South Carolina officials argued Moore had already raised similar claims and lost while also noting one of his jurors was Hispanic.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2xmvlk9000k3b6mi8mzswdz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The state\u2019s Republican governor still is considering a clemency petition from Moore. Gov. Henry McMaster will not announce his decision until 5:45 p.m. Friday \u2013 minutes before the execution is due to begin at 6 p.m. \u2013 he <a href=\"https:\/\/www.youtube.com\/watch?v=ao4JT-rpvdM\" target=\"_blank\" rel=\"noopener\">said<\/a> Wednesday.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2xmx8zy000r3b6mqpy7worv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            More than 20 people \u2013 including two jurors and the judge from Moore\u2019s original trial and a former director of the state prison system \u2013 have asked McMaster to spare Moore\u2019s life by granting him clemency, The Associated Press <a href=\"https:\/\/apnews.com\/article\/south-carolina-execution-richard-moore-clemency-af2562fc002871c3723532672fbc0c3c\" target=\"_blank\" rel=\"noopener\">reports<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2w3ciw60007356mbptko3y4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Moore is the last person<strong> <\/strong>remaining<strong> <\/strong>on South Carolina\u2019s death row to be convicted by a jury with no Black members, his defense attorneys <a href=\"https:\/\/justice360sc.org\/2024\/justice-360-issues-press-release-response-to-execution-notice-for-richard-bernard-moore\/\" target=\"_blank\" rel=\"noopener\">say<\/a>. He would be the second person put to death since the state resumed capital punishment <a href=\"https:\/\/www.cnn.com\/2024\/09\/20\/us\/freddie-owens-south-carolina-execution\/index.html\">following a 13-year pause<\/a> prompted by difficulty obtaining drugs for its <a href=\"https:\/\/www.cnn.com\/interactive\/2023\/11\/us\/lethal-injection-execution-explained-dg\/\">lethal injection protocol<\/a>, an issue <a href=\"https:\/\/www.cnn.com\/2016\/05\/13\/health\/pfizer-death-penalty-drugs\/index.html\">other states<\/a> have faced.<strong> <\/strong>\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2w3ciw60004356mzi1m94fl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Moore was convicted of killing a White convenience store clerk, James Mahoney, during a 1999 robbery. Moore, who entered the store in Spartanburg County unarmed, pulled Mahoney\u2019s handgun away from him. Mahoney then grabbed a second gun and shot Moore in the arm before Moore fired a fatal shot at Mahoney, prosecutors asserted.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2w3ciw60006356m553phvwy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Moore fled, taking a bag filled with more than $1,400 cash, they said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2w3ciw60005356mnwy8x94z@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Defense attorneys have argued Moore killed Mahoney in self-defense. \u201cNo other South Carolina death penalty case has involved an unarmed defendant who defended himself when the victim threatened him with a weapon,\u201d they said <a href=\"https:\/\/justice360sc.org\/2024\/justice-360-issues-press-release-response-to-execution-notice-for-richard-bernard-moore\/\" target=\"_blank\" rel=\"noopener\">in a statement<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2w7l66v00193b6m45z9nyf8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Moore\u2019s son, who was 4 years old when his father was charged, says his father deserves mercy.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2w7l66v001a3b6moz1kvid4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cHe\u2019s a human being who made mistakes,\u201d Lyndall Moore <a href=\"https:\/\/apnews.com\/article\/richard-moore-execution-south-carolina-son-clemency-134d0477072a02f7abb10ed22b68a5ac\" target=\"_blank\" rel=\"noopener\">told the AP<\/a>. \u201cAnd this particular mistake led to the death of another human being. But his sentence is completely disproportionate to the actual crime.\u201d\n    <\/p>\n<h2 class=\"subheader inline-placeholder\" data-editable=\"text\" data-uri=\"cms.cnn.com\/_components\/subheader\/instances\/cm2w3fvrd000s356mzvvz9yvv@published\" data-component-name=\"subheader\" id=\"south-carolina-expanded-execution-methods\" data-article-gutter=\"true\">\n        South Carolina expanded execution methods<br \/>\n<\/h2>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2w3ciw6000c356mjbg29quh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Supreme Court<a href=\"https:\/\/www.uscourts.gov\/educational-resources\/educational-activities\/facts-and-case-summary-batson-v-kentucky\" target=\"_blank\" rel=\"noopener\"> in 1986 ruled<\/a> prosecutors cannot strike a potential juror based solely on race. If challenged, the state must state a \u201crace-neutral\u201d reason for excluding the candidate.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2w3ciw6000d356m6zf7ehiv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In Moore\u2019s case, prosecutor Trey Gowdy \u2013 who later served four terms as a <a href=\"https:\/\/www.congress.gov\/member\/trey-gowdy\/G000566\" target=\"_blank\" rel=\"noopener\">Republican congressman<\/a> \u2013 told the judge the primary reason one Black jury candidate was struck was because she had tried to hide her criminal record during questioning, while he chose to exclude another because that person\u2019s son had been convicted of murder, the state wrote in opposing Moore\u2019s Supreme Court request.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2x6rwf200073b6mem2uqwur@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A White jury candidate who also had a close family member prosecuted for murder had also been stricken for the same reason, Gowdy told the judge at the time. Moore\u2019s counsel did not raise any challenges with Gowdy\u2019s stated reasons at the time when asked by the trial court, according to the state.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2x66bvm0000356mlgmxhrzg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In a brief filed Tuesday with the Supreme Court, the South Carolina attorney general argued it was too late for Moore to raise the issue of jurors\u2019 race because it had not been mentioned in some earlier appeals. Moore\u2019s attorneys responded Wednesday the case\u2019s \u201cunique procedural backdrop\u201d should allow the justices to consider their arguments.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2x69kwt00043b6mlzewdr95@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            CNN reached out to Gowdy for comment Thursday. Thirty-four percent have been Black, <a href=\"https:\/\/www.census.gov\/quickfacts\/\" target=\"_blank\" rel=\"noopener\">more than double the proportion <\/a>of Black US residents in 2023.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2xn1gkt00103b6maltgb7r7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            As to the clemency petition, McMaster \u201cintend(s) to review everything that I can in a timely fashion,\u201d the governor told reporters Wednesday.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm2xn7caj001c3b6m0sohtsau@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe death penalty is a very serious decision regardless of the circumstances,\u201d he said. \u201cThat\u2019s a very permanent, very serious, awesome punishment, and it must be considered very, very carefully.\u201d\n    <\/p>\n<div data-uri=\"cms.cnn.com\/_components\/image\/instances\/cm2w3jsbp000w356mjhsdo94v@published\" class=\"image_inline-small image_inline-small__hide-placeholder\" data-image-variation=\"image_inline-small\" data-name=\"Gov.
