Barnica is the third woman reported by ProPublica to have died in recent years<strong> <\/strong> after being unable to access abortion<strong> <\/strong>legally or having her medical care delayed.<\/p>\n<p class=\"dcr-1eu361v\">Although US abortion bans \u2013 which more than a dozen states have enacted in the two years since the supreme court overturned <a href=\"https:\/\/www.theguardian.com\/us-news\/roe-v-wade\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Roe v Wade<\/a> \u2013 technically permit the procedure in medical emergencies, doctors across the country have said that the laws are worded so vaguely that they<strong> <\/strong>don\u2019t know when they can legally intervene. (Texas enacted the ban almost a year before Roe was overturned; it now bans abortion from conception.) When her bleeding worsened the following day, Barnica returned to the hospital, where a doctor concluded that a miscarriage was \u201cin progress\u201d. Another soon concluded that a miscarriage was \u201cinevitable\u201d.<\/p>\n<p class=\"dcr-1eu361v\">Barnica\u2019s cervix was dilated at nearly 9cm, a condition that left her vulnerable to fast-acting infections, ProPublica reported. And under the Texas ban, doctors could not intervene unless a \u201cmedical emergency\u201d \u2013 a term that was not defined in the law \u2013 developed.<\/p>\n<p class=\"dcr-1eu361v\">About 40 hours after Barnica\u2019s second arrival at the hospital, doctors stopped being able to detect a fetal heartbeat, according to the report. A doctor expedited her labor using medications and delivered Barnica\u2019s fetus. But after she returned home, Barnica\u2019s bleeding continued and worsened.<\/p>\n<p class=\"dcr-1eu361v\">Within days, she was back at the hospital, where she died of sepsis involving \u201cproducts of conception\u201d, according to her autopsy report. Her widowed husband is now raising their four-year-old daughter, ProPublica reported.<\/p>\n<p class=\"dcr-1eu361v\">Multiple experts, including OB-GYNs and maternal fetal medicine specialists, told ProPublica that delaying Barnica\u2019s care ran against the medical standard of care due to the risk of infection. Had she been given options earlier, they told the outlet, Barnica might have survived.<\/p>\n<p class=\"dcr-1eu361v\">Doctors involved in Barnica\u2019s case did not respond to ProPublica\u2019s requests for comment. In a statement, HCA Healthcare, the hospital chain that treated Barnica, told ProPublica that doctors exercised independent judgment and \u201cour responsibility is to be in compliance with applicable state and federal laws and regulations\u201d.<\/p>\n<p class=\"dcr-1eu361v\">Abortion and the consequences of banning the procedure have become one of the top issues in the US election, as support for abortion rights has surged in the years since Roe fell and dozens of women have come forward to say they were <a href=\"https:\/\/www.theguardian.com\/us-news\/ng-interactive\/2024\/oct\/21\/idaho-abortion-trump\" data-link-name=\"in body link\">denied medically necessary care<\/a>. Kamala Harris has made protecting abortion rights a key plank of her policy platform, while Donald Trump and other Republicans have tried to evade discussion of it or flip-flopped on the issue.<\/p>\n<p class=\"dcr-1eu361v\">\u201cMy heart breaks for the Barnica family,\u201d Colin Allred, a US representative from Dallas running for a Senate seat, posted on X on Wednesday. Allred is running against Ted Cruz, the avowedly anti-abortion senator, and has made abortion rights a centerpiece of his campaign.<strong> <\/strong>\u201cJosseli Barnica should be alive today but because of Ted Cruz\u2019s cruel abortion ban, Texas women have been denied the life-saving health care they need. We can\u2019t afford six more years of Ted Cruz.\u201d<\/p>\n<p class=\"dcr-1eu361v\">Cruz has recently <a href=\"https:\/\/www.texastribune.org\/2024\/10\/07\/ted-cruz-texas-abortion-colin-allred\/\" data-link-name=\"in body link\">kept quiet on abortion<\/a>. He declined a ProPublica request from comment, as did the Texas governor, Greg Abbott, and the state attorney general, Ken Paxton.<\/p>\n<p class=\"dcr-1eu361v\">In the weeks since ProPublica first reported on two Georgia<strong> <\/strong>women, <a href=\"https:\/\/www.propublica.org\/article\/georgia-abortion-ban-amber-thurman-death\" data-link-name=\"in body link\">Amber Nicole Thurman<\/a> and <a href=\"https:\/\/www.propublica.org\/article\/candi-miller-abortion-ban-death-georgia\" data-link-name=\"in body link\">Candi Miller<\/a>, who died after being unable to access legal abortions in their home state, Trump has also largely avoided commenting on their specific cases. However, during a Fox News townhall, the host Harris Faulkner told Trump that Thurman\u2019s family was holding a press call.<\/p>\n<p class=\"dcr-1eu361v\">\u201cWe\u2019ll get better ratings, I promise,\u201d <a href=\"https:\/\/x.com\/KamalaHQ\/status\/1846571615498232032\" data-link-name=\"in body link\">Trump joked<\/a>.
