More than a dozen medical experts said Barnica\u2019s death was preventable. However, the state\u2019s abortion laws kept doctors from intervening until they couldn\u2019t detect a fetal heartbeat, which didn\u2019t happen until about 40 hours after the miscarriage started.<\/p>\n<p class=\"t-copy t-links-underlined t-align-left\"><a href=\"https:\/\/www.texastribune.org\/2024\/11\/01\/nevaeh-crain-death-texas-abortion-ban-emtala\/\">Nevaeh Crain<\/a>, 18, died last year after developing a dangerous complication of sepsis that doctors refused to treat while her six-month-old fetus still had a heartbeat. Two emergency rooms didn\u2019t treat her and a third delayed care, moving Crain to the intensive care unit only after she was experiencing organ failure. Medical experts said if the hospital staff had treated her early, they either could have helped Crain with an early delivery or saved her life by ending the pregnancy if the infection had gone too far.<\/p>\n<p class=\"t-copy t-links-underlined t-align-left\">\u201cJosseli Barnica and Nevaeh Crain should be alive today,\u201d the doctors wrote in their <a href=\"https:\/\/pbs.twimg.com\/media\/Gbexbo5bIAA320E?format=jpg&amp;name=large\">letter<\/a>. \u201cAs OBY-GYNs in Texas, we know firsthand how much these laws restrict our ability to provide our patients with quality, evidence-based care.\u201d<\/p>\n<p class=\"t-copy t-links-underlined t-align-left\">In 2021, Texas lawmakers passed a law prohibiting doctors from performing an abortion after six weeks. The law allows members of the public to sue doctors or anyone who helps perform an abortion for $10,000.<\/p>\n<p class=\"t-copy t-links-underlined t-align-left\">After the Dobbs v. Jackson ruling overturned Roe v. Wade, Texas banned almost all abortions \u2014 including in cases of rape and incest. The law does create an exception for a doctor to perform an abortion when they believe it is necessary to save the life of the pregnant patient. Doctors who violate the state\u2019s abortion law risk losing their medical license and potentially spending life in prison.<\/p>\n<p class=\"t-copy t-links-underlined t-align-left\">Doctors have said that confusion about what constitutes a life-threatening condition has changed the way they treat pregnant patients with complications. The Texas Medical Board has offered <a href=\"https:\/\/www.texastribune.org\/2024\/06\/21\/texas-medical-board-abortion-guidance\/\">guidance<\/a> on how to interpret the law\u2019s medical exception, and the Texas Supreme Court has ruled that doctors don\u2019t need to wait until there\u2019s an imminent risk to the patient to intervene. But some physicians say the guidance is vague and that hospitals are navigating each situation on a case-by-case basis.<\/p>\n<div class=\"c-plugin c-plugin--seamless c-plugin--flush \">\n<div class=\"c-plugin__inner\">\n<div class=\"c-prompt c-prompt--box c-prompt--livestream\" onclick=\"event.stopPropagation();\">\n<div class=\"c-prompt__content t-align-center\">\n<p>            <img decoding=\"async\" class=\"c-prompt__img\" src=\"https:\/\/static.texastribune.org\/media\/prompts\/promo-brief-logo.png\" alt=\"Logo for The Brief newsletter.\"\/><\/p>\n<p>The most important Texas news,<br \/>sent weekday mornings.<\/p>\n<\/p><\/div>\n<\/div><\/div>\n<\/div>\n<p class=\"t-copy t-links-underlined t-align-left\">ProPublica\u2019s reporting about Crain and Barnica comes as U.S. Sen. <a href=\"https:\/\/www.texastribune.org\/directory\/ted-cruz\/\">Ted Cruz<\/a> and U.S. Rep. <a href=\"https:\/\/www.texastribune.org\/directory\/colin-allred\/\">Colin Allred<\/a> of Dallas face off in a heated bid for one of Texas&#8217; two seats in the U.S. Senate. Their <a href=\"https:\/\/www.texastribune.org\/2024\/10\/07\/ted-cruz-texas-abortion-colin-allred\/\">divergent views on abortion<\/a> have been a central issue in the race, and both candidates have weighed in on Crain and Barnica\u2019s deaths.<\/p>\n<p class=\"t-copy t-links-underlined t-align-left\">\u201cTexas doctors can\u2019t do their jobs because of Ted Cruz\u2019s cruel abortion ban,\u201d Allred <a href=\"https:\/\/x.com\/ColinAllredTX\/status\/1852352065755828273\">wrote on X<\/a>, linking to the story about Crain. \u201cCruz even lobbied SCOTUS to allow states to ban life-saving emergency abortions.\u201d<\/p>\n<p class=\"t-copy t-links-underlined t-align-left\">In 2021, Cruz sponsored a 20-week federal abortion ban. He also co-introduced a bill that would allow states to exclude medical providers that perform abortions from receiving Medicaid funding. After the U.S. Supreme Court overturned Roe v. Wade, Cruz celebrated the decision as a \u201cmassive victory.\u201d<\/p>\n<p class=\"t-copy t-links-underlined t-align-left\">Cruz has previously said he thought Texas\u2019 exception to save the life of the pregnant mother was working. This week he reiterated that stance. He called Crain and Barnica\u2019s deaths <a href=\"https:\/\/www.houstonchronicle.com\/politics\/texas\/article\/houston-mother-death-abortion-laws-19877041.php\">\u201cheartbreaking\u201d<\/a> in an interview with The Houston Chronicle and said procedures necessary to save the life of the pregnant mother are legal in Texas.<\/p>\n<p class=\"t-copy t-links-underlined t-align-left\"><a href=\"https:\/\/www.texastribune.org\/2023\/11\/14\/texas-abortion-laws-lawsuit\/\">Dozens of women have come forward<\/a> saying that, after the state\u2019s abortion ban went into effect, they were unable to get the health care they needed for their medically complex pregnancies.<\/p>\n<p class=\"t-copy t-links-underlined t-align-left\">Last year, state lawmakers passed a law allowing abortions for people with ectopic pregnancies, a nonviable type of pregnancy in which the embryo implants outside the uterus, as well as when a patient\u2019s water breaks before the fetus is viable.<\/p>\n<p class=\"t-copy t-links-underlined t-align-left\">The doctors who signed the letter said they want to see a change in state law.<\/p>\n<p class=\"t-copy t-links-underlined t-align-left\">\u201cTexas needs a change. A change in laws.
