Andrew Cuomo to the Department of Justice, alleging he lied to Congress.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wm9ch4000x3b6m63reoxca@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At issue is Cuomo\u2019s truthfulness regarding his role in the writing and review of a state health department report from June 2020 that <a href=\"https:\/\/www.cnn.com\/2021\/02\/15\/politics\/andrew-cuomo-covid-19-controversy-explained\/index.html\">underestimated the nursing home death count<\/a> by nearly half.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wm9ch4000y3b6mo5k8ksae@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A Cuomo administration advisory sent out in March 2020 barred nursing homes from rejecting patients solely on the basis of a Covid-19 diagnosis. Subcommittee chairman Rep. Brad Wenstrup, an Ohio Republican, <a href=\"https:\/\/oversight.house.gov\/wp-content\/uploads\/2024\/03\/2024.03.05-BRW-Letter-to-Cuomo.pdf\" target=\"_blank\" rel=\"noopener\">has alleged<\/a> the former governor\u2019s \u201cmisguided decision effectively admitted thousands of COVID-19 positive patients into nursing homes, causing predictable but deadly consequences for New York\u2019s most vulnerable.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wm9ch4000z3b6my5huwepl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Earlier Wednesday, Cuomo\u2019s legal team filed a referral letter to the Justice Department requesting they investigate an alleged abuse of power by the select committee, with a particular focus on Wenstrup, whom they claim to be in cahoots with a Fox News personality and her husband, who is part of a separate Covid-related lawsuit against the former governor.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wm9ch400103b6m5jrh9c77@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Cuomo spokesman Rich Azzopardi said the GOP-led committee was engaged in a \u201cpre-election Maga exercise and affirmatively chose to act unethically in order to help their masters score cheap political points.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wm9ch400113b6m1nc2tfa0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThis is a joke,\u201d Azzopardi said of the testimony in question. \u201cThe Governor said he didn\u2019t recall because he didn\u2019t recall.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wm9ch400123b6mmde2d17t@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Cuomo\u2019s handling of the pandemic has come under stricter scrutiny in recent years. After reporting first surfaced that his administration had misled the public about the death toll, officials in New York began investigations.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wm9ch400133b6mn2d74arf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In January 2021, New York Attorney General Letitia James\u00a0issued a report stating Covid-19 deaths among residents of nursing homes had been undercounted by approximately 50%. The health department had skewed the numbers by omitting in their count deaths that occurred after a patient was transported to a hospital.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wm9ch400143b6mr0znhjmb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The report preliminarily concluded that deaths were underreported based on a survey of 62 nursing homes, roughly a 10% sample of total facilities across the state. James\u2019 report detailed one facility where deaths were underreported to the Department of Health by as many as 29 deaths.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wm9ch400153b6mokn59d8e@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The expected criminal referral is based partly on testimony by Cuomo\u2019s former executive assistant Farrah Kennedy, who wrote emails in June 2020 to then-senior staff of Cuomo offering edits to the report and rewriting parts of it. A June 28, 2020, email she sent was titled \u201cEdits to nursing home doc.\u201d Cuomo denied the edits were his, but Kennedy told the subcommittee, \u201cI believe this to be his handwriting.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wm9ch400163b6mqe4ez6pq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Cuomo\u2019s allegedly \u201cfalse statements,\u201d the subcommittee said in a letter obtained by CNN, were made during <a href=\"https:\/\/www.cnn.com\/2024\/04\/26\/politics\/andrew-cuomo-testify-covid-nursing-home-deaths\/index.html\">a June 11 transcribed interview<\/a> and related to \u201chis involvement in and knowledge of the drafting of the July 6 Report.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wm9ch400173b6mh17tht0d@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cAs explained in the attached referral,\u201d the subcommittee letter signed by Wenstrup states, \u201cMr. Cuomo made multiple criminally false statements, including that he was neither involved in the drafting nor the review of the July 6 Report.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wm9ch400183b6mhyp8xmbj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Cuomo, according to the letter, \u201calso\u00a0testified that he did not have any discussions about the July 6 Report being peer reviewed\u201d and that he didn\u2019t know whether the report was to be reviewed by individuals not in the department of health.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2wm9ch400193b6mn9deidxj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The subcommittee says that documents show all of those statements to be false.
