Patrick Haggard approved 26-year-old Jose Antonio Ibarra\u2019s waiver. Through his translator, Ibarra told the judge he understands he can\u2019t reverse his decision.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3elsykr0000356m1xpjojd7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Riley, a 22-year-old Augusta University College of Nursing student, was <a href=\"https:\/\/www.cnn.com\/2024\/02\/24\/us\/uga-augusta-university-student-death-saturday\/index.html\">killed February 22<\/a> while out for a run on the University of Georgia\u2019s campus. The bench trial will now begin at 9 a.m. Friday and will continue Monday, Haggard said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3epvbrd0002356mexua2l18@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            For the bench trial, evidence and witness or expert testimony will be presented to the judge in open court, similar to how they would be presented to a jury.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3elwm3k0005356m6yltpu3t@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The switch to a bench trial came after the judge denied a motion from Ibarra\u2019s defense attorneys requesting some evidence in the case be suppressed ahead of trial, court records show.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3eltn040004356mmpi0osgr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Ibarra was <a href=\"https:\/\/www.cnn.com\/2024\/05\/08\/us\/laken-riley-killing-indictment\/index.html\">indicted<\/a> in May on 10 counts, including charges related to Riley\u2019s death and another incident in which Ibarra allegedly went to a UGA apartment building the same day as the killing, looked through a window and spied on a student, his indictment states.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3entv0z0000356m4ltdoy3o@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Riley went for a morning run on the UGA campus, where she had studied until May 2023 before switching to Augusta University.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3eo2x3j000a356min9td248@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Police started searching for Riley after receiving a call around noon February 22 from a friend who said Riley had not returned from her jog at UGA\u2019s intramural fields, UGA Police Chief Jeff Clark said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3eobw8g000h356msvcozn86@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Less than an hour later, Riley\u2019s body was found near a lake.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3eobd77000f356m5fb9e2ch@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Police connected Ibarra to Riley\u2019s killing by using <a href=\"https:\/\/www.cnn.com\/2024\/02\/23\/us\/uga-augusta-university-student-death\/index.html\">campus security camera footage<\/a>, physical evidence and key input from the community, Clark said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3eo7pt0000c356me0ihnz83@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Ibarra struck Riley in the head with a rock multiple times and asphyxiated her, according to his indictment.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3eopl0m0017356mv2xsp3l9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Ibarra was arrested the day after Riley\u2019s death. Investigators have said there is no evidence he and Riley knew each other, and police described the killing as a \u201c<a href=\"https:\/\/www.cnn.com\/2024\/02\/25\/us\/uga-augusta-university-student-killing-monday\/index.html\">crime of opportunity<\/a>.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3eoevau000o356m34z4sdr2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Ibarra was arrested in 2022 after entering the US illegally and was \u201c<a href=\"https:\/\/www.cnn.com\/2024\/02\/25\/us\/uga-augusta-university-student-killing-monday\/index.html\">paroled and released for further processing<\/a>,\u201d US Immigration and Customs Enforcement said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3eooiqf000z356mizwmnb5s@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            He also was arrested by New York City police in September 2023 and charged with \u201cacting in a manner to injure a child less than 17 and a motor vehicle license violation,\u201d ICE asserted in a news release. But police released Ibarra \u201cbefore a detainer could be issued,\u201d ICE said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3eoh2yh000t356mha1vbpjs@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            When asked about ICE\u2019s statement about Ibarra\u2019s arrest and release, New York\u2019s office of the deputy commissioner of public information said it did not have a record of Ibarra\u2019s arrest.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3eopgro0014356m6p8716y4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            By February 2024, Ibarra was living in Athens, Georgia \u2013 home to the University of Georgia, where Riley was killed.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3eoq1ew001a356m8speu5os@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Republican President-elect Donald Trump blamed the Biden administration\u2019s immigration policies for contributing to Riley\u2019s death. In the months leading up to his election, Trump vowed to conduct a large-scale <a href=\"https:\/\/www.cnn.com\/2024\/11\/11\/us\/closed-border-trump-immigration-deportation\/index.html\">deportation of undocumented migrants<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3eoqmo8001e356mg2ljnbyr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            <a href=\"https:\/\/www.cnn.com\/politics\/live-news\/election-campaign-news-03-09-24#h_bc4571a0ebae3106a282167ee73a316b\">Riley\u2019s parents attended a Trump rally<\/a> in March and met with Trump backstage, co-campaign manager Chris LaCivita said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3eorh70001h356mcku60lfl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Democrats have also invoked Riley\u2019s death in political speeches.
