But the outcome was not historic: workers <a href=\"https:\/\/www.npr.org\/2021\/04\/09\/982139494\/its-a-no-amazon-warehouse-workers-vote-against-unionizing-in-historic-election\">voted against unionizing<\/a>. <\/p>\n<p>U.S. labor officials later <a href=\"https:\/\/www.npr.org\/2021\/08\/02\/1014632356\/amazon-alabama-warehouse-workers-may-get-to-vote-again-on-union\">ruled that Amazon<\/a> improperly influenced the vote, and workers voted a <a href=\"https:\/\/www.npr.org\/2022\/03\/31\/1090123017\/do-over-union-election-at-amazons-bessemer-warehouse-is-too-close-to-call\">second time in 2022<\/a>. The outcome remained <a href=\"https:\/\/www.npr.org\/2022\/03\/31\/1090123017\/do-over-union-election-at-amazons-bessemer-warehouse-is-too-close-to-call\">too close to call for years<\/a>, with hundreds of ballots challenged by either Amazon or the Retail, Wholesale and Department Store Union as the two accused each other of breaking labor laws. <\/p>\n<aside id=\"ad-backstage-wrap\" class=\"ad-wrap backstage\" aria-label=\"advertisement\">\n<\/aside>\n<p>For months, in a tiny courtroom in Birmingham, an administrative law judge at the National Labor Relations Board <a href=\"https:\/\/www.npr.org\/2024\/04\/25\/1246423390\/amazon-warehouse-alabama-union-vote\">heard testimony about the 2022 election<\/a> from workers, Amazon managers and officials from the agency itself.<\/p>\n<p>The labor board&#8217;s own investigators painted a picture of an aggressive and illegal anti-union campaign by the company. The union asked for another do-over of the vote. The company challenged how the government ran the last vote and reiterated that workers &#8220;made their voices heard&#8221; as they rejected the union in the original election. <\/p>\n<p>That original vote against unionizing was set aside by federal labor officials because they <a href=\"https:\/\/www.npr.org\/2021\/08\/02\/1014632356\/amazon-alabama-warehouse-workers-may-get-to-vote-again-on-union\">ruled that Amazon<\/a> improperly influenced the election, particularly by <a href=\"https:\/\/www.npr.org\/2022\/01\/26\/1075833289\/why-a-mailbox-continues-to-loom-over-amazon-warehouse-union-vote-in-alabama\">placing a mailbox for ballots<\/a> in an Amazon-branded tent in a surveilled parking lot.<\/p>\n<p>Now Judge Michael Silverstein is ordering a third election, finding that Amazon illegally confiscated union materials from the break room, among other violations. But Silverstein also moved to dismiss several allegations of unfair labor practices by Amazon. <\/p>\n<p>Amazon says it plans to appeal the ruling. <\/p>\n<p>&#8220;This decision is wrong on the facts and the law,&#8221; Spokesperson Mary Kate Paradis said in a statement. She criticized the labor board and the union for &#8220;trying to force a third vote instead of accepting the facts and the will of our team members.&#8221; <\/p>\n<aside id=\"ad-secondary-wrap\" class=\"ad-wrap secondary\" aria-label=\"advertisement\">\n<\/aside>\n<p>The union also is challenging parts of the order, which means there will be more legal reviews before a new election can be set.<\/p>\n<p>\u201cWe reject [the judge\u2019s] decision not to provide any of the significant and meaningful remedies which we requested and would be required for a free and fair election,\u201d RWDSU President Stuart Appelbaum <a href=\"https:\/\/www.rwdsu.org\/news\/amazon-3rd-election\">said in a statement<\/a>. \u201cThere is no reason to expect a different result in a third election \u2013 unless there are additional remedies. Otherwise, Amazon will continue repeating its past behavior and the Board will continue ordering new elections.\u201d<\/p>\n<p>Separately, Amazon continues to <a href=\"https:\/\/www.npr.org\/2023\/01\/11\/1125205641\/amazon-warehouse-union-staten-island\">legally challenge<\/a> the <a href=\"https:\/\/www.npr.org\/2022\/04\/01\/1089318684\/amazon-labor-union-staten-island-election-bessemer-alabama-warehouse-workers\">historic 2022 union victory<\/a> at a facility in Staten Island, N.Y. That election formed the first \u2014 and so far only \u2014 unionized Amazon warehouse in the country, but the company still refuses to begin bargaining with some 5,500 unionized workers. <\/p>\n<p>The upstart union that prevailed in New York \u2014 the independent Amazon Labor Union, saw its finances and organization deteriorate over the two-year standoff with Amazon.
