All three liberal justices on the court \u2013 Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson \u2013 said they would not have halted a lower-court ruling earlier in October ordering the state to restore the voter registrations.<\/p>\n<p class=\"dcr-1eu361v\">The legal dispute centers on a <a href=\"https:\/\/www.governor.virginia.gov\/media\/governorvirginiagov\/governor-of-virginia\/pdf\/eo\/EO-35-Comprehensive-Election-Security-Ensuring-Legal-Voters-and-Accurate-Counting---vF---8.7.24.pdf\" data-link-name=\"in body link\">7 August executive order<\/a> by the Virginia governor, Glenn Youngkin, a Republican, directing the state to run its voter registration rolls against DMV data on a daily basis to check for non-citizens. The justice department and civil rights groups sued, saying that the state was violating a federal law that prohibits systematic removals of voters within 90 days of a federal election.<\/p>\n<p class=\"dcr-1eu361v\">The US district judge Patricia Giles <a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/oct\/25\/virginia-voter-non-citizen-eligible\" data-link-name=\"in body link\">granted an injunction<\/a> request last week to restore the voters.<\/p>\n<p class=\"dcr-1eu361v\">Voting experts have long warned that comparing voting rolls with DMV data is not a reliable way to find non-citizens on the rolls because there may be <a href=\"https:\/\/www.documentcloud.org\/documents\/25260010-full-analysis-non-citizens-veris-review\" data-link-name=\"in body link\">paperwork errors<\/a> and people can become naturalized after getting their driver\u2019s license. The plaintiffs in the lawsuit said they had identified several people who were in fact citizens but had their registrations wrongly canceled.<\/p>\n<p class=\"dcr-1eu361v\">\u201cWe know this program removes eligible voters,\u201d said Protect Democracy, a non-profit that sued <a href=\"https:\/\/www.theguardian.com\/us-news\/virginia\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Virginia<\/a> over the removals, in a statement. \u201cVirginia has not presented <em>any <\/em>evidence of noncitizens participating in elections. Because there is none. And it\u2019s actually eligible VA voters that have been caught in the middle of this election-subversion scheme.\u201d<\/p>\n<p class=\"dcr-1eu361v\">A spokesperson for the Department of Justice said in a statement that they disagree with the supreme court\u2019s order. \u201cThe Department brought this suit to ensure that every eligible American citizen can vote in our elections,\u201d they wrote.<\/p>\n<p class=\"dcr-1eu361v\">Kamala Harris\u2019s campaign responded to the ruling in a statement.<\/p>\n<p class=\"dcr-1eu361v\">\u201cEvery eligible voter has a right to cast their ballot and have their vote counted, and this ruling does not change that. Our campaign is going to make sure every eligible voter is able to vote,\u201d the campaign said. \u201cVoting by non-citizens remains illegal under federal law. We are confident this election will be free, fair, and secure, and we are confident that the voters will elect Kamala Harris.\u201d<\/p>\n<p class=\"dcr-1eu361v\">Donald Trump and allies had distorted the removals, saying that the lower court decision meant that non-citizens were going to be placed back on the voter rolls.
