{"id":120540,"date":"2024-10-31T18:58:46","date_gmt":"2024-10-31T11:58:46","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=120540"},"modified":"2024-10-31T18:58:46","modified_gmt":"2024-10-31T11:58:46","slug":"new-law-makes-dueling-presidential-transitions-possible","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=120540","title":{"rendered":"New law makes dueling presidential transitions possible"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p>WASHINGTON (AP) \u2014 There will be 77 days between <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/election-2024\">Election Day<\/a><\/span> and <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/joe-biden-inauguration-day-fabf334c9fd05dc020f468aa9e53bffe\">inauguration<\/a><\/span>, a period in which the president-elect may ready his or her administration to take over power from President <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/joe-biden\">Joe Biden<\/a><\/span>. <\/p>\n<p>Long built on tradition and bipartisanship, the presidential <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/explain-transition-election-inauguration-db5529c285029f87db322bb094cb5659\">transition<\/a><\/span> exploded into a point of political contention four years ago, after then-President <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/donald-trump\">Donald Trump<\/a><\/span> made baseless claims to <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/ap-fact-check-trump-conclusively-lost-bbb9d8c808021ed65d91aee003a7bc64\">dispute his loss<\/a><\/span> and his administration <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/joe-biden-transition-approved-04f44843e63aad2820bc72640cca2e83\">delayed kicking off the transition process for weeks<\/a><\/span>. <\/p>\n<p>This year, a new law is meant to start the transition sooner, no matter who wins. But, if neither major party candidate concedes after Election Day, the updated rules allow both sides to get additional government funding and logistical support to begin working toward transitioning to power. That could lead to both Vice President <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/kamala-harris\">Kamala Harris<\/a><\/span> and Trump potentially assembling dueling, governments-in-waiting for weeks.<\/p>\n<p>\u201cRules can only take you so far, and ultimately you need to have the players in the system working to shared objective,\u201d said Max Stier, president and CEO of the nonprofit Partnership for Public Service, which has worked with candidates and incumbents on transitions. \u201cEveryone should have the shared objective of making sure that the handoff of power is smooth and effective. And that requires a cooperation that law can\u2019t alone enforce.\u201d <\/p>\n<p>Here\u2019s a look at how changes meant to fix the problems of four years ago may not solve coming issues this time, and where the coming transition stands in the meantime: <\/p>\n<h2>What happened in 2020? <\/h2>\n<p>Trump <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-2020-election-lies-debunked-4fc26546b07962fdbf9d66e739fbb50d\">lied<\/a><\/span> about widespread voter fraud that <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/voter-fraud-election-2020-joe-biden-donald-trump-7fcb6f134e528fee8237c7601db3328f\">didn\u2019t occur<\/a><\/span>, delaying the start of the 2020 transition from one administration to the next from Election Day on Nov. 3 to Nov. 23. <\/p>\n<p>The Trump-appointed head of the General Services Administration, <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/emily-murphy-say-transitional-launch-110eea5e33860598a0e177708081dd47\">Emily Murphy<\/a><\/span>, consulted the transition law dating to 1963 and determined that she had no legal standing to determine a winner \u2014 and start funding and cooperating with a transition to a Biden administration \u2014 because Trump was still challenging the results in court.<\/p>\n<p>GSA essentially acts as the federal government\u2019s landlord, and it wasn\u2019t until Trump\u2019s efforts to subvert free and fair election results <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/donald-trump-losing-election-lawsuits-36d113484ac0946fa5f0614deb7de15e\">had collapsed across key states<\/a><\/span> that Murphy agreed to formally \u201c <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/joe-biden-health-national-security-rob-portman-coronavirus-pandemic-ac923137dfb664e5c3a1923f52eebbad\">ascertain a president-elect<\/a><\/span> \u201d and begin the transition process. Trump also eventually posted on social media that his administration would cooperate. <\/p>\n<h2>What\u2019s different this time?<\/h2>\n<p>Enacted in December 2022, the Presidential Transition Improvement Act now mandates that the transition process begin five days after the election, even if more than one candidate hasn\u2019t conceded.