will also advise them that noncitizens are not eligible to vote in Virginia.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p1ygcy00023b6msipk7g6w@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Former President Donald Trump railed against the ruling on Truth Social, claiming that a \u201cWeaponized Department of \u2018Injustice,\u2019 and a Judge (appointed by Joe), have ORDERED the Great Commonwealth of Virginia to PUT NON-CITIZEN VOTERS BACK ON THE ROLLS.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p20idp00093b6m2c2g3fuc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            State officials immediately appealed the ruling to the 4th US Circuit Court of Appeals, and Trump, in his Truth Social post, said the \u201cU.S. Supreme Court will hopefully fix it!\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2pk05kj00003b6mggcgdn1o@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On Friday night, Virginia officials asked the appeals court\u00a0for an emergency order pausing the trial judge\u2019s ruling. The appeals court ordered the Justice Department and the private plaintiffs to respond by 1 p.m. Saturday.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2pk4xkm00053b6mprwvtpxq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Virginia is asking for the appeals court to decide the emergency appeal by Monday.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ovsj0r000a3b6m43hbka6b@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The ruling comes on the heels of a Justice Department victory in a similar case brought against Alabama for a purge program it was running within the 90-day window. When Giles announced her ruling from the bench Friday, lawyers for the state asked her to pause while they appeal, raising the concern there could be potential noncitizens who are restored to the rolls.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ovsj0r000b3b6m7rtsmj83@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The judge rejected that argument: \u201cI am not dealing with belief. I am dealing with evidence.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ovsj0r000c3b6mfrln8efi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The supposed threat of noncitizens voting in the 2024 election has been a fixation of Trump and Republicans. However, documented cases of noncitizens voting are extremely rare; a recent Georgia audit of the 8.2 million people on its rolls found just 20 registered noncitizens \u2013 only nine of whom had voted.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ovsj0r000d3b6mree1kgvb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Virginia Gov. Glenn Youngkin, a Republican, touted his state\u2019s efforts to purge noncitizens with an August executive order \u2013 just as the 90-day window began \u2013  and pledged the program would continue and take even more aggressive steps to remove suspected non-citizens.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ovsj0r000e3b6maoblm1bw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Under the program, if a person told the department of motor vehicles via a checkbox that he or she was a noncitizen, or the Department of Motor Vehicles had other records indicating non-citizenship, Virginia election officials would send that person a notice giving them two weeks to affirm their citizenship or have their registration canceled. The program requires election officials to move forward with sending the notices and starting the purge process for individuals even if they have other information indicating those voters are in fact citizens. Naturalized citizens can sometimes be wrongly tagged as suspected noncitizens because of outdated government\u00a0data.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2oxklyf000c3b6mlg1dknrw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Youngkin criticized the judge\u2019s ruling Friday and said that the state will ask the Supreme Court to undo it \u201cif necessary.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2oxqjop000f3b6m9yha76ux@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cLet\u2019s be clear about what just happened: only eleven days before a Presidential election, a federal judge ordered Virginia to reinstate over 1,500 individuals \u2013 who self-identified themselves as noncitizens \u2013 back onto the voter rolls,\u201d the governor said in a\u00a0statement that did not address the evidence that eligible voters had been removed as well.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ovsj0r000f3b6mes6ztsi5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At a daylong hearing Thursday, Charles Cooper, a lawyer for Virginia, argued that purges focused on non-citizens weren\u2019t covered under the quiet period imposed by the National Voter Registration Act, and that Virginia\u2019s procedures were not the kind of \u201csystematic\u201d program addressed in the federal law.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ovsj0r000g3b6mdg8isnja@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            He also pointed to the opportunities that Virginia offered citizens to rectify false positives, which also include the ability to re-register at a polling place on Election Day.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ovsj0r000h3b6md7v2dojd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On Friday, Giles said that the possibility that wrongly purged people could vote provisionally was not enough to salvage the program.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ovsj0r000i3b6msf64p9ah@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The state\u2019s actions, she said, \u201chave curtailed the right of eligible voters to cast their ballots in the same way that other eligible voters.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ovsj0r000j3b6mj83e3720@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Virginia\u2019s opponents also argued that same-day registration would not fix the problem for purged eligible voters who sought to vote via an absentee ballot.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2ovsj0r000k3b6m7024gw80@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Brent Ferguson, representing immigrant activists and voting rights advocates who sued over the removal program, said Thursday that, using the list of purged voters that had been handed over to the challengers earlier this week, his team had already identified 18 citizens who had been wrongly removed.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2p29rpy00093b6mgfz2rafd@published\" data-editable=\"text\"
