A jury found the man she accused of assault not guilty."},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div data-editable=\"content\" itemprop=\"articleBody\" data-reorderable=\"content\">\n<p>\n    <cite class=\"source__cite\"><br \/>\n      <span class=\"source__location\" data-editable=\"location\"\/><br \/>\n      <span class=\"source__text\" data-editable=\"source\">CNN<\/span><br \/>\n        \u00a0\u2014\u00a0<br \/>\n    <\/cite>\n<\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2weaw6x00582cp84ozw7lq3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It was\u00a0the first case in the <a href=\"https:\/\/www.cnn.com\/2024\/10\/09\/politics\/cia-sexual-assault-allegations\/index.html\">CIA\u2019s\u00a0#MeToo<strong> <\/strong>moment<\/a> \u2014\u00a0when a line of women\u00a0who came\u00a0to Capitol Hill beginning\u00a0in early 2023 to report\u00a0to Congress\u00a0that they had been the victims of\u00a0sexual assault or harassment\u00a0while working at the agency.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g700073b6mk84048s4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Rachel Cuda, a trainee, was the first.\u00a0Dozens more would follow.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g700083b6muoc553nl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Her story was harrowing: She claimed that a fellow trainee had \u201cstrangled\u201d her in a stairwell at the agency. That summer, a judge in Fairfax County, Virginia, found her alleged attacker guilty of misdemeanor assault in a bench trial.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g700093b6mbtxfggmc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In more than a year since, courts in Virginia and\u00a0Washington, DC,\u00a0have returned two more guilty verdicts\u00a0in trials of\u00a0CIA officers\u00a0accused of sexual misconduct. Congress issued a <a href=\"https:\/\/www.cnn.com\/2024\/04\/22\/politics\/house-intelligence-committee-find-cia-mishandled-sexual-assault-and-harassment-claims\/index.html\">series of damning reports<\/a> \u2014\u00a0and passed legislation reforming the agency\u2019s processes for handling allegations of assault and harassment. For the first time, what victims say is a culture that protects predators had leaked into the public eye.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000a3b6m534ejshl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Cuda\u2019s story had started a movement.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000b3b6m31igb0n9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI\u2019m that first guy through the door. I can take this impact for you. Somebody\u2019s gotta do it. Somebody has to go outside of the institution to shine a line on this\u2014because this didn\u2019t just happen to me,\u201d she said in an\u00a0<a href=\"https:\/\/www.elle.com\/culture\/career-politics\/a62711642\/cia-sexual-assault-rachel-cuda-interview\/\" target=\"_blank\" rel=\"noopener\">interview<\/a>\u00a0with\u00a0Elle\u00a0published earlier this week.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000c3b6mtlzblr34@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But in the end, the first case became one of the messiest.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000d3b6mn1hgicnu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On Wednesday, a Virginia jury unanimously overturned the\u00a0original\u00a0conviction of Ashkan Bayatpour, declaring him not guilty of assaulting Cuda.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000e3b6m28snmn1l@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cSexual harassment is a real national security issue that threatens unit cohesion and forces good people out of serving our country,\u201d Bayatpour said in a prepared statement\u00a0released after\u00a0the verdict\u00a0on Wednesday. \u201cThese kinds of allegations should be taken seriously and investigated thoroughly. But we have to find a better way to sort out credible allegations from lies.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000f3b6mcdxf5pq4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The trial exposed the challenges of adjudicating\u00a0these types\u00a0of allegations between close colleagues, not just in the CIA, but in any workplace. And it cast Cuda, the woman whose alleged assault more than any other had come to define the issue at the agency, as a complicated heroine for a movement that she helped begin.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000g3b6mozfkstle@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A midday walk between two work friends \u2014\u00a0\u201cworky-work soul mates,\u201d in Cuda\u2019s words \u2014\u00a0ended in the encounter in the stairwell in which she said she was \u201cstrangled\u201d\u00a0but which\u00a0Bayatpour said involved a light flutter of a scarf over her shoulders as part of a misguided effort to cheer her up.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000h3b6mnxpi303b@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It followed months of instant messages between the two that were full of friendly banter that defense lawyers said was clearly pockmarked with double entendres \u2014\u00a0a pattern in a work relationship that led Bayatpour to believe a sexual joke would be funny.