<\/p>\n<p>That avoids long delays and means \u201can \u2018affirmative ascertainment\u2019 by the GSA is no longer a prerequisite for gaining transition support services,\u201d according to agency guidelines on the new rules. <\/p>\n<p>But the new law also effectively mandates federal support and cooperation for both candidates to begin a transition. It states that such support should continue until \u201csignificant legal challenges\u201d that could alter electoral outcomes have been \u201csubstantially resolved,\u201d or when electors from each state meet in December to formally choose an Electoral College winner. <\/p>\n<p>That means the government potentially bestowing enough backing that both sides can prepare an administration until mid-December \u2014 only about a month before Inauguration Day on Jan. 20.<\/p>\n<div class=\"Infobox\" data-module=\"\" data-gtm-region=\"What to know about the 2024 Election Today's news: Follow live updates from the campaign trail from the AP. Learn more.\" data-align-center=\"\">\n<div class=\"Infobox-items RichTextBody\">\n<p><b>What to know about the 2024 Election<\/b><\/p>\n<\/div>\n<\/div>\n<p>Derek Muller, a University of Notre Dame law professor and presidential transition expert who testified in favor of the legislation, said it ensures that potentially two candidates get backing for transitions, with one eventually falling away. He said that\u2019s preferable to having a situation where no transition support is released to either side \u2014 which can spark delays leading to national security lapses. <\/p>\n<div class=\"Infobox\" data-module=\"\" data-gtm-region=\"What to know about the 2024 Election Today's news: Follow live updates from the campaign trail from the AP. Learn more.\" data-align-center=\"\">\n<div class=\"Infobox-items RichTextBody\">\n<p><b>What to know about the 2024 Election<\/b><\/p>\n<\/div>\n<\/div>\n<p>\u201cIn the past, it was neither candidate gets the funding. Now it\u2019s both,\u201d Muller said. <\/p>\n<p>He pointed to the contested 2000 election, when GSA didn\u2019t determine the winner until the Florida recount fight was settled on Dec. 13 \u2014 raising questions about national security gaps that may have contributed to the U.S. being underprepared for the Sept. 11 attacks the following year. <\/p>\n<p>\u201cIt can last into mid-December. There\u2019s no question that\u2019s a risk,\u201d Muller said of potential dueling transition efforts after this year\u2019s election. \u201cBut I think it\u2019s a risk that they want to take. And even mid-December is still a month away from inauguration, so at least you have some certainty.\u201d<\/p>\n<p>Even today, though, Trump continues to falsely claim he won in 2020 and only says he\u2019ll accept this November\u2019s results if <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-harris-mcdonalds-2024-presidential-election-pennsylvania-73e55c8c1db4adc2a547b62bd5142be3\">they are fair<\/a><\/span>, making it easy to imagine him doing so only if he wins \u2014 and potentially putting the new law to the test. <\/p>\n<h2>How are both sides preparing?<\/h2>\n<h2\/>\n<p>The sprawling transition process starts around 4,000 government positions being filled with political appointees \u2014 people who are specifically tapped for their jobs by the president-elect\u2019s team. That often begins with key Cabinet departments.<\/p>\n<p>Harris\u2019 team already has reached an agreement with the Biden administration to use government office space in Washington and other resources, and to begin vetting potential key national security hires. <\/p>\n<p>Trump\u2019s team <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-harris-transition-security-e9b282a5861c67573d19ad3667580448\">has signed no transition agreements<\/a><\/span>, missing deadlines to agree with GSA on logistical matters like office space and tech support and with the White House on access to agencies, including documents, employees and facilities. <\/p>\n<p>Stier, of the Partnership for Public Service, said the Trump administration\u2019s disregard for the transition process dates to 2016, when the then-president-elect <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/election-2020-joe-biden-donald-trump-coronavirus-pandemic-elections-e9f1167a204dbfa51fb38608677fac70\">fired his transition coordinator<\/a><\/span>, former New Jersey Gov. <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/chris-christie\">Chris Christie<\/a><\/span>, and then spent months of his early administration trying to catch up on basic staffing issues. <\/p>\n<p>Stier said the agreements to prepare transition are merely \u201cthe starter\u2019s pistol \u2014 it isn\u2019t actually the race.\u201d The full process, he said, \u201crequires a deep understanding of our government and a willingness to appreciate the importance of process.\u201d <\/p>\n<h2>What will transition look like? <\/h2>\n<p>Neither side will be starting totally from scratch. While Harris will build her own government, she might tap some holdovers from the Biden administration, where she was vice president. Trump will bring in a new team, but he built an entirely new administration in 2017 and can do it again.<\/p>\n<p>Harris could also opt to keep Senate-confirmed Biden appointees as acting Cabinet secretaries, just in case it is hard to get her nominations through a post-election, GOP-controlled Congress.
