When\u00a0undocumented immigrants finish serving their time\u00a0in state prisons or local jails, they\u00a0are generally\u00a0released into the community rather than handed over to ICE.\u00a0<\/p>\n<p class=\"\">Trump\u00a0has vowed that if he returns to office, he will immediately\u00a0begin rounding up undocumented im\u00a0across\u00a0the country, starting with those\u00a0who have criminal records or final orders of deportation.\u00a0\u00a0<\/p>\n<p class=\"\">Nearly 1.5 million immigrants in the U.S. have final orders of deportation, according to ICE officials. And more than 430,000 immigrants with criminal records are\u00a0believed to be living in the country\u00a0outside of ICE detention. It is not clear\u00a0to what extent the two\u00a0groups overlap. <\/p>\n<p class=\"\">During the first Trump administration, over 400,000 immigrants with criminal records lived in the U.S. outside of ICE detention, roughly the same number as do under the Biden-Harris administration.  <\/p>\n<p class=\"\">Having federal agents arrest and deport as many as\u00a01.9\u00a0million such immigrants would cost nearly 10 times ICE\u2019s current\u00a0annual budget, according to the American Immigration Council, a pro-immigration research and advocacy organization.<\/p>\n<p class=\"\">To pressure local law enforcement\u00a0agencies to cooperate, the Trump team would cut off their access to Justice Department grants, the three sources said.\u00a0The Justice Department\u00a0describes the grants, known as the Byrne JAG grant program,\u00a0as\u00a0the \u201cleading source of federal justice funding to state and local jurisdictions.\u201d\u00a0<\/p>\n<p class=\"\">\u00a0The\u00a0Justice Department has historically given out\u00a0over $250 million in funding\u00a0per year\u00a0to state and local law enforcement\u00a0agencies through the Byrne JAG grant program. The process is competitive, and law enforcement organizations have used the funding to cover policing\u00a0costs\u00a0to drug rehabilitation centers to corrections programs.\u00a0<\/p>\n<p class=\"\">During Trump\u2019s first term in office, several states, including New York, sued the administration after it cut off Byrne JAG grants to sanctuary cities. After an appeals court sided with the Trump administration, the Democratic-controlled states appealed to the Supreme Court.\u00a0And that legal maneuver, in essence, ran out the clock on the first Trump administration.<\/p>\n<p class=\"\">Before the Supreme Court ruled, Joe Biden won the 2020 election, took office and restarted the grant program for sanctuary cities.