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000i3b6mo8zeqcrw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Victims\u2019 rights advocates point out that women who come forward with allegations of sexual assault are often not believed.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000j3b6ml78nygfg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But during closing arguments, even the state prosecutor seemed to tacitly acknowledge that Cuda\u2019s account of the incident appeared full of little inconsistencies, a slowly evolving narrative that Bayatpour\u2019s defense attorney had just argued at length had become more dramatic in each retelling.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000k3b6mp8omvuhm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cLet\u2019s summarize: Ms. Cuda is a liar. Check,\u201d the prosecutor said,\u00a0referring to the defense team\u2019s position.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000l3b6mgb8b7b6z@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Even so, she argued to the jury: \u201cYou can still find him guilty. It\u2019s an unwanted touching.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000n3b6mvzy7fr1i@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Cuda and Bayatpour had not known one another long. They were both new employees of the CIA, training to become case officers. But they became\u00a0fast\u00a0work friends and chatted endlessly over Skype, the internal\u00a0instant messaging service\u00a0used at the agency.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000o3b6m2srp09fv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Cuda testified in court that the two were not close; that Bayatpour had pursued her romantically but that she is married and had rebuffed him.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000p3b6m48f846uq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But reams of internal Skype messages between Bayatpour and Cuda\u00a0suggest\u00a0two new colleagues\u00a0who\u00a0seemed to talk constantly. Cuda often sent him heart emoticons and told him she \u201cloved\u201d him. In messages where Bayatpour suggested social activities, Cuda responded enthusiastically.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000q3b6m14xkqdyc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            They took frequent walks around agency grounds, and Bayatpour testified that Cuda often\u00a0seemed to be going through a hard time.\u00a0She confessed challenges in her marriage to him, he testified, and, later, began sharing explicit details with him about a sexual relationship he said she told him she was having with another colleague at the agency, whom they called \u201ctall guy\u201d in internal messages. According to Bayatpour, the will-they-won\u2019t-they build-up to that alleged relationship\u00a0with \u201ctall guy\u201d\u00a0became a frequent topic of discussion between the two, as had discussions of her sexual preferences \u2014\u00a0including, he said, that she liked to be \u201cchoked.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000r3b6mqfvxd78l@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Cuda denied telling Bayatpour that she liked to be choked, denied the affair, and denied sending a graphic text message \u2014\u00a0presented as a screen shot at trial \u2014 that Bayatpour testified was Cuda detailing an alleged encounter with \u201ctall guy\u201d in May.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000s3b6mtu1rvsep@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Skype messages between the two were often rife with sexual innuendo. Bayatpour from the stand frankly acknowledged that although their relationship was platonic, they often engaged in flirtatious banter and jokes with sexual undertones, describing himself now as embarrassed. He enjoyed hearing all the dramatic details of her life, he said, because it was entertaining \u2014\u00a0like watching \u201cThe Bachelorette.\u201d He saw his role as her cheerleader, he said, often bucking her up.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000t3b6myrwhml81@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWtf would I do without you,\u201d she wrote in one Skype message.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000u3b6mhfhsuib5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Cuda repeatedly insisted either that their banter was not sexual in nature, or, if it was, that she was uncomfortable with Bayatpour\u2019s language. Although she frequently responded with \u201clmao,\u201d \u201chahahahahaha\u201d and similar online expressions of amusement, those were all examples of \u201cuncomfortable laughter,\u201d she said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000v3b6mem6r7ryl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            She would, she said, sometimes express discomfort to Bayatpour that \u201cthere were multiple men who were coming on to me\u201d at the agency.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000x3b6m2iijl9i0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On July 13, 2022, both parties testified, Cuda asked to go for a walk around the agency grounds. During that walk, Bayatpour gave her a royal blue scarf, a light, pashmina-style garment. Bayatpour testified that he had been given it for free\u00a0by some friends connected to the Blue Angels\u00a0(the Navy\u2019s flight demonstration squadron), and it had been gathering dust in his office until, on a whim, he decided to give it to Cuda. At the end of the walk, he walked her up the stairs back to her fifth-floor office.