Wade<\/a><\/span> in 2022, a ruling that struck down the nearly 50-year nationwide right to abortion, proving that abortion opponents can win on ballot measures.<\/p>\n<p>There were firsts on the other sides, too: Three amendments call for rolling back abortion bans, including one in <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-missouri-amendment-ballot-election-f114445b087e77d0cc786d3eeb2eb615\">Missouri<\/a><\/span> that bars it at all stages of pregnancy with exceptions only under limited circumstances to save the life of the woman.<\/p>\n<p>Here\u2019s a look at takeaways from the results.<\/p>\n<h2>Abortion is headed to court in the push to overturn Missouri\u2019s ban<\/h2>\n<p><span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-missouri-amendment-ballot-election-f114445b087e77d0cc786d3eeb2eb615\">Missouri<\/a><\/span> is the most populous state where a ballot measure could roll back a current ban on abortions at all stages of pregnancy.<\/p>\n<p>But the work isn\u2019t done there.<\/p>\n<p>Planned Parenthood affiliates that operate in Missouri filed in a state court Wednesday seeking to invalidate the state\u2019s abortion ban and several laws that regulate the care.<\/p>\n<p>The Missouri amendment, which is to take effect Dec. 5, does not specifically override any state laws. Instead, the measure left it to advocates to ask courts to knock down bans that they believe would now be unconstitutional.<\/p>\n<p>Planned Parenthood leaders said Wednesday on a Zoom call with reporters that they want to start offering abortions at clinics in Columbia, Kansas City and St. Louis if they get the judicial ruling they\u2019re requesting \u2014 starting with blocking enforcement of laws on the book. <\/p>\n<p>\u201cThis is only the first step to realizing and fully implementing the protections of Amendment 3. It\u2019s certainly not the last step,\u201d said Richard Muniz, interim president and CEO of Planned Parenthood Great Rivers.<\/p>\n<p>Clinics had stopped providing abortions in Missouri even before the state\u2019s ban took effect in 2022. They said a list of regulations made it impossible for them to operate. In its legal filing, the Planned Parenthood affiliate that covers much of the state says the onerous requirements include clinicians who provide abortion have surgical licenses and that they conduct pelvic exams on all patients \u2014 even if they offer only medication abortions.<\/p>\n<p>\u201cSome of these patients choose medication abortion precisely because they do not want instruments inserted into their vagina,\u201d Dr. Selina Sandoval, an associate medical director for Planned Parenthood Great Plains, said in a legal filing. \u201cI cannot and will not subject my patients to unnecessary exams.\u201d<\/p>\n<p>Planned Parenthood also objects to laws requiring clinicians to have admitting privileges at nearby hospitals, mandating a 72-hour waiting period for abortions and banning telemedicine for abortion. Support us. <\/i><span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/donate\" target=\"_blank\" rel=\"noopener\"><i>Donate to the AP<\/i><\/a><\/span><i>.<\/i><\/p>\n<\/div>\n<\/div>\n<h2>Abortion rights are popular with voters<\/h2>\n<p>Abortion rights advocates <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-ballot-measures-harris-trump-florida-missouri-49c9073cbb6056b66a8a7d0d099795d1\">heralded victories<\/a><\/span> at the ballot box as a signal of <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-trump-biden-election-2024-dobbs-498d14f6e2bbfe1f313f006ad089de4e\">widespread support<\/a><\/span> for abortion rights, even in conservative states.<\/p>\n<p>The three states where abortion measures were defeated had special circumstances that weren\u2019t present in the others.<\/p>\n<p><span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-marijuana-ballot-amendments-desantis-trump-florida-bf6cdcd8455936510cf042a95050ce0f\">In Florida<\/a><\/span>, the threshold for passing a constitutional amendment is 60% while most states require a simple majority. Most voters supported adding abortion rights \u2014 but it fell short of the requirement.