The appeals court ruling follows an order from a three-judge panel in the circuit court last year, originally <a href=\"https:\/\/www.teslarati.com\/elon-musk-tweet-ruled-illegal\/\">ruling that Musk has to delete the tweet<\/a>.<\/p>\n<p>\u201cWe hold that Musk\u2019s tweets are constitutionally protected speech and do not fall into the categories of unprotected communication like obscenity and perjury,\u201d the court ruled.<\/p>\n<p>\u201cDeleting the speech of private citizens on topics of public concern is not a remedy traditionally countenanced by American law,\u201d the court added.<\/p>\n<p>In the original tweet, Musk writes that there is \u201cnothing stopping Tesla team at our car plant from voting union,\u201d noting that they could as soon as the following day if they wanted to. \u201cBut why pay union dues and give up stock options for nothing,\u201d the CEO adds in the tweet.<\/p>\n<p>You can see the full tweet in question below.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Nothing stopping Tesla team at our car plant from voting union. Our safety record is 2X better than when plant was UAW &amp; everybody already gets healthcare.<\/p>\n<p>\u2014 Elon Musk (@elonmusk) <a href=\"https:\/\/twitter.com\/elonmusk\/status\/998454539941367808?ref_src=twsrc%5Etfw\">May 21, 2018<\/a><\/p>\n<\/blockquote>\n<p>Although the court did rule that the tweet does not have to be deleted, the court did not respond as to whether Musk illegally threatened Tesla workers in the tweet, as was initially claimed by the NLRB.<\/p>\n<p>Many of the judges on the board dissented the ruling, claiming that it \u201csays zip about whether the NLRB is entitled to enforcement of seven uncontested Tesla labor violations,\u201d and ignoring \u201cwhether Musk\u2019s tweet was an unfair labor practice.\u201d<\/p>\n<p>The decision also calls into question the extent to which the NLRB and other federal agencies can challenge employer speech.<\/p>\n<p>Musk has expressed multiple similar sentiments in the past, especially highlighting the multiple corruption scandals faced by the United Automotive Workers (UAW) in the past several years. In a follow-up to the original tweet, Musk also notes that the \u201cUAW did nada for job security in last recession,\u201d adding that the union \u201cdropped Fremont like a hot potato to protect their core base in Detroit.\u201d<\/p>\n<p>In 2022, <a href=\"https:\/\/www.teslarati.com\/uaw-president-vs-elon-musk-tesla-union-vote\/\">Musk encouraged the UAW to hold a unionization vote at its Fremont factory<\/a>, though the union hasn\u2019t yet held a vote at the companies\u2019 factories.<\/p>\n<p>\u201cI\u2019d like hereby to invite UAW to hold a union vote at their convenience,\u201d Musk wrote. \u201cTesla will do nothing to stop them.\u201d<\/p>\n<p>Last November, the <a href=\"https:\/\/www.teslarati.com\/uaw-union-drive-tesla-automakers\/\">UAW officially launched a union drive at Tesla and 12 other automakers<\/a>, following a historic, six-week strike against the Big Three, Ford, General Motors (GM), and Dodge-Chrysler parent company Stellantis that garnered record pay increases.
