But fans and researchers of gaming history might be forced to deal with hours of traffic every time they want to access these in person, <a href=\"https:\/\/www.theverge.com\/2024\/10\/25\/24279657\/us-copyright-dmca-exception-extension-denied-remote-access\" target=\"_blank\" title=\"(Opens in a new tab)\" rel=\"noopener\"><em>The Verge <\/em>reports.\u00a0<\/a><\/p>\n<p>The decision comes after two non-profits, the Video Game History Foundation and the Software Preservation Network (SPN), spent three years campaigning for  the US Copyright Office to grant an exemption to its rules governing old video games.<\/p>\n<p>Under the Foundation\u2019s proposals, researchers would have been able to access emulated copies of their chosen games remotely, just like how libraries can sometimes grant members e-book access from home.<\/p>\n<p>In an official statement on the loss, the group blamed \u201clobbying efforts by rightsholder groups\u201d such as the Entertainment Software Association (ESA), the trade association of the video game industry that represents many of the world\u2019s largest publishers, for holding back its ideas.<\/p>\n<p>The statement read: \u201cDuring our hearing with the Copyright Office, the Entertainment Software Association (ESA) declared that they would never support remote game access for research purposes under any conditions.&#8221;<\/p>\n<p>&#8220;The game industry\u2019s absolutist position\u2014which the ESA\u2019s own members have declined to go on the record to support\u2014forces researchers to explore extra-legal methods to access the vast majority of out-of-print video games that are otherwise unavailable.\u201d<\/p>\n<p>The news comes as game preservationists may have an increasingly indispensable role in preserving the cultural history of video games<\/p>\n<p>The vast majority\u201487%\u2014of <a href=\"https:\/\/gamehistory.org\/87percent\/\" target=\"_blank\" title=\"(Opens in a new tab)\" rel=\"noopener\">games released before<\/a> 2010 are &#8220;critically endangered&#8221; in the US according to the Video Game History Foundation, which means that they aren\u2019t easily available in their original physical and digital forms.<\/p>\n<p>Some platforms have had much better luck in terms of how their back catalog has been preserved.