<\/p>\n<p>There, Gov. Ron <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-ron-desantis-florida-election-2024-6fa32787580e935a819248504345cb3c\">DeSantis<\/a><\/span>, a Republican with a national profile, also presented a challenge to proponents by steering <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-ballot-measures-fundraising-florida-arizona-39f0cac3078fffcf94196710c50865ec\">state GOP funds<\/a><\/span> to counter the measure and defending a state agency for publishing a webpage attacking it, among <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/florida-abortion-amendment-6-commercial-lawsuit-election-d762c425f6ec193c3edcf6e6e9c93198\">other government efforts<\/a><\/span>. <\/p>\n<p><span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/south-dakota-abortion-recreational-marijuana-2f44b07744c2ed52001d665fe4f17c97\">In South Dakota<\/a><\/span>, the measure is different from the others because it would have allowed the state to regulate abortion in the second trimester \u2014 but only in ways that protect the health of the woman. Because of that provision, most national abortion rights groups did not put money into promoting it, which could have been a factor in its failure in a conservative state.<\/p>\n<p><span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/election-2024-nebraska-abortion-marijuana-schools-6d09bba809b95cfdb8572034b578fcde\">In Nebraska<\/a><\/span>, both sides had questions on the ballot. Voters passed the one that bars abortion after the first 12 weeks of pregnancy \u2014 which is in line with current state law \u2014 and also allows the possibility of more stringent bans. They also rejected the measure that aimed to enshrine into the state constitution the right to abortion until viability, which is considered to be sometime after 21 weeks of pregnancy, though there\u2019s not a fixed time.<\/p>\n<p>Abortion rights advocates condemned the novel strategy by anti-abortion groups of putting a competing measure on the ballot as an <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-ballot-initiatives-voters-democracy-2024-7ac73939250441ddd015d3be741cfff2\">attempt to confuse voters<\/a><\/span>. The approach was considered by anti-abortion groups elsewhere.<\/p>\n<h2>Trump\u2019s return to the White House could also shape abortion policy<\/h2>\n<p>Republican Donald Trump <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/election-day-trump-harris-white-house-83c8e246ab97f5b97be45cdc156af4e2\">reclaimed the presidency<\/a><\/span>, despite his consistently <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-abortion-election-2024-ivf-contraception-d91f0959087e803db390be11eb60975b\">shifting stances<\/a><\/span> on reproductive rights.<\/p>\n<p>If Republicans win the House, in addition to their victories in the <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/congress-elections-house-senate-harris-trump-94b49277db2a5c21f23236794a36afa6\">Senate<\/a><\/span> and White House, it could open the door to the passage of a national ban.<\/p>\n<p>Trump <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-harris-vance-walz-debate-2024-election-abortion-64c739e99ffa1ad51b973e420e1fe92d\">has said<\/a><\/span> he would veto a national ban, despite previously <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-trump-harris-contraception-debate-vance-2f11a66ab4619fcb3d9917ee51a9c060\">declining to answer questions<\/a><\/span> about it.<\/p>\n<p>But Republicans have been accused of attempting to recast federal abortion restrictions as \u201cminimum national standards\u201d in order to distort their own stances on the issue, given the political unpopularity of the GOP\u2019s position on abortion.<\/p>\n<p>Judicial appointments have already shaped the national abortion landscape. Trump has repeatedly taken credit for appointing three justices to the U.S. Supreme Court who helped form the majority that overturned Roe v. Wade. It\u2019s not just the Supreme Court. Trump-nominated U.S. District <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/judge-shopping-abortion-pill-97188c88505ccda8b81f2997020b4112\">Judge Matthew Kacsmaryk<\/a><\/span> has issued rulings with nationwide consequences, including one impacting <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/supreme-court-abortion-mifepristone-fda-4073b9a7b1cbb1c3641025290c22be2a\">access to the abortion pill mifepristone<\/a><\/span>.