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000y3b6mjfpqbxio@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The two parties presented dramatically different interpretations of the encounter in the stairwell.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g7000z3b6m8b913y6t@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Cuda told the jury that Bayatpour asked for the scarf back. As they were walking up the stairway, she testified, she saw the scarf come over her head from behind. She turned around, she said, and he started to cross the ends of the scarf aggressively. Bayatpour, she said, was making \u201ca face I will never forget\u201d \u2014\u00a0a face, she said, that indicated to her that he was trying to hurt her. Cuda testified that he told her, \u201cThis is what I want to do to you,\u201d and leaned in to kiss her. She disentangled herself, she said, and kept walking towards her office. At the top of the stairs, she claimed that Bayatpour draped the scarf over her head again from behind and said, \u201cThere are many uses for this.\u201d When she came out of the stairwell onto the fifth floor, she said, Bayatpour \u201cgrabbed me by the arm, spun me around, leaned in\u201d and kissed her on the cheek.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g700103b6mmias2iih@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Almost none of\u00a0what Cuda claimed, Bayatpour said, was true.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g700113b6mqry9t6ib@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In an initial recorded interview with internal investigators at the CIA several days after the incident played at trial, Cuda calmly described Bayatpour draping the scarf over her head and crossing the ends, but said she didn\u2019t \u201ccatch\u201d what he said. She did not mention that he had \u201cgrabbed\u201d her at the top of the stairs and kissed her on the cheek.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g700123b6mzj4cxohv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In Bayatpour\u2019s version of events, Cuda had spent much of their long walk venting to him about her love life and her struggles at the agency \u2014\u00a0something he said she often did. At the end of the walk, he said, she asked him how he was doing. Bayatpour told her he was in love, that he thought he had found the woman he was going to marry. Abruptly, he said, she ended their walk and he immediately felt like he had been insensitive, gushing about his happy life while she was struggling.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g700133b6mok5jez73@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIn the stairwell, I was thinking, I need to do something funny to break the mood,\u201d Bayatpour told the jury.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g700143b6m117zmijl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Bayatpour said he asked for the scarf back from Cuda and, standing approximately face-to-face with her, lightly draped the scarf over her neck and waggled the two ends, saying \u201cHey, there are many uses for this\u201d \u2014\u00a0a reference, he thought, to her past confessions about being choked that they had laughed over. Cuda, he said, rolled her eyes. They exited the stairwell and parted.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g700153b6m0yzgzr6s@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It was a joke, his attorney said \u2014\u00a0perhaps a bad joke or an inappropriate joke, but not one intended to do bodily harm or in any way express hostility to Cuda.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g700163b6mbm5ax3wn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Cuda, seated in the first row of the courtroom with her husband and\u00a0a small number of supporters,\u00a0wept through the beginning of his testimony and, later, shook her head repeatedly as he described the encounter and their relationship.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g700173b6mvsocrw4p@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Hinting at the complexity of the case, the jury initially deadlocked at 6-1 \u2014\u00a0with no indication of which way they were swinging. But within an hour, they had returned their unanimous not-guilty verdict.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g700183b6m2z12suot@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            What Cuda\u2019s story \u2014\u00a0including the\u00a0acquittal\u00a0of the man she claimed attacked her \u2014 will mean for the movement built by survivors and advocates hung over the proceedings during the three-day trial.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wo79g700193b6m666yiu7s@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In his closing arguments, Bayatpour\u2019s attorney seemed to\u00a0allude to\u00a0the fears of some advocates: Sexual harassment in the workplace is a true problem, and female victims have historically been voiceless in a male-dominated society.
