{"id":125130,"date":"2024-11-12T22:51:45","date_gmt":"2024-11-12T15:51:45","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=125130"},"modified":"2024-11-12T22:51:45","modified_gmt":"2024-11-12T15:51:45","slug":"new-york-judge-delays-presidential-immunity-ruling-in-trump-hush-money-case","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=125130","title":{"rendered":"New York judge delays presidential immunity ruling in Trump &#8220;hush money&#8221; case"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div id=\"\">\n<p><em>New York \u2014<\/em>\u00a0President-elect <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/what-happens-to-trumps-criminal-cases-if-he-wins-2024-election\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\" rel=\"noopener\">Donald Trump&#8217;s criminal conviction<\/a><\/span> lives on, at least for another week.<\/p>\n<p>A New York judge on Tuesday deferred making an immediate decision on whether presidential immunity should have prevented jurors from seeing certain evidence at Trump&#8217;s trial this spring \u2014 and if the verdict should be tossed.<\/p>\n<p>Justice Juan Merchan said he will rule next week on whether a <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/supreme-court-trump-immunity-decision-opinion\/\" data-invalid-url-rewritten-http=\"\">July Supreme Court ruling<\/a><\/span> granting Trump presidential immunity for official acts precludes a jury from finding him guilty after a criminal trial this spring.<\/p>\n<aside class=\"newsletter_signup \">\n<figure class=\"embed embed--type-newsletter-widget embed--float-none embed--size-large embed--type-iframe\" data-ads=\"{\" wordcount=\"\">\n<\/figure>\n<\/aside>\n<p>Sentencing is so far still scheduled for Nov. 26.<\/p>\n<p>A prosecutor for Manhattan District Attorney Alvin Bragg emailed Merchan Sunday night, saying Trump asked for a pause &#8220;based on the impact on this proceeding from the results of the Presidential election.&#8221;\u00a0<\/p>\n<p>&#8220;The People agree that these are unprecedented circumstances,&#8221; wrote the prosecutor, Matthew Colangelo, who added there&#8217;s a need to balance the interests of &#8220;a jury verdict of guilt following trial that has the presumption of regularity; and the Office of the President.&#8221;<\/p>\n<p>Trump lawyer Emil Bove followed up in his own email to Merchan, writing that a &#8220;stay, and dismissal, are necessary to avoid unconstitutional impediments to President Trump&#8217;s ability to govern.&#8221;<\/p>\n<p>The long-awaited ruling, on whether evidence shown at trial should have been shielded from jurors, due to presidential immunity, could have profound consequences for the case.\u00a0<\/p>\n<p>Trump was the first former president ever to be <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/trump-judge-juan-merchan-indictment-manhattan-new-york\/\" data-invalid-url-rewritten-http=\"\">convicted of crimes<\/a><\/span>. On Nov. 5, he also became the <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/donald-trump-win-presidency-2024\/\" data-invalid-url-rewritten-http=\"\">first person with a criminal record<\/a><\/span> ever to be elected president.\u00a0<\/p>\n<p>Trump&#8217;s lawyers vowed the day a <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/live-updates\/trump-trial-verdict-jury\/\" data-invalid-url-rewritten-http=\"\">unanimous jury found him guilty<\/a><\/span> of felonies in May to fight his conviction. They were given an extraordinary opportunity not long after when the <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/supreme-court-trump-immunity-decision-opinion\/\" data-invalid-url-rewritten-http=\"\">Supreme Court ruled former presidents are immune<\/a><\/span> from prosecution for official acts. The decision said evidence related to Trump&#8217;s work as president could not be used at trial.<\/p>\n<p>Trump&#8217;s legal team, which is led by Todd Blanche, seized on the landmark ruling, demanding <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/trump-conviction-hush-money-case-new-york-prosecutors\/\" data-invalid-url-rewritten-http=\"\">Trump&#8217;s conviction be set aside<\/a><\/span>, and his sentencing canceled. They argued jurors should never have heard testimony related to Trump&#8217;s communications with former White House communications director <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/trump-trial-new-york-witness-testimony-week-3\/\" data-invalid-url-rewritten-http=\"\">Hope Hicks<\/a><\/span>, or his former executive assistant and director of White House Operations Madeleine Westerhout.<\/p>\n<p>Prosecutors argued in response that the Supreme Court ruling didn&#8217;t apply to evidence shown at trial. They also said the material protested by Trump&#8217;s lawyers were &#8220;a sliver of the mountains&#8221; of evidence the jury considered.<\/p>\n<p>The jury ultimately concluded that <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/trump-charges-conviction-guilty-verdict\/\" data-invalid-url-rewritten-http=\"\">Trump committed 34 felonies<\/a><\/span> in signing off on a scheme to cover-up reimbursements to <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/supreme-court-michael-cohen-trump-lawsuit\/\" data-invalid-url-rewritten-http=\"\">Michael Cohen<\/a><\/span>, his former attorney and fixer. Cohen had paid $130,000 to adult film star <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/live-updates\/trump-trial-testimony-bookkeeping-gag-order-contempt\/\" data-invalid-url-rewritten-http=\"\">Stormy Daniels<\/a><\/span>, days before the 2016 presidential election, to buy her silence about an alleged sexual encounter with Trump years early. The agreement has often been referred to as a &#8220;hush money&#8221; deal.<\/p>\n<p>Trump insists he is not guilty of falsifying business records \u2014 the charge he was convicted on \u2014 and has vehemently denied Daniels&#8217; story.<\/p>\n<p>The Supreme Court&#8217;s decision in July was the latest curveball in a case that dates back to 2018, when the Manhattan District Attorney&#8217;s office first began investigating the &#8220;hush money&#8221; deal.<\/p>\n<p>Trump, amid his first term as president, fought the investigation as it expanded into a wide-ranging probe of his finances. The case&#8217;s first landmark Supreme Court ruling came in 2020, when the nation&#8217;s highest court ruled the Constitution does not preclude a state criminal subpoena of a sitting president. The ruling allowed the Manhattan District Attorney, then Cyrus Vance Jr., access to Trump&#8217;s tax returns.<\/p>\n<p>The borough&#8217;s next district attorney, Alvin Bragg, took up the case but narrowed its focus, bringing it back to the &#8220;hush money&#8221; deal. On March 31, 2023, a grand jury made Trump the first ever former, and future, president indicted for crimes.<\/p>\n<p>Trump&#8217;s seven-week trial began just more than a year later, on April 15.
