{"id":120687,"date":"2024-11-01T03:59:50","date_gmt":"2024-10-31T20:59:50","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=120687"},"modified":"2024-11-01T03:59:50","modified_gmt":"2024-10-31T20:59:50","slug":"elon-musks-legal-team-delays-possible-ruling-on-1m-giveaways-with-federal-court-filing","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=120687","title":{"rendered":"Elon Musk&#8217;s legal team delays possible ruling on $1M giveaways with federal court filing"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p class=\"\">PHILADELPHIA \u2014 Elon Musk\u2019s legal team filed court papers that delayed a potential ruling on a lawsuit over his super PAC\u2019s $1 million lottery-style giveaways. <\/p>\n<p class=\"\">Philadelphia District Attorney Larry Krasner <a href=\"https:\/\/www.nbcnews.com\/tech\/tech-news\/philadelphia-da-sues-elon-musk-america-pac-million-dollar-petition-giv-rcna177592\" target=\"_blank\" rel=\"noopener\">filed a lawsuit<\/a> over the contest Monday in state court, but late Wednesday, lawyers for Musk and his America PAC <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.paed.629416\/gov.uscourts.paed.629416.1.0_1.pdf\" target=\"_blank\" rel=\"noopener\">filed papers in federal court<\/a> to move the matter there, arguing that federal law \u2014 not state law \u2014 was central to the case.\u00a0<\/p>\n<p class=\"\">John Summers, a lawyer representing Krasner, described the development as \u201ccowardly, as well as irresponsible,\u201d during a brief hearing in state court Thursday morning.\u00a0<\/p>\n<p class=\"\">Matthew Haverstick, a lawyer representing Musk and the super PAC, defended the substantive merits of their actions. He said their notice of removal was properly filed.\u00a0<\/p>\n<p class=\"\">The federal court filing automatically blocked any immediate action in state court, where Judge Angelo Foglietta had already scheduled Thursday\u2019s hearing. Foglietta went ahead with the hearing but acknowledged that the federal filing had stripped him of jurisdiction to hear arguments.\u00a0<\/p>\n<p class=\"\">As a result, Musk\u2019s super PAC has been free to continue running the daily contest, including <a href=\"https:\/\/x.com\/america\/status\/1851970630737895776\" target=\"_blank\" rel=\"noopener\">announcing a winner<\/a> early Thursday morning. <\/p>\n<p class=\"\">Thursday afternoon, Krasner\u2019s attorneys <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.paed.629416\/gov.uscourts.paed.629416.3.0_1.pdf\" target=\"_blank\" rel=\"noopener\">filed an emergency motion<\/a> in federal court to send the case back to state court, arguing that the suit makes claims only under Pennsylvania law, not federal law. <\/p>\n<p class=\"\">Musk is trying to \u201crun the clock until election day\u201d and avoid a ruling, they wrote. <\/p>\n<p class=\"\">It was not immediately clear how soon a federal judge might rule on the motion or call a hearing. In federal court, the matter had been assigned to U.S. District Judge Jerry Pappert, an appointee of former President Barack Obama, and the federal docket did not show any rulings or scheduled hearings.\u00a0<\/p>\n<p class=\"\">Krasner has sought to move quickly in the case, arguing that Musk and his super PAC are <a href=\"https:\/\/www.nbcnews.com\/tech\/tech-news\/philadelphia-da-sues-elon-musk-america-pac-million-dollar-petition-giv-rcna177592\" target=\"_blank\" rel=\"noopener\">running an illegal lottery<\/a> that violates state law, but the end of the contest is fast approaching, with the final $1 million daily winner scheduled for Tuesday.\u00a0<\/p>\n<p class=\"\">America PAC <a href=\"https:\/\/petition.theamericapac.org\/\" target=\"_blank\" rel=\"noopener\">says<\/a> it has given $1 million prizes to 13 people in the past two weeks. To be eligible to win, people must be registered voters in one of seven battleground states and sign a petition pledging support for the First and Second amendments.\u00a0<\/p>\n<p class=\"\">Summers said he planned to argue in federal court to have the case returned to state court.\u00a0<\/p>\n<p class=\"\">\u201cWe will proceed to federal court, and we will address the issues there and seek to have the matter remanded back to the state court,\u201d he told reporters outside the state courtroom Thursday. He said it\u2019s a case \u201cthat involves state law issues.\u201d\u00a0<\/p>\n<p class=\"\">Summers noted that Musk didn\u2019t appear in person for the hearing.\u00a0<\/p>\n<p class=\"\">\u201cThis morning, DA Krasner was here to testify. Elon Musk didn\u2019t show,\u201d he said.\u00a0<\/p>\n<p class=\"\">Musk\u2019s private jet was in Austin, Texas, as of early Thursday morning, according to the <a href=\"https:\/\/bsky.app\/profile\/elonjet.net\/post\/3l7s5icjdiz2a\" target=\"_blank\" rel=\"noopener\">Elon Jet account<\/a> on Bluesky which publishes aggregated flight data.\u00a0<\/p>\n<p class=\"\">During Thursday\u2019s brief hearing, Summers highlighted Musk\u2019s retweeting of an X post calling Foglietta a \u201cleftist judge,\u201d which the judge said he dismissed as \u201cirrelevant.\u201d\u00a0<\/p>\n<p class=\"\">Foglietta said he wasn\u2019t going to get into any implications of Musk\u2019s failure to appear in person for the hearing unless and until a federal judge returned the case to state court. Musk\u2019s lawyers did attend the hearing.\u00a0<\/p>\n<p class=\"\">Haverstick waved away his client\u2019s absence, saying that Musk is a busy man who can\u2019t \u201cmaterialize\u201d on 12 hours\u2019 notice and that he was added as a defendant in the case only as a \u201cpublicity stunt.\u201d\u00a0<\/p>\n<p class=\"\">Summers pushed back on the idea that Musk was too busy to appear, citing Musk\u2019s wealth, resources and ownership of SpaceX \u2014 which prompted Foglietta to interrupt.<\/p>\n<p class=\"\">\u201cHe\u2019s not going to take a rocket ship and land on the building,\u201d the judge said. \u201cLet\u2019s be serious.\u201d\u00a0<\/p>\n<p class=\"\">\u201cIf anyone could land a rocket ship in Philadelphia, it\u2019s Elon Musk,\u201d Summers replied.<\/p>\n<p class=\"\">Summers also took issue with the idea that the DA sued Musk as a publicity stunt, saying nothing in the matter was a publicity stunt other than Musk\u2019s \u201cweird\u201d rallies.\u00a0<\/p>\n<p class=\"\">Summers also questioned whether America PAC is paying lottery winners, saying there\u2019s no sign of the payouts on the super PAC\u2019s expenditure reports. The super PAC has said on X that it has disbursed money at least to the initial winners.\u00a0<\/p>\n<p class=\"\">Haverstick declined to respond to most of Summers\u2019 comments during the hearing, saying that Summers was speaking about matters that weren\u2019t at issue.\u00a0<\/p>\n<p class=\"\">Krasner\u2019s suit, by focusing on the regulation of lotteries in Pennsylvania, sidestepped questions about whether the $1 million giveaway violates laws against buying votes or paying people to register to vote.