<\/p>\n<p>Through executive power, a president could also restrict abortion pills sent <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/comstock-act-abortion-pills-dbf61e25f6f23cd3772c597dd6d4e337\">through the mail<\/a><\/span> and declare that a law that requires doctors to <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-supreme-court-idaho-emergency-care-000a2482fdd1f1299599c91a6cc7635a\">stabilize emergency room patients<\/a><\/span> does not require them to provide abortion. A new administration could also pull back on a <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/supreme-court-emergency-abortion-idaho-fda6b6b8cefd026dea95011dfcf11426\">federal lawsuit<\/a><\/span> that challenges aspects of Idaho\u2019s ban.<\/p>\n<h2>Results show voters willing to split the ticket on abortion issues<\/h2>\n<p>One interpretation of the presence of some of the ballot measures was that they were put up in part to drive turnout of Democratic voters in candidate elections.<\/p>\n<p>If that was the plan \u2014 and some abortion rights advocates say it wasn\u2019t \u2014 it didn\u2019t seem to sway other statewide races.<\/p>\n<p>The mostly Republican states of Montana and Missouri passed abortion rights protections and also elected GOP candidates for president, U.S. Senate and governor.<\/p>\n<p>In Montana, Republican <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/senate-election-tester-sheehy-montana-f882b50bf4af6a87ec32e3a5f626eccb\">Tim Sheehy<\/a><\/span> defeated three-term incumbent Sen. Jon Tester, who attempted to pair his campaign with the abortion rights push.<\/p>\n<p>Three other Republican states \u2014 Florida, Nebraska and South Dakota \u2014 rejected abortion ballot measures and supported Trump for president and GOP senators where they were on the ballot.<\/p>\n<p>The Democratic states of Colorado and Maryland expanded abortion rights and voted for Democrats in statewide elections. The same is true in New York, where the ballot measure bars discrimination on the basis of \u201cpregnancy outcomes\u201d and does not mention abortion specifically \u2014 but was championed by abortion rights advocates, who say it will preserve access.<\/p>\n<p>The measures also passed in Arizona and Nevada, where the presidential and U.S. Senate races had not been called by midday Wednesday.<\/p>\n<h2>Abortion rights fail to deliver Democrats wins in Senate<\/h2>\n<p>Democrats in the most competitive <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/live\/senate-house-election-updates-11-5-2024\">Senate races<\/a><\/span> centered their closing argument and ads around abortion, an issue they hoped to capitalize on after it has previously motivated voters up and down the ballot. But abortion rights <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/congress-elections-house-senate-harris-trump-94b49277db2a5c21f23236794a36afa6\">failed to put them<\/a><\/span> over the top \u2014 including in Montana.<\/p>\n<p>Texas Rep. Colin Allred, a Democrat, failed in his bid to defeat <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/senate-texas-ted-cruz-colin-allred-e791c362621efac9fac78a3a146f77d1\">Sen. Ted Cruz<\/a><\/span> after <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/texas-senate-allred-cruz-ad-campaign-abortion-69b5a7db65cd82d1bbe258d874ae6c6c\">investing $5 million<\/a><\/span> in an ad campaign focused on abortion and invoking the issue in campaign trail speeches and during an <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/allred-cruz-texas-senate-debate-9b8a5439c62752a536a9da334b7797b3\">October debate<\/a><\/span>. Allred leaned on the <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-texas-ban-7d865cdfd75bdc6b2f4186f4d1e6e8bd\">personal stories<\/a><\/span> of Texas women impacted by the state\u2019s abortion ban that have sparked national outrage.<\/p>\n<p>In Ohio, <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/election-2024-senate-ohio-brown-moreno-74c4b91e5866215d4201377fefcadad0\">Republican Bernie Moreno<\/a><\/span> defeated incumbent Sen. Sherrod Brown after Brown and his allies pounced on <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/election-2024-senate-ohio-moreno-brown-abortion-2771a833403d1a29db295d50cc307a7e\">cellphone video<\/a><\/span> that emerged late in the campaign showing Moreno criticizing suburban women who base their votes on abortion rights.<\/p>\n<p>A <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/wisconsin-senate-baldwin-hovde-debate-b406f160d6f17bd75047471dbba83460\">hotly contested race<\/a><\/span> between Democratic Sen